AGENDA ITEM: Advanced Disposal Contract Addendum for Storm Debris Collection

BACKGROUND: Section 4, paragraph B. of the Solid Waste contract with Advanced
Disposal requires the contractor to have a disaster response plan to aid the city with
cleanup of debris "accumulated by reason of a storm of disastrous proportions, natural
disaster, severe disturbance, riot or other calamity". The base solid waste contract does
not provide a means of paying Advanced Disposal for providing this cleanup assistance.
This amendment provides a method of measuring debris collected and sets a unit price
for payment, as required by FEMA.
Additional cleanup assistance beyond the bulk debris contract already in place is
required because storm debris that is containerized (e.g., bagged) will not be accepted at
the COJ Temporary Debris Storage and Reduction Site (TDSRS), and so must be
handled separately. The form and substance of this contract has been discussed with
and approved by a FEMA Debris Specialist.
BUDGET: Storm debris collection is paid from account 420-4201-534-3400 (Other
Contractual Services), but no funds are budgeted in advance. Commission action will be
required to add funds for this purpose in case of a storm or other debris generating
event.
RECOMMENDATION: Staff recommends approving the Addendum to the Advanced Disposal
Contract and authorizing the City Manager to sign for the City.

ADVANCED DISPOSAL, INC.
AND
THE CITY OF ATLANTIC BEACH

For expedited clearing of debris accumulated by reason of a storm, natural disaster, severe disturbance, riot
or other calamity, the City of Atlantic Beach requires additional yard debris pick up capacity. Advanced
Disposal, Inc. (Advanced), the normally contracted waste hauler for the City, agrees to provide these
emergency services with compensation on a unit price basis as defined below:
Advanced will be paid at a rate of $80 /ton of waste (net weight) as documented on load tickets from the
designated waste site. This rate will apply to all yard waste collected in excess of 105% of the three year
average weight picked up for that month, pro-rated on a weekly basis (4.33 weeks per month) in any month
where this addendum is activated, as documented in the Sanitation monthly report. Activation will be in the
form of a Notice to Proceed from the Director of Public Works. A cleanup planning meeting between City and
Advanced personnel will occur within 24 hours of receipt of the Notice to Proceed. When activated, the focus
of the post storm cleanup efforts by Advanced Disposal will be on collection of bagged or containerized trash
that cannot be taken to a City of Jacksonville Temporary Debris Storage and Reduction Site (TDSRS). Afield
supervisor dedicated to debris cleanup operations shall be in the City and available to meet with City
personnel at all times Advanced Disposal trucks are conducting debris cleanup. Cleanup efforts under this
addendum shall end when storm cleanup by the City's bulk debris contractor is completed or after two
sweeps of the City have been completed, as determined by the Director of Public Works. Remaining debris,
containerized and bulk, will be collected under the terms of the existing Sanitation contract.
A copy of the scale certification will be provided with the first invoice for this service. The tonnage rate above
will constitute full compensation for debris collection and disposal. No additional payment will be made for
grinding, burning or other means of final disposal for storm debris under this addendum.
The unit price payable to the Contractor for the second and subsequent years of the term hereof may be
adjusted upward or downward on the anniversary of the contract upon written request of the City or the
Contractor at least 90 days before the anniversary date. If requested, the rate adjustment shall be equal to
100% of the Consumer Price Index (CPI), United States All Urban Consumers, published by the U.S.
Department of Labor, Bureau of Labor Statistics for the preceding twelve (12) month contract period. No fuel
rate adjustment, other than what is included in the CPI calculation, is authorized.
An approved cleanup plan, including level of effort, as discussed in Section 4.B of the base contract, is
required for this authorization. City approval of a conceptual cleanup plan may be granted at the meeting
required by Section 4.B, with written commitment of schedule and level of effort from Advanced Disposal, Inc.
to follow within 48 hours.
