REGULAR MEETING OF
TREE CONSERVATION BOARD
July 28, 2004
A regular meeting of the Tree Conservation Board was held on Wednesday, July 28, 2004, at the
Adele Grage Cultural Center. Present were Chair Maureen Shaughnessy, Jim McCue, Bill
Permenter, Deputy Building Official Larry Higgins and Recording Secretary Susan Dunham.
Absent were Charles Carroll and Elizabeth Green.
1. Call to Order
The meeting was called to order at 7:03 p.m.
2. Recognition of Visitors
None.
3. Approval of Minutes of June 30, 2004, and July 10, 2004
A motion was made by Board Member Permenter, seconded by Board Member
McCue, and unanimously carried to approve the Minutes of June 30, 2004, as written.
A motion was made by Board Member McCue, seconded by Board Member Permenter,
and unanimously carried to approve the Minutes of July 10, 2004, as written.
4. New Business
A. Tree Removal Applications:
1. 352 St" Street: Mr. Steve Hamilton introduced himself. He advised that originally he was
going to save the 20" cedar by the driveway but it now needed to be removed. Mr. Hamilton
also informed the board that there was a 13" palm on the site that was diseased.
A motion was made by Board Member Permenter, seconded by Board Member McCue,
and unanimously carried to direct the Building Official to issue a permit for the removal of
a 20" cedar, an 11" palm and a 13" palm to be mitigated with 22" of oak to be planted on
site.
2. Lot 1, Block 126, Section H (6t" Street and Stocks Street): Mr. Larry Smallwood
introduced himself. Discussion was held and it was determined that the tree surveys were not
accurate. The board requested that Mr. Smallwood prepare correct tree surveys and submit new
applications.
A motion was made by Board Member McCue, seconded by Board Member Permenter,
and unanimously carried that the applicant re-submit his applications for tree removal for
Lots 1-5, Section H.
3. Lot 2, Block 126, Section H (6t" Street and Stocks Street): Deferred.
4. Lot 3, Block 126, Section H (6t" Street and Stocks Street): Deferred.

6. Reports and Announcements
Susan Dunham introduced Amber Lehman, her replacement, to the board members.
Board Member Shaughnessy brought up for discussion the Island Club Condominiums and their
parking. She stated that at the second reading it appeared that the suggestion was that if the City
were to possibly lease public parking spots to these owners, that the City would replace parking
from another area. She indicated that the other area chosen was Mandalay Park on the corner of
16t" Street, Ocean Boulevard and Seminole Road. Board Member Shaughnessy stated that this
park had a beautiful old canopy and was a cool beautiful haven. She stated that she was very
concerned that for a few people, the City would consider something as drastic as cutting down an
existing hammock and putting in concrete parking lots six blocks from the ocean. She advised
that six trees were going to be removed and she found this incomprehensible. Board Member
McCue stated that this was remote from the oceanfront and that the parking spaces should be
replaced in the same proximity to the ocean. Board Member Permenter stated that from a Tree
Conservation Board point of view, regardless of what occurs at lOt" Street, the board was
attempting to protect a corridor in the old Selva Norte area and the board had just assessed over
$6,000 to people who have cut down trees on public property without permission. He stated that
now the City was going to cut down six trees, disturbing the canopy, and placing perpendicular
parking in that area. Board Member Permenter stated that he thought that was something that the
board should be concerned about, not only in Mandalay Park but anywhere that trees were to be
removed. He further stated that this area was a natural preserve and he felt very strongly about
that.
A motion was made by Board member McCue and seconded by Board Member Permenter
to request that the City Council address other possibilities other than this, look at parallel
parking at other locations on Beach Avenue, in particular where the neighbors often put
palm trees in the right-of--way to prevent people from parking in front of their homes. We
seek a solution that brings the parking places closer to the oceanfront where they can be
used by the general public.
Discussion was held and it was determined that the motion would be withdrawn and a new
motion stated.
Board Member McCue withdrew his motion. Board Member Permenter withdrew his
second.
A motion was made by Board Member McCue, seconded by Board Member Permenter,
and unanimously carried to request that the City Commission carefully study any
possibility of tree removal anywhere to create parking spaces and that the City
Commission and staff study alternatives in other locations in closer proximity to the beach
and beach access.
