Notice to persons needing special accommodations and to all hearing impaired persons: In accordance with the Americans with Disabilities Act, persons needing special accommodation to participate in this proceeding should contact the City of Atlantic Beach (904) 247-5800, 800 Seminole Road, Atlantic Beach, Florida 32233 not later than five days prior to the date of this meeting. ,,.,, MINUTES OF THE REGULAR MEETING OF THE TREE CONSERVATION BOARD February 25, 2004 A regular meeting of the Tree Conservation Board was held Wednesday, February 25, 2004, at the Adele Grage Cultural Center. Present were Chair Maureen Shaughnessy, Charles Carroll, Bill Permenter, Building Official Don Ford and Recording Secretary Susan Dunham. Absent were Susan Grebe and Jim McCue. 1. Call to Order The meeting was called to order at 7:04 p.m. 2. Recognition of Visitors None. 3. Auaroval of Minutes of Meetings of January 28, 2004 A motion was made by Board Member Permenter, seconded by Board Member Carroll, and unanimously carried to approve the Minutes of January 28, 2004. 4. New Business A. Tree Removal Applications: The Board changed the order of the Agenda as follows: 4. 113 Fourth Street: jBuilding Official Ford advised that a total of seven palm trees were being '*- removed from the right-of--way. He stated that he talked with Public Works who advised him that there was no room to relocate the palms on the right-of--way but that it would be acceptable if the trees were mitigated on the property. He further advised that there was a 14" palm and a 6" live on site that required mitigation. Mr. Davies requested the opportunity to trim and prune the trees in the right-of--way and then take a second look. Building Official Ford advised Mr. Davies that if they removed less inches than approved that this would be no problem. Building Official Ford stated in his conversation with Mr. Davies, the applicants would like to either relocate or plant new trees. He proposed mitigating 100% for the 87" of palm trees located in the right-of--way and 50% for the 6" live oak and the 14" palm. He advised that the applicants had two 12" palms in the interior zone that could be preserved for mitigation. He further advised that they have listed three trees to be relocated which would reduce the number to 36" on the right-of--way. A motion was made by Board Member Permenter, seconded by Board Member Carroll, and unanimously carried to direct the Building Official to issue a permit for the removal of a 14" palm and a 6" live oak on site and the Board recommends to Public Works that that they allow removal of siz 12" palms and one 14" palm located in the right of way to be mitigated at 100 percent with two 12" palms and a 15" palm on site, relocate from the right of way three 12" palms and one 14" palm, and three inches of live oak to planted on site. If the applicants do not relocate the palms, they must plant 50" of trees or pay into the tree fund at $117 per inch. 2. 160 Magnolia Street: Mr. Frank Pasko introduced himself. Building Official Ford advised that this property was as a single property with two townhouses located on it. He stated that the City does not subdivide the lot and, therefore, the 5" oak was located in the interior zone and no mitigation was required. ?' A motion was made by Board Member Carroll, seconded by Board Member Permenter, and unanimously carried to direct the Building Official to issue a permit for the removal of one 5" oak with no mitigation required. Minutes of Tree Conservation Board February 25, 2004 Page 2 1. 463 Selva Lakes Circle: Building Official Ford stated that the only tree in this application requiring mitigation was a 8.5" bay which was located approximately 18.5 feet from the property line. He stated that the application indicated that the bay was diseased but at this time of year, it was hard to determine if it was diseased because it had no leaves on it. A motion was made by Board Member Permenter, seconded by Board Member Carroll, and unanimously carried to direct the Building Official to issue a permit for the removal of an 8.5" bay to be mitigated with 4.25" of hardwood to be planted on site or paid into the Tree Fund at $117 per inch. 3. 332 Seventh Street: Building Official Ford identified two trees to be removed that required mitigation, a 15" palm and a 12" palm. He stated that the application indicated that an 18" palm may be removed if they were not able to save the root structure. Building Official Ford informed the board that since the tree was located in the interior zone, if it were removed, it would not require mitigation. He stated that the applicant identified a 15" palm in the interior zone to use towards mitigation. A motion was made by Board Member Carroll, seconded by Board Member Permenter, and unanimously carried to direct the Building Official to issue a permit for the removal of a 15" palm and a 12" palm in the exterior zone to be mitigated with a 15" palm on site in the interior zone. 5. Old Business A. Tree Removal Application Form: Deferred to the next meeting. B. Draft Ordinance Regarding Protected Corridor: Building Official advised that the ordinance went in front of the Commission last Monday night and they approved it to come to the next meeting as an ordinance form for a first reading. He suggested that the board members attend the next Commission meeting. 6. Reports and Announcements Lot 1 together with the north 15 feet of Lot 2, Block 174 (Carnation and West Plaza): Building Official Ford stated that he .issued the permit on this property because the last meeting was canceled due to a lack of a quorum. He stated that the Ordinance required that the Building Department issue a permit within 15 days of application. 19te Street Lot: Building Official Ford informed the board that Coppenbarger Homes was required to spend $4,500 for trees on the lot. He provided a copy of a bill from Landscape Management and Irrigation for $4,550. He stated that Landscape Management and Irrigation planted four 4" live oaks, two 4" laurel oaks and four 4" River Birch trees. 7.
