01-10-07Minutes of January 10, 2007, Tree Conservation Board CC TO: ^ City Cc^~;~?csion .~ MINUTES OF THE ^ City f~t:crney REGULAR MEETING OF THE ^ Press ^ File TREE CONSERVATION BOARD ^ January 10, 2007 ~ Date: A regular meeting of the Tree Conservation Board was held Wednesday, January 10, 2007 at the Adele Grage Cultural Center. Present were Chair Maureen Shaughnessy, Jim McCue, Stephanie Catania, Charles Carroll, Public Works Director Rick Carper, and Recording Secretary Bambi Dickinson. Carole Varney was excused. 1. Call to Order The meeting was called to order at 7:OOpm. 2. Recognition of Visitors None 3. Approval of Minutes from December 13, 200b Regular Meeting Stephanie Catania motioned to approve the minutes from the December 13, 2006 regular meeting. Jim McCue seconded the motion and it passed unanimously. 4. New Business Tree Removal Permit Applications A. 360 Garden Lane Fred DeSapio of 360 Garden Lane, Atlantic Beach, was present to address the Board in regards to his application. Mr. DeSapio stated the trees he is requesting to remove are located on a mound and does not think they are stable. The size and location of the trees present a risk of injury and property damage. Mr. McCue inquired if Mr. DeSapio was planning to do any construction in the area where the proposed trees to be removed are located. Mr. DeSapio responded that he does not plan to do any construction on the site. In addition, to meet the spirit of the tree ordinances he does plan to replant 4-5 trees. The Board determined this application does not require a permit but will issue one to confirm the application is exempt and be entered on recorded per Mr. DeSapio's request. A motion was made by aim McCue to instruct the Building Official to issue a Tree Removal Permit for 360 Garden Lane for the removal of 1-18"J22" split Magnolia, 1- 2S" Live Oak, 1-10" Sabal Palm located in the interior zone and 1-10" Sabal Palm in the exterior zone. No mitigation is required but Mr. DeSapio has chosen to protect 1 - 25" Live Oak located in the exterior zone and intends to plant 1 -Palm, 1 -Cypress, and 1 -Live Oak in keeping with the tree ordinances even though it is not required. Stephanie Catania seconded the motion and it passed unanimously. B. 1160 Beach Avenue (.Post Removal Application Cindy Mullen was present to address the Board in response to a letter sent by Rick Carper regarding the removal of several Palm Trees without a permit. Mr. Lavale Paulin, owner of Southeastern Structural Consultants, Inc., was also present in his client's behalf and to provide visuals of the removed trees. Mrs. Mullen stated her husband did not know that removing Palms required a permit. In the past, they had obtained a permit to remove Hardwoods but did not .~Iintttes of January 10, ?007, Tree Conservation Board :, l ~, remember seeing Palms on the list. They have already replanted 1 - 13" Palm, 1 -14" Palm, and 1 - 14" Palm. A motion was made by Stephanie Catania to instruct the Building Official to issue a permit after the fact for the removal of 1- 10" Cabbage Palm, 1 - 14" Cabbage Palm, and 1 - 17" Cabbage Palm located in the exterior zone. Mitigation requirement is 100%. The 41" of removed Palm must be replaced by 41" of Palm. The Mullen's have already chosen to replace the trees by planting 1 - 13" Palm and 2 - 14" Palms in the exterior zone. The removal of one approximately 12" Palm in the interior zone does not require mitigation. Jim McCue seconded the motion and it passed unanimously. Maureen Shaughnessy reminded the Mullen's to water the newly planted trees and protect them during construction. Public Works Director, Rick Carper, stated to Mrs. Mullen's that the Palms must live one year or be replaced according to the code. Chuck Carroll suggested having information published in regards to property boundaries and removing trees to inform citizens due to the post applications of Ms. Cynthia Doctor and Mr. And Mrs. Mullen's. C. 1674 Park Terrace East Rick Carper reported he had given approval in accordance with City Code for a rotten Oak Tree at this location to be removed. D. 461 Levy Road Rick Carper reported he had given approval in accordance with City Code for a large Cedar Tree at this location to be removed due to it being rotten with several branches falling off. 5. Old Business A. 1845 Ma~port Road Rick Carper reported that due to a lack of quorum at the last meeting he had issued a permit for this location. He had consulted with Chair Shaughnessy on issuing the permit. Discussion ensued regarding the possibility of moving a parking island three spaces to the left in order to save a 26" Water Oak. In conclusion, due to the large amount of grading and construction done to the land the tree probably would not survive. Jim McCue asked if plans had met the City's Landscaping requirements. Rick Carper stated he would review the plans with Sonya Doerr. 6. Reports & Announcements New liaison should be at the next meeting. Stephanie Catania reported that she would not be present for the next Tree Board Meeting on January 24, 2007. 7. Adjournment The meeting was adjourned at 7:45pm. 2
