CITY OF ATLANTIC BEACH CODE ENFORCEMENT BOARD MINUTES 7:00 P.M., March 8, 2005 Call to Order: PRESENT: Curtis Sanders, Jr., Chairman Ray Breault Mamie Hurd Suzanne Noel Carl Russell AND: Alex Sherrer, Code Enforcement Officer Susan Gorman, Secretary Suzanne Green, Prosecuting Attorney Alan Jensen, City Attorney ~ ABSENT: Don Wolfson Peter Wynkoop, excused Chairman Sanders called the meeting to order at 7:05 p.m., followed by the Pledge of Allegiance to the Flag by all present. 1. Approval of the Minutes of the Regular meeting held on November 9, 2005 There were no changes to the minutes and it was unanimously approved to accept the minutes as presented. 2. Recognition of Visitors and Guests regarding any matters not listed on the agenda. There were no other visitors or guests present. 3. Unfinished Business from previous meeting: Code Enforcement Officer Alex Sherrer gave follow-up reports on the following cases: A. COMPLIANCE: (1). Case No.: 308-04, Animal Citation -Harry Cain of 449 Mako Dr., $1,555.00 lien placed on homeowners property. ~,.... (2). Case No.: 440-04, Animal Citation -Elaine Dance of 1690 Jordan St., $1843.801ien placed on homeowners property. Page 2 Code Enforcement Board March 8, 2005 4. New Business: A. Elect a new Vice -Chairman for the Board Chairman Sanders asked Board members to consider serving as Vice Chairman, then instructed the Board to select a Vice Chairman. Ray Breault motioned for Karl Russell to service as Vice Chairman, and the motion carried. B. Discussion on Code Enforcement Fines. Code Enforcement Officer Alex Sherrer advised the Board of recommendations made by Finance at the January, 2005 Workshop. Finance would prefer the Board not to set specific amounts for payment each month, but determine time limits for payment of fines/fees. Several options are available to enforce compliance. Liens as little as $100.00 can be placed against a property or Finance can turn all outstanding fines/fees to a collection agency. C. HEARINGS All witnesses were sworn in and the following testimony was given: Case No: 24-OS , Mr. Joseph Nedeau, 105 W. 6th St., Atlantic Beach, Fl, Chapter 12, Section 12-1 (6) Structurally Unsound Fence. The Board heard testimony from Building Official, Don Ford regarding the disrepair of the privacy fence located at 105 W. 6th Street. Code Enforcement Officer Alex Sherrer gave testimony regarding the condition of the fence and the background information concerning the violation history. The Respondent was present and testified that he made repairs to the privacy fence before the Hearing. Don Ford stated his most recent inspection of the privacy fence on March 8, 2005 confirmed the instability of the structure. Board member Breault suggested that Building Official Don Ford and Code Enforcement Officer Alex Sherrer should meet with Mr. Nedeau before further attempts to repair the fence commence in order to comply with Building code standards. Mr. Nedeau was found in violation by the Board. Board member Ray Breault motioned to give Mr. Nedeau thirty days from March 9, 2005 to repair, remove or replace the privacy fence before fines commence at $25.00 per day for the first 15 days, and will double every 15 days. Failure to comply will result in the maximum fine of $250.00 per day plus administrative costs . Mamie Hurd seconded and the motion carried. Page 3 Code Enforcement Board March 8, 2005 Case No.: 857-04, Ms. Karen Ann Woods, 103 3rd St. W, Atlantic Beach, Fl , Chapter 4, Section 4-30 (b) (5) FAILURE TO PAY ANIMAL CONTROL FINE IN SPECIFIED AMOUNT OF TIME. The Respondent was not present. Code Enforcement Officer, Alex Sherrer explained the background information on when and why the violation was referred to Code Enforcement. Mr. Sherrer stated City policy and procedure and gave his recommendation to impose a fine and administrative costs. The Board found Ms. Woods in violation and approved a fine of $110.00 plus $288.80 administrative costs. Case No.: 711-0, Mr. Andres Guzman Rojas, 1648 Main St., Atlantic Beach, Fl, Chapter 4, Section 4-30 (b) (5) FAILURE TO PAY ANIMAL CONTROL FINE IN SPECIFIED AMOUNT OF TIME. The Respondent was present. Code Enforcement Officer, Alex Sherrer explained the background information on when and why the violation was referred to Code ,,, Enforcement. The Respondent, Mr. Rojas claimed to have paid a fine, but could not produce a receipt of payment. Animal Control Officer, Denine Zagari gave testimony regarding her knowledge of the case. The Board determined that Mr. Rojas was in violation but administrative costs would be waived if compliance is met within thirty days. 5. Board Member Comments: Alex Sherrer advised the Board of plans to request a special meeting, April 12, 2005. Board member Suzanne Noel inquired about the purpose of the meeting. The Code Enforcement Officer informed the Board that a code violation case will come before them on April 12th 6.
