AGENDA ITEM: Request for a Waiver from City Code Section 19-7 Driveway Limitations to
Exceed the Maximum Allowed Width and Right of Way Impervious Area Limit for a Duplex Lot
Located at 78 / 80 W. Eighth Street

BACKGROUND: City Code Section 19-7 contains the following requirements for driveways at
duplexes:
(a) The proposed driveway shall not create more than 50%
impervious area within the right-of-way.
(g) Maximum driveway width at the property line and through the
right-of-way for duplexes on a 50 foot lot shall be a combined width for
both driveways of 24 feet.
The applicant has constructed a single 41 foot wide concrete slab as a combined driveway. This
results in 82% impervious area in the right of way for this 50 foot lot.
Additional Background:
Applicant submitted right of way permit applications for this installation and for the duplex
at 74 / 76 W. Eighth Street on July 30, 2008. Public Works denial of approval and comments on
this application for exceeding the requirements of Section 19-7 were forwarded to the applicant on
August 4th. On August 6'" the applicant called Public Works to state that the driveways had
already been poured and to inquire about his options in view of Public Works disapproval of his
permit application. When told his options were to either remove the extra driveway width or apply
to the Commission for a waiver to City Code, applicant indicated his desire to request a waiver.
Because of the excess driveway width, this construction remains un-permitted, and will require the
permit fee to be doubled when paid as a result of starting construction before obtaining a City
Building Permit.
Applicant submitted an identical right of way permit application for the duplex at 74 / 76 W.
Eighth Street. This parcel was not addressed in the waiver application but should receive the
same final consideration.
BUDGET: No budget issues.
RECOMMENDATION: Staff recommends disapproval of this waiver request and direction to the
applicant to remove the excess driveway already constructed for in the City Right of Way at both
74 / 76 and 78 / 80 W. Eighth Street.

Section 24-46(d) permits the City Commission to authorize limited Waivers, on a
case-by-case basis, from a specific provision(s) of these Land Development Reg-
ulationswhen it is demonstrated that compliance with such provision(s) would
be unreasonable, in conflict with the public interest, or a practical impossibility.
A Waiver from these Land Development Regulations may be approved only upon
showing of good cause, and upon evidence that an alternative to a specific pro-
vision(s) of this Chapter shall be provided, which conforms to the general intent
and spirit of these Land Development Regulations. In considering any request
for a Waiver from these Land Development Regulations, the City Commission
may require conditions as appropriate to ensure that the intent of these Land
Development Regulations is enforced. A Waiver shall not modify any require-
ment orterm customarily considered as a Variance or any requirement or term
prohibited as a Variance, and shall be considered only in cases where alternative
administrative procedures are not set forth with the City Code of Ordinances.

The purpose of the extension of the driveway at the subject property is to improve the streetscape and reduce erosion onto a public
street, which creates unsafe driving conditions and adversely effects drainage and sensitive watershed areas. The required permit
was applied for prior to the commencement of work. Obviously there was not intent to circumvent the requirement of the
ordinance code. I would like to point out that other land owners had been required by the City of Atlantic Beach to perform the
work to their driveway to prevent erosion, but we did solely out of an effort to improve the subject property. In addition, other
driveways in the area were constructed to the standards we used prior to the change in the ordinance code.
