2005-10-03 (special meeting minutes) vMinutes of the Special Called October 03, 2005 Community Development Board meeting MINUTES OF THE SPECIAL MEETING OF THE COMMUNITY DEVELOPMENT BOARD October 03, 2005 A special meeting of the Community Development Board was held on Monday, October 03, 2005, in the City Hall Commission Chambers. Present were Carolyn Woods, Steve Jenkins, David MacInnes, Craig Burkhart, Chris Lambertson, Community Development Director Sonya Doerr and Recording Secretary Amber Lehman. 1. Call to Order. The meeting was called to order at 5:09 p.m. 2. UBE-2005-08, Mitchell. Public hearing to consider a request for aUse-by-Exception (recommendation to the City Commission) to allow for the sale of used automobiles for property within the Commercial General (CG) Zoning District and located at 1850 Mayport Road. Ronnie Mitchell, 1850 Mayport Road, stated that he has a current dealership license, and has over 18 years of experience in operating a used car dealership. Mr. Mitchell also expressed that he wanted to clean up the area that he plans on occupying as the car dealership. He will only maintain 10-20 cars on the lot at one time. Ms. Woods asked Mr. Mitchell about the location of his building. Mr. Mitchell replied that his building is in the middle of two other buildings that look the same. Ms. Woods asked Mr. Mitchell if he had plans for hiring a salesman for his dealership. Mr. Mitchell replied that in the future he will probably hire a salesperson, but for now in the beginning stages, he will be the only employee. Ms. Woods asked Mr. Mitchell if he will be doing car repairs at this facility. Mr. Mitchell replied that he will have all repairs handled off-site. Mr. MacInnes asked Mr. Mitchell if he would have a mechanic on site. Mr. Mitchell replied that he would not have a mechanic. Mr. MacInnes asked if the building is now occupied. Mr. Mitchell replied that the building is not being occupied, but the building was a used car dealership and a tire store previously. Mr. MacInnes asked Ms. Doerr what the City Commission's stance was for more Use-by- Exceptions for auto sales and repair businesses on Mayport Road. Ms. Doerr replied that the Commission wants Mayport Road to transition into more retail and neighborhood serving uses to support goals to redevelop and improve Mayport Road. Ms. Woods asked Ms. Doerr what other zoning allow for auto repairs. Ms. Doerr responded that industrial zoning allows for auto sales. Ms. Woods stated that competition might clean-up Mayport Road Mr. Jenkins stated that in the Land Development Regulations, Section 24-63 states that certain provisions may apply to new development on Mayport Road, including consideration of consistency with the Comprehensive Plan and the Commercial Corridor standards. Minutes of the Special Called October 03, 2005 Community Development Board meeting Although this Use-by-Exception is not new construction, Mr. Jenkins stated that he feels that the Board should still consider whether this use complies with the Comprehensive Plan. Mr. Burkhart stated that since this application does not involve new construction, he does not feel that the Board can designate certain conditions from the Corridor standards that the applicant must comply with. Ms. Doerr stated that, because this is aUse-by-Exception request, the Board can recommend certain conditions even though this is not new construction. This is a request for a new business at this location, and the Comprehensive Plan and the Land Development Regulations should both be considered with this Use-by-Exception application. Ms. Woods stated that this property and the area could use some cleaning up in terms of landscaping. Ms. Doerr stated that the City has been working towards the construction of landscaped medians for about four years, and that project will soon begin. Ms. Doerr stated that the Corridor standards are intended primarily to address new development, but the long-term objective is to see less intense commercial uses and those that are more supporting of nearby residential areas. A motion was made by Mr. Jenkins to recommend denial of this Use-by-Exception to the City Commission citing the findings in the staff report. The vote was called and Mr. Jenkins, Ms. Woods, and Mr. Lambertson voted aye and Mr. MacInnes and Mr. Burkhart voted nay. The motion to recommend denial carried. 3.
