06-30-04 vMINUTES OF SPECIAL CALLED MEETING OF TREE CONSERVATION BOARD June 30, 2004 A special called meeting of the Tree Conservation Board was held on June 30, 2004, in the Adele Grage Cultural Center. Present were Chair Maureen Shaughnessy, Jim McCue, Bill Permenter, Building Official Don Ford and Recording Secretary Susan Dunham. Absent was Charles Carroll. 1. Call to Order The meeting was called to order at 7:00 p.m. 2. Recognition of Visitors Mr. Steve Hamilton introduced himself and advised the board that he purchased two lots on Stn Street between Sherry Drive and East Coast Drive. He stated that he would be bringing a Tree Removal Application to the next meeting but asked if the board could address this issue prior to that time. Mr. Hamilton informed the board that there were three palm trees located in front of the house that prevent equipment from coming onto the lot. He asked if it would be possible to gain permission to remove the palm trees prior to the next meeting so that he could begin construction. Mr. Hamilton requested the removal of a 13" palm and two 12" palms in the interior zone. Board Member Permenter stated that these trees were not protected and he, therefore, did not have a problem approving this application based upon the Building Official verifying the measurements. A motion was made by Board Member Permenter, seconded by Board Member McCue, and unanimously carried to instruct the Building Official to issue a permit for the removal of a 13" palm and two 12" palms with no mitigation required based on the Building Official verifying the measurements. Mr. Paul Nichols of Bestcon, Inc., introduced himself. Building Official Ford advised that the board would hold a special called meeting at the Paradise Preserve site to address all the lots at one meeting. Mr. Nichols Paul advised that they were installing the infrastructure at Paradise Preserve and in order to receive permits, he needed Tree Removal Permits. He reminded the board that in the past, with respect to Hidden Paradise and Paradise Cove, each lot had been considered individually with respect to interior and exterior zones but the subdivision was treated as one with respect to mitigation. Mr. Nichols invited the board out to the site on a Saturday morning at their convenience. The board determined that the special called meeting would be held Saturday, July 10, at 8:00 a.m., at the trailer at Paradise Preserve on Dutton Island Road West. 3. Auproval of Minutes of the Meeting of June 9, 2004 A motion was made by Board Member Permenter, seconded by Board Member McCue, and unanimously carried to approve the Minutes of June 9, 2004, as written. Tree Removal Applications 1. 1845 Hickory Lane: Building Official Ford advised that a 24" oak had been removed without a permit and it was approximately three feet from their property line in the city right-of- way. He further advised that the owners took out a total of four trees, three on their lot and the one located on the city right-of--way. A motion was made by Board Member McCue, seconded by Board Member Permenter, and unanimously carried to request that the Building Official assess mitigation at 100 percent fora 24" oak at $117 per inch. In addition, that the Building Official discover the name of the tree removal firm and that some appropriate action be taken against this tree removal firm for not going through the proper channels and discovering whether they could legally remove the tree on the city right-of--way. Discussion was held with regard to fining tree removal companies who cut down trees illegally. Building Official Ford advised that over $6,000 had been assessed in the last month for trees that were removed without a permit. Discussion was held with regard to notifying the newspapers so that an article could be written to educate the community. Building Official Ford advised that the new Public Works Director did not want to be involved in tree mitigation in the future but wanted the Tree Conservation Board to assess mitigation at 100 percent on trees removed from city right-of--way. Building Official Ford stated that in the future the board would make a recommendation to the Building Official instead of the Public Works Director. 2. Part f Lot 1, Section 18, Township 2, Section H (Lot 1) (Kestner Road): Building Official Ford that the 8" pine, the 20" pine and the 15" pine were all located in the city right-of--way. A motion was made by Board Member Permenter, seconded by Board Member McCue, and unanimously carried to recommend that the Building Official issue a permit for the removal of an 8" pine, a 20" pine and a 15" pine in the city right-of--way to be mitigated with a 4" oak, a 5" oak, a 6" oak, an 11" oak, a 4" maple, a 5" oak and an 18" pine. A motion was made by Board Member Permenter, seconded by Board Member McCue, and unanimously carried to direct the Building Official to issue a permit for the removal of one 14" pine to be mitigated on site with one 12" pine. 3. Part of Lot 1, Section 18, Township 2, Section H (Lot 2) (Kestner Road): A motion was made by Board Member Permenter, seconded by Board Member McCue, and unanimously carried to recommend that the Building Official issue a permit for the removal of an 18" pine, a 7" pine and a 20" palm in the city right~f--way to be mitigated at 100 percent at $117 per inch. *., A motion was made by Board Member Permenter, seconded by Board Member McCue, and unanimously carried to request that the Building Official issue a permit for the removal of two 12" pines, an 8" myrtle and a 30" oak to be mitigated on site with two 4" oaks, one 3" oak, one 5" oak and one 18" pine. Minutes of June 30, 2004, Special Called Meeting of Tree Conservation Board Page 3 4. 1525 Richardson Lane: Building Official Ford informed the board that all the trees on the lot were in poor condition except the large multi-trunk pine tree labeled on the survey as trees "D" "E" and "F." He stated that he would encourage the applicant to save this tree. Board Member Permenter suggested that the Building Official speak with the applicant and then issue the permit based on the applicant's response. Building Official Ford advised that he would update the board on this application at the next meeting. 5. 319 12th Street: Building Official Ford stated that Commissioner Beaver requested that the Board disregard the three trees in the northern property line because he had not determined if these trees were to be removed. A motion was made by Board Member McCue, seconded by Board Member Permenter, and unanimously carried to request that the Building Official issue a permit for the removal of a 16" palm in the exterior zone to be mitigated with an 8" palm to be planted on site. 5. Old Business None. 6. Reports and Announcements Building Official Ford advised that the Protected Corridor Ordinance letter was delivered to the city commission last week. 7.
