Resolution No. 07-12RESOLUTION NO. 07-12 A RESOLUTION OF THE CITY OF ATLANTIC BEACH AUTHORIZING THE MAYOR TO SIGN DOCUMENTS GRANTING PERPETUAL EASEMENTS TO THE FLORIDA DEPARTMENT OF TRANSPORTATION FOR THE PURPOSE OF CONSTRUCTING AND MAINTAINING TRAFFIC SIGNALS ALONG ATLANTIC BOULEVARD, AND PROVIDING AN EFFECTIVE DATE WHEREAS, the State of Florida Department of Transportation proposes to construct or improve STATE ROAD NO. A1A, SECTION NO. 72100, F.P. NO. 2089672, IN DUVAL COUNTY, FLORIDA; and WHEREAS, it is necessary that an easement across certain lands now owned by CITY OF ATLANTIC BEACH, FLORIDA, be acquired by the State of Florida Department of Transportation; and WHEREAS, said use is in the best interest of the City; and WHEREAS, the State of Florida Department of Transportation has made application to said City to execute and deliver to the State of Florida Department of Transportation a perpetual easement, or easements, in favor of the State of Florida Department of Transportation for the purpose of constructing and maintaining Traffic Signal Loops, and said request having been duly considered. NOW, THEREFORE, be it resolved by the City Commission of the City of Atlantic Beach as follows: SECTION 1. That the application of the State of Florida Department of Transportation for a perpetual easement, or easements, is for transportation purposes which is in the public or community interest and for public welfare; that a perpetual easement, or easements, in favor of the State of Florida Department of Transportation in THE CITY OF ATANTIC BEACH, FLORIDA, should be drawn and executed by this City Commission. SECTION 2. The Mayor is hereby authorized to execute the documents granting Perpetual Easements to the Florida Department of Transportation on behalf of the City of Atlantic Beach. SECTION 3. This Resolution shall take effect immediately upon its final passage and adoption. SECTION 4. BE IT FURTHER RESOLVED that a certified copy of this Resolution be forwarded forthwith to the State of Florida Department of Transportation at Lake City, Florida.
