REGULAR MEETING OF TREE CONSERVATION MEETING MINUTES
May 23, 2007
A regular meeting of the Tree Conservation Board was conducted at 7:00 p.m. on Wednesday,
May 23, 2007 in the Adele Grage Cultural Center. The presiding Chairperson Maureen
Shaughnessy adjourned the meeting at 8: 20 p.m.
I. ROLL CALL
Present: Maureen Shaughnessy, Jim McCue, Carole Varney, Brea Paul, Stephanie Catania
and City LiaisonlPianner Erika Hall and Recording Secretary Jessica Morales.

Recognition of Visitors: Geoff Selhorst (388 8a' St) and Damon Rebhahn (River City
Cabinets)
Approval of Minutes of May 9, 20117 Meeting: Stephanie Catania made the motion to
approve the minutes from the May 9th, 2007 regulaz meeting. Jim McCue seconded the
motion and it passed unanimously.
II. NEW BUSINESS
a. Tree Removal Permits
1. 388 8`~ Street (Selhorst) Geoff Selhorst stated his name and address for the record.
Mr. McCue inquired about the addition being put on the house and Mr. Selhorst
stated that the addition is still in progress. The boazd inquired and wanted to confirm
that Mr. Selhorst was removing the 16" Laurel Oak or the 38" Live Oak (protected).
Mr. Selhorst confirmed that the 16" Laurel Oak is being removed and not the 38"
Live Oak. Mr. McCue asked if the addition was a single story or two story addition
and Mr. Selhorst confirmed that it is a single story addition. Mr. Selhorst explained to
the boazd why he is removing the 16" Laurel Oak due to overhanging on the house
becoming a hazard. The Boazd inquired about the 38" Live Oak (protected) and was
concerned about the size of this trees' root ball and how it will affect the foundation
of the new addition. Mr. McCue gave Mr. Selhorst a few suggestions in regards to the
3 8" Live Oak root ball issue by advising that Mr. Selhorst have his engineer do a
monolithic foundation in order to keep the Live Oak healthy and save Mr. Selhorst
any unnecessary costs. Mr. Selhorst responded to the board that he did not know the
size of the root ball and gave a brief summary as to how his engineer designed and
remedied the root ball problem.

Motion of the Boazd: Carol Varney made a motion that the tree removal permit for
Mr. Selhorst at 388 8`h St. be granted for the removal of one 16"Laurel Oak (exterior
zone) be mitigated by the protection of one 38 " Live Oak and planting of two 2 "
Hardwoods. Jim McCue seconded the motion and the board passed it unanimously.
b. Exempt Tree Removals
1. 281 Pine Street (Pappas) Erika Hall gave a brief summary in regazds to Mr. Pappas
coming to the City of Atlantic Bch and applying for a tree permit due to the trees
causing foundation problems to his rental home. Ms. Hall stated that Mr. Pappas
made Ms. Hall aware of the renovations he is doing to the home by installing new
windows. Ms. Hall made Mr. Pappas aware that any renovations done to the home
over the amount of $10,000.00 dollars will require a review by the Tree Conservation
Board. Ms. Hall stated that Mr. Pappas assured her that his renovations were under
$10,000.00 dollars. Ms. Hall stated that Mr. Pappas also was made aware of the tree
application and a checklist that can be found on the City's website if he had any
further questions about the application. Ms. Hall stated that a few days later Mr.
Pappas submitted an application for exempt tree removal. The boazd discussed their
concerns regazding Mr. Pappas' renovations exceeding the $10,000 threshold with the
planner Ms. Hall and decided not to take any action unless Mr. Pappas does not
follow the City procedures.
2. 1965 Sevilla Blvd. W (Brodeur) Ms. Hall gave a brief summary in regazds to Mr.
Brodeur coming to City of Atlantic Beach completing the necessary forms for an
exempt tree permit. Ms. Hall stated Mr. Brodeur included a letter stating there is one
8" Bay (exterior zone) in need of removal due to disease and safety hazards to the
house. The board asked Ms. Hall what was her decision on this matter and Ms. Hall
stated that she approved the tree removal because Mr. Brodeur had all his paperwork
done accordingly to the City of Atlantic Beach's Tree Conservation Board
requirements and met the criteria for an exemption.
III. OLD BiISINESS
a. Mitigation
1. 1863 Mayport Road (River City Cabinets) Damon Rebhahn stated his name and
address for the record. Damon Rebhahn came before the boazd as requested to discuss
the new site plan. Mr. Rebhahn gives a brief explanation in regards to the new site
plan. The board asked Mr. Rebhahn if he formerly submitted a new application for
this new site plan. Mr. Rebhahn and Ms. Hall confirmed that Rick Carper, Public
Works Director and former staff liaison to the Tree Conservation Boazd, stated that a
new application was not necessary. Ms. Hall stated that she could issue an updated
permit that reflects the provisions of the new site plan. The board inquired to Mr.
Rebhahn about the pazking with a few concerns in regazds to the spacing for car
mobility. Mr. Rebhahn did explain to the board that the parking was an added feature
for overflow and that the mobility was fine. The board reviewed the new site plan in
comparison to the original site plan (2005) and the revision (February 2007) to get an

understanding of which trees aze going in and which trees are coming out. Ms. Hall
gave a brief summary to the board of the trees being proposed to meet mitigation,
consisting of a total of 141" (six 4" Cypress and thirteen 9" Palm trees).
Motion of the Board: Brea Paul made a motion to amend the previous permits from
December 2005 & February 2007 to reflect the new changes in the mitigation for a
total of 141 " (six 4" Cypress and thirteen 9" Palm trees)..Iim McCue seconded the
motion and it passed unanimously.
2. 400/500/5341574 Stocks St. (R/E Dome Investors) Erika Hall stated that neither she
nor Rick Carpenter have yet received a return receipt in regards to these properties.
Ms. Ha11 stated it has been thirty days as of May 23, 2007. Ms. Hall stated that the
next course of action when the letters are returned would be to post the letters in a
conspicuous place on the property and document the postings with date-stamped
photographs. Ms. Hail stated that Alex Sherrer, Code Enforcement Officer, said that
this would establish proof of notification given to property owner. Ms. Hall stated
that the matter will then be forwazded to the Code Enforcement board to handle.
IV. REPORTS AND ANNOUNCEMENTS
a. 1680 Jordan St. (Doctor) Ms. Hall stated that Mrs. Doctor-Brock had indicated that she
would be attending this meeting to discuss what type of trees she needed to plant. Ms.
Hall also stated that Mrs. Doctor-Brock said that she might be getting some sort of
assistance from Habitat of Humanity in resolution of her mitigation. Mrs. Doctor-Brock
was not present at this meeting, however the Board discussed the decision that was made
at the City Commission meeting in regards to Mrs. Doctor-Brooks case and suggested
that Mrs. Varney help Mrs. Doctor-Brock in her selection and placement of trees based
on the City Commission's decision.
b. Orchid Street (Van Duren) Erika Hall stated that Mr. Grant Van Duren and his father
Mr. George Van Duren are working on mitigation for the Orchid Street properties and
will be ready to present that information at the next Tree Conservation Board meeting for
Wednesday, June 13, 2007.
c. Dorothy Kerber: The Boazd discussed an issue raised at the last City Commission
meeting and presented by Dorothy Kerber. Ms. Kerber asserted that the Tree
Conservation Board meetings were being conducted covertly. She stated that meetings
were always over before the time stated in the posted meeting notices. Cazol Varney
spoke with Dorothy Kerber after the meeting telling her that the Tree Boazd Meetings
always run on time on the second and fourth Wednesdays of the month at the regulaz
scheduled time, which is 7 p.m. Ms Varney suggested that perhaps Ms. Kerber was
attending on the wrong night or going to the wrong facility. Ms. Varney also suggested
that Ms. Kerber offer a retraction of her statement at the next City Commission meeting
since she had done harm to the Board's integrity. Ms. Varney reported that Ms. Kerber
stood by her statement and said that it would not be retracted. Chairperson Maureen
Shaughnessy stated that she would write a letter to the Beaches Leader to clarify this
matter.

Motion of the Board: Maureen Shaughnessy made a motion to adjourn the meeting at
8: 20 pm; Jim McCue seconded the motion and it passed unanimously.
