ORDINANCE NO. 90-x-206
AN ORDINANCE OF THE CITY OF ATLANTIC BEACH, FLORIDA,
AMENDING CHAPTER 24, ZANING, SUBDIVISION AND LAND
DEVELOPMENT REGULATIONS, TO PROVIDE TIME LIMITS ON
TEMPORARY STRUCTURES, TO CLARIFY FRONT YARD PARIQNG
REQUIRE ~ FOR RECREATIONAL VEHICLES, BOATS, ETC.,
AND TO PROHIBIT INSTALLATION OF BURGLAR BARS, METAL
AWNINGS, ETC., ON COMMERCIAL PROPERTIES, AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, there are currently no time limitations on temporary structures such as
awnings, tents, canopies, and the h`tce, which can become public safety issues caused by frequent
storms and high winds, a~
WHEREAS, clarification is needed to allowing the parking of recreational vehicles, boats,
and the like, in front yards to fully implement the intent of the current law, and
WHEREAS, there are currently no restrictions to the installation of burglar bars, metal
awnings, and the like, on commercial bu~7dings, which can become public safety issues for
customers reeding an emergency escape from a GQmmercial building or public safety personnel
needing emergency access to such building.
NOW THEREFORE, BE IT ORDAINED BY CITY CONIIVIISSION ON BEHALF
OF THE PEOPLE OF THE CITY OF ATLANTIC BEACH, FLORIDA:
SECTION 1.
(a) Sec. 24151(a) of the Code of Clydinances is hereby amended to read as follows:
"(a) Authorization. Accessory uses and structures are permitted within any
zoning district, as set forth within this section, where the accessory uses or structures are
clearly ancillary, in connection with, and incidental to the principal use allowed within the
particular zoning district. Any peimaneirtly located structure, including porches, decks and
deck railings and the like, which exceed thirty (34) inches in height, also including those
which may not require a building permit, are subject to applicable yard requirements and the
provisions of this section. Any accessory s~~artur+e, if allowed to deteriorate to an unsafe,
deteriorated or unsightly appearance, shall be repaired or removed upon order of the city,
and shall become subject to cede enforcement action for failure to comply. However.
temporary slkruchu~es, such as portable tents, canopies. or other nonpermanent
structures used for protection ag~unst the elements and/or for decoration shall be limited to
special occasion use only, and for a period of not more than ninety--six (961 hours, i.e. four

(b) Sec. 24163(bx2) of the Code of C-rdinst>ces is hereby amended to read as follows:
"(2) Recreational vehicles, boats or boat trailers, or other type of trailer shall not
be parked or stored closer than fifteen (15) feet from the front lot tine and shall be parked in
a manner that is genexaLly ~ to the front property line such that Length is not
m a manner that extends across the front of the lot. it being the intent that
recreational velncles, boats and trailers that are parked forward of the residence should not
excessively dorrunate the front of the lot."
(c) Sec. 24171 of tt>be Code of Chdin$rx~es is hereby amended. by adding a new
subsection (cx5), which subsection shall read as follows:
"(5) Burglar bars, steel Gates. metal awnings and steel roll down curtains are
urolu`bited on the exterior and interior of a structiu+e when visible from any public street.
ExrstmQ structures winch atready have bru~Jar bars, etc shall be brought into compliance
with these rnovisions within a reasonable time after any change of ownership of the
wtuch shall not be more than ninety (90) days
SECTION 2. This Ordinance shall take effect immediately upon its final passage and
adoption.
