If any person decides to appeal any decision made by the Tree Conservation Board with respect to any matter considered at the above meeting, he or she will need a record of the proceedings, and for such purpose, may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is based. MINUTES OF THE REGULAR MEETING OF THE TREE CONSERVATION BOARD January 14, 2004 A regular meeting of the Tree Conservation Board was held Wednesday, January 14, 2004, at the Adele Grage Cultural Center. Present were Chair Maureen Shaughnessy, Charles Carroll, Susan Grube, Jim McCue, Bill Permenter, Building Official Don Ford and Recording Secretary Susan Dunham. 1. Call to Order The meeting was called to order at 7:00 p.m. 2. Recosnition of Visitors Ms. Susan Grube, new Tree Conservation Board member, was introduced. 3. Aauroval of Minutes of Meetings of December 10.2003 A motion was made by Board Member Permenter, seconded by Board Member Carroll, and unanimously carried to approve the Minutes of December 10, 2003. 4. Old Business A. Tree Removal Application Form: Moved to after New Business. B. Draft Ordinance Regarding Protected Corridor: Moved to after New Business. Building Official Ford suggested that the board change the order of the agenda placing New Business prior to Old Business. A motion was made by Board Member Carroll, seconded by Board Member Permenter, and unanimously carried to permanently change the order of New Business and Old Business. 5. New Business A. Tree Removal Applications 1. Lots 1, 2, 3, 4 and 5, Block 243, Section H (Stocks Street/West 14th Street): Building Official Ford clarified that the front of the property was located on Levy Road. He corrected the tree survey as follows: 1) the 7.5" oak requested for removal on the north side of the property was a 7.5" magnolia; and 2) the five trees in the clump next to the 7.5" magnolia listed as individual trees were actually a 12" multi-trunk oak. Board Member McCue asked if the entrance could be located on Stocks Street to avoid removal of trees. Building Official Ford responded that the applicant was not able to do this because of retention areas to be located on the Stock Street side and the West 14~' Street side. Building Official Ford also indicated that the surveyor incorrectly marked the property line by 18 feet so the property line was actually 18 feet further to the north. It was determined that the applicant was removing the following protected trees: a 10" oak, a 12" pine, a 7.5" magnolia, and a 12" multi-trunk oak. Building Official Ford advised that the applicant had identified a 4.5" oak and a 4.0" oak to use towards mitigation, which were not oak trees. However, he stated that he located two 5" oaks on the north side of the property which the applicant could protect. A motion was made by Board Member Permenter, seconded by Board Member Carroll, and unanimously carried to direct the Building Official to issue a permit for the removal of 7.5" of ~ magnolia, l2" of pine and 22" of oak to be mitigated with two 5" oaks on site, 6" of hardwood to be planted on site and 4" of other tree to be planted on site. Minutes of Tree Conservation Board January 14, 2004 Page 2 4. Old Business A. Tree Application Form: Suggestions for changes were made. Building Official Ford advised that he would bring the amended Tree Application form to the next meeting. B. Draft Ordinance Regarding Protected Corridor: The board made suggested changes. Building Official Ford stated that he would make the corrections and forward the Ordinance to the city attorney, Alan Jensen, for approval. 6. Reports and Announcements Building Official Ford advised that a letter was sent to Vaughn Rivers with regard to trees removed at 14 East Dutton Island Drive. He stated that this issue would be on the agenda of the next Code Enforcement Board meeting. Board members made the following suggestions for locations for new trees to be planted: 1) End of Mary Street on Dutton Island Road; 2) The corner of Main and Dutton Road; 3) Stocks Street from 790 to 887; 4) Saturiba and North Sherry Drive; 5) North Sherry, north of Saturiba Drive; and 6) Sea Oats and 19`~ Street. Building Official Ford advised the board that when the Jacksonville Transportation Authority installed a retention pond on Mayport Road, they were required to plant trees within three years. He stated that the three year timeframe had expired and the Jacksonville Transportation Authority had not planted any trees. Building Official Ford advised that he would pursue this issue next month. 7. Adiournment There being no other business or discussion, the meeting was adjourned at 8:15 p.m. Maureen Shaughnessy, Chair
