Approval of the minutes of the Regular Meeting held January 11, 1999. The Mayor asked for corrections or amendments to the minutes. There were no corrections or amendments, and the minutes were unanimously approved as presented. 2. Courtesy of the Floor to Visitors: Marcy Ashby of 133 Pine Street thanked City Manager Thompson for handling a noise problem related to dumpsters, and presented a handout regarding proposed Navy bombing. She expressed concern regarding damage to marine life and the shrimping business. The document is attached hereto and made a part of the official record as Attachment A. J.P. Marchioli of 414 Sherry Drive,believed that the impervious surface ordinance should not be passed as it was not warranted. 3. MESERVE X MITCHELSON X X Commissioner Mitchelson inquired of Building Inspector Don Ford as to SHAUGHNESSY X why the lower bid was not accepted. Mr. Ford advised that the low bidder had submitted a faxed certificate of insurance which was not acceptable as original documents were requested. Discussion ensued regarding the faxing of documents, and Commissioner Mitchelson suggested that there may be a need to consider changing this requirement. Commissioner Meserve stated that he sits on the Bid Committee, and that the City receives many bids which don't meet the requirements for many reasons, and that we should stick closely to the rules. The Mayor suggested putting the Fax issue on the next agenda. There was no further discussion, and the motion was unanimously approved. Action on a proposal filed by David Boyer and Steve Rosenbloom for an Art/Sculpture Park i) Authorize staff to draft a Resolution supporting this project ii) Authorize staff to advise the R-A-M Professional Group of the proposed Art/Sculpture Park so this may be taken into consideration during the design phase of the stormwater improvements Mayor Shaughnessy read Item 8A of the Agenda, and recognized Steve Rosenbloom. Steve Rosenbloom of 1417 Beach Avenue stated he felt that Plaza was an under-used green space. He had taken the matter to the Cultural Arts Board, the Tree Board and the Recreation Board, and he indicated he would like to tie the Plaza area into the City Hall/Howell Park complex. David Boyer of 2061 Beach Avenue addressed the issue of the traffic circle, and referenced the Albert H. Halff study which recommended a round-about at the intersection. The proposed design would require the taking of some private property but he felt the round-about would be a visual enhancement. Mayor Shaughnessy asked if the round-about had been included when this 0 matter was brought before the boards. Mr. Rosenbloom said it had not but indicated that some suggestions were made by board members to do something with a round-about. M S O E T C I O Y Minutes Page -4- O N E N January 25, 1999 COMMISSIONERS N D S 0 Mayor Shaughnessy recommended that the design be reviewed by the Traffic/Parking Committee and Staff, specifically Public Safety. Mr. Rosenbloom discussed the funding and felt this project would tie in with the Stormwater project. He felt timing was important since the opportunity could be lost once the Stormwater design was complete. Mayor Shaughnessy suggested discussing the concept presented by Mr. Rosenbloom and Mr. Boyer at a City Commission workshop to be held on Saturday, January 30, 1999, (now rescheduled for Saturday, February 20, 1999) and brought back to the City Commission at their next meeting, or the following meeting. She also felt the traffic situation should be reviewed by a traffic engineer. Stephen Kuti of 1132 Linkside Drive stated that he felt "circle" (not round-about")would eliminate stop and go traffic, and he supported the project. Commissioner Mitchelson felt it would be a beautiful addition, but was concerned regarding the impact on fire trucks. Commissioner Meserve thought it was a good idea and felt the traffic circle may be safer than the present configuration. He felt the design was time sensitive and the city should move forward rapidly so RAM could consider this. Commissioner Beaver concurred and suggested that RAM be notified regarding the proposed park at a meeting scheduled for Wednesday, January 27, 1999, or by letter. In response to Mayor Shaughnessy's inquiry regarding the type of sculpture, Mr. Rosenbloom stated that the City Commission would make that decision. There being no further discussion, this matter was referred to the committees referenced above, and scheduled for the next regular meeting. B. Discussion and related action in connection with 1999 Dancin' in the Street Festival (Commissioner Beaver) Mayor Shaughnessy stated that the City Manager has the authority to approve or disapprove the Dancin' in the Street Festival and if he had a M S O E T C I O Y Minutes Page -5- ONEN January 25, 1999 COMMISSIONERS N D S 0 problem he would bring it to the Commission. Commissioner Beaver was concerned with alcoholic beverage sales, but Mayor Shaughnessy was reluctant to discuss the matter pending any appeal which may be brought to the City Commission. Commissioner Mitchelson felt that the City Manager needed direction regarding staffing, and City Manager Thompson stated that Town Center would pay the costs of Public Works and police unless directed otherwise by the City Commission. C. Appointment to the Tree Board to fill the unexpired term of Dennis Sparks (City Commission) The Mayor stated she wished to appoint Eloise Koerber of 1476 Linkside Drive, to fill the unexpired term of Mr. Sparks on the Tree Conservation Board, and since Mr. Sparks' term was about to expire, she would appoint Ms. Koerber for an additional full term. The City Commission concurred. D. Approve expenditure of recycling grant monies in the amount of$5,947.84 (Alternative B recommended)(City Manager) Motion: Accept the recommendation of staff and approve BEAVER X expenditure of recycling grant monies in the amount of BORNO X X 5,947.84 as recommended (Alternative B, in staff report MESERVE X X attached hereto as Attachment B). SHX HAUGHNEUGHNESSY X Discussion ensued regarding the current inventory and condition of picnic tables, trash bins, and recycling bins. The condition of the trash bins at the beach was also discussed and the City Manager advised that 55 gallon drums were used and many were rusted and not in good condition. The City Manager advised the request must be submitted by January 31. Following further discussion, the motion carried by a four to one vote with Commissioner Mitchelson voting nay. E. Approve the purchase of a 6-inch emergency pump with automatic controller, a 3-inch standby pump, a 4-inch standby pump, as sole source items from Blankenship and Associates, in the amount of$27,227.00 (City Manager) M S O E T C I O Y Minutes Page -6- ONE N January 25, 1999 COMMISSIONERS N D S 0 Motion: Approve purchase of a 6-inch emergency pump BEAVER X with automatic controller, a 3-inch standby pump, a 4-inch BORNO X standby pump, as sole source items from Blankenship and ME SERVE x x MITCHEL SON X X Associates, in the amount of$27,227.00. SHAUGHNESSY x Commissioner Meserve stated these pumps are standardized throughout the City and Commissioner Mitchelson noted that the price was $7,000 under the amount budgeted. Alan Potter of 374 Second Street stated that unless the pumps were exclusively for sewage, this may not be a sole source item. The City Attorney advised that if the City Commission desired to purchase the pumps as a sole source item, it would be necessary to waive the bidding requirements. Amendment: Waive the formal bid process and accept staff recommendation to purchase the pumps. 41) The motion carried unanimously. The City Commission then voted on the main motion and the motion carried unanimously. F. Combine two authorized part-time positions to create one full-time position within the Parks and Recreation Department (City Manager) Motion: Accept the staff recommendation to combine two BEAVER X authorized part-time positions to create one full-time BORNO X position within the Parks and Recreation Department. Discussion ensued and Mayor Shaughnessy felt that beautification was very important and felt it would be diminished if it was combined into another department. The Mayor said she would like to see a resolution indicating that beautification enjoy the priority and importance with the City Commission that it seems to enjoy with the citizens of the City, that it remain a separate department, and that funding be retained for a half- time employee. The Mayor reported she had met with a division chief of the Jacksonville Department of Parks and Recreation which has two grant 110 writers, and she indicated they had offered their assistance to Atlantic Beach. The Mayor felt that the city could leave Beautification in tact and M S O E T C I 0 Y Minutes Page -7- o N E N January 25, 1999 COMMISSIONERS N D S 0 also get full-time help for the Recreation Director. She also felt there were talented people in Atlantic Beach, including master gardeners, who would be willing to work part time in Beautification, and who would have more expertise in the field of Beautification than a clerk. Commissioner Borno agreed that Mr. Johnson needed a full time assistant to handle the clerical work. Commissioners Mitchelson and Meserve agreed with the need for a full- time assistant for Mr. Johnson. Commissioner Meserve felt the decision regarding the Beautification position could be made later. City Manager Thompson stated that since April, the Parks and Recreation staff, the gardener, and Pat Williams, had been doing the beautification work. Commissioner Beaver suggested going ahead with the staff recommendation, and if Beautification declines, revisit it later. 411 Barbara Hopson who served on the Beautification Committee and Recreation Advisory Board, believed if the positions were combined under the direction of Parks& Recreation, there would be a conflict of interest as the Beautification coordinator would require different skills from the recreation clerk. She felt Beautification would lose out if the positions were combined. City Manager Thompson stated he didn't think the intent was to abolish the Beautification Coordinator position. Substitute Motion: Approve a full-time recreation BORNO X assistant position, and ask the City Manager to look for MITCHELSON X funds for a Beautification Coordinator Further discussion ensued following which Commissioner Beaver offered the following motion: Motion: Table the motion until the next meeting, giving BEAVER X X City Manager time to see if he could fund a separate position BORNO x for beautification. Authorize the expenditure of$1,375.00 for R-A-M Professional Group to meet with the Community Development Board at a special meeting (City Manager) Motion: Approve expenditure of$1,375.00 for R-A-M BORNO X Professional Group to meet with the Community MITCHELSON X Development Board as requested. City Manager Thompson explained that the staff report was not clear and that the hourly rate in the R-A-M proposal would be used and the cost would not exceed $1,375.00. Commissioner Borno thought it was premature for R-A-M to meet with the Community Development Board (CDB) at this stage. He felt R-A-M should do the design first and then hold the meeting with the CDB. Commissioner Meserve concurred. Commissioner Mitchelson withdrew the motion, and Commissioner Borno withdrew his second. Commissioner Beaver felt the City had not given RAM specific directions. Could RAM calculate net gain based on 50% or 40% impervious coverage? He suggested that staff Communicate to CDB that the Commission had a problem with the timing, and felt that it was premature at this point. He suggested the CDB submit questions in writing through the City Manager to RAM so they could consider those concerns and needs as they work on the design. Following further discussion, Commissioner Mitchelson offered the following motion: Motion: Request the Community Development board BEAVER X to submit their questions in writing through the City BORNO X Manager to R-A-M so R-A-M may consider their concerns ME SERVE X X and needs as they consider the design. MITCHELSON X X SHAUGHNESSY X Albert Rabassa of 1820 Live Oak Lane, stated that the contract includes the cost for meetings. He felt a decision should be made regarding who could call meetings, and that the City should not pay unless an expenditure was properly approved by City. Alan Potter stated that CH2M Hill study(when $3.00 stormwater fee was established) was to provide a report on the amount of impervious surface on every lot. City Attorney Jensen stated he attends CDB meetings, and indicated they were taking their task very seriously and were looking for every piece of information to assist them with their task. There was no further discussion and the motion carried unanimously. H. Authorize staff to enter into a contract with Slavin Management Consultants to conduct the search and hiring process for the position of City Manager as outlined in their proposal, at a cost not to exceed 18,197.00 (City Manager) Motion: Authorize staff to enter into a contract with Slavin BEAVER X Management Consultants at a cost of$18,197.00. BORNO X MESERVE X X Stephen Kuti stated he would like the City to make sure the new City MITCHEL SON Manager is a people person who gets along with citizens. He felt the City SHAUGHNESSY x x Manager's job was to run the City and spend funds wisely. He urged the City Commission to wait to hire Slavin since he felt the citizens committee which was recently appointed, was capable of doing this task. Citizen Kerber expressed concerns regarding the cost and indicated that committees had performed this task well in the past. After further discussion, the motion carried unanimously. I.Discussion and possible related action regarding Selva Marina streets (Commissioner Meserve) BEAVER X X Motion: Authorize the City to continue normal BORNO X maintenance of roads, both public and private, in the Selva MESERVE X X Marina area, and direct the City Manager to continue MITCHELSON X discussions with the citizens in that area regarding where to SHAUGHNESSY X go from here. M S O E T C I O Y Minutes Page -10- 0 N E N January 25, 1999 COMMISSIONERS N D S 0 Discussion ensued and it was understood "maintenance" meant repairing potholes, etc., and not that the City would accept the roads. Commissioner Meserve reviewed the history of the Selva Marina roads situation, and felt staff could work with citizens to assist them with major repairs. He felt some middle ground could be found. Commissioner Mitchelson suggested that the creation of a special taxation district be put on next ballot for the purpose of maintaining the roads. Commissioner Meserve agreed. Commissioner Borno suggested that the Selva Marina residents reactivate their homeowners association and Harold Brodeur of 1965 Sevilla Boulevard West stated there were several homeowners associations in the area but they had not been active for some time. Gail Leas, of 1915 Oak Circle stated she is opposed to special tax district and felt residents were currently paying taxes not getting anything for 40 them. Tom Goodrich of 1907 Creekside Circle, suggested keeping communication open. He felt the residents needed guidance from the City. He reported a homeowners meeting had recently been held in Commission Chambers. Sally Madry of 1915 Creekside Avenue presented minutes of the meeting held in Committee Chambers. The motion carried unanimously. Mayor Shaughnessy called a recess at 10:25 p.m. and reconvened the meeting at 10:40 p.m. Tom Downing of 2323 Oceanwalk Drive West thanked the City for working with Atlantic Beach School to remove sand at the playground equipment and replace it with rubber material. SHAUGHNESSY x x M S O E T C I O Y Minutes Page -11- O N E N January 25, 1999 COMMISSIONERS N D S 0 City Attorney Jensen explained the JEA wished to purchase several parcels, and wished only to secure temporary construction easements on others. He distributed a map illustrating the lots in question. He indicated that the data which had been used by the JEA in their appraisal process may not have been appropriate and felt the city may wish to have the appraisals evaluated. Discussion ensued and the City Attorney explained that the JTA would get the property either through a purchase negotiated with the City, or through eminent domain. What the City needed to decide was whether the JEA offer was appropriate. The Mayor explained the procedure involved for a"quick take" and a"slow take." Commissioner Meserve hoped the City would work with JTA regarding landscaping which he felt would enhance the area. He felt the city should get an evaluation of the appraisals and cooperate with JTA as much as possible. Commissioner Mitchelson inquired how the price being offered by the JEA related to the purchase price paid by the City. He also pointed out that the city was hoping to install a flood gate on property owned by the City of Jacksonville, and wondered if a trade could be worked out in this connection. The Mayor concurred. City Manager Thompson stated that staff would like to review what is underground, i.e. water lines, sewer lines, etc., and return with a Staff Report and recommendation. There being no further discussion, the motion was unanimously voted down. City Manager Thompson stated that staff would investigate the matter further and report back as soon as possible. 9. City Manager Reports and/or Correspondence: City Manager David Thompson provided each Commissioner with a written report and highlighted some areas, as follows: reported city staff had met with the contractor who maintains the Atlantic Boulevard medians and explained some of the improvements which would be made; M S O E T C I O Y III Minutes Page -12- O N E N January 25, 1999 COMMISSIONERS N D S 0 reported that the city had received a check in the amount of 7,023.70 as a settlement of a lawsuit against major oil companies, said funds to be restricted to road construction or maintenance; reported that preliminary figures for refinancing the Gulf Breeze loan, had come in at lower rates than anticipated, and explained that this matter would be brought before the City Commission for action at the next meeting. 10. Reports and/or Requests from City Commissioners, City Attorney and City Clerk City Clerk Maureen King introduced a new employee in her office, Linda Kilis. City Attorney Jensen stated he had been notified by the law firm of 40 Rogers Towers that they had been selected to represent SunTrust Bank, and in the event the city should select SunTrust Bank to refinance the Gulf Breeze loan they have requested that the city consider authorizing someone to sign a waiver for the potential conflicts of interest for them to represent the Bank in that closing since they represent the City in labor negotiations. The City Attorney indicated he did not see this as a problem since these were unrelated matters. He suggested that in the event the city select Sun Bank for the refinancing, the City Manager be authorized to execute the waiver. Commissioner Meserve stated that Phase 2 of the contract for the sewer line to Mayport Village had been let as of last week. Commissioner Borno reported the recent death of Jim Jarboe's father- in-law. The Mayor: presented several pieces of correspondence and requested that the City Clerk copy and distribute these to City Commissioners; announced a meeting of Beaches Area Historical Association to be held in Commission Chambers on Thursday, January 28, III 1999; M S O E T C I O Y Minutes Page•13- ONE N January 25, 1999 COMMISSIONERS N D S 0 announced a meeting between the Stormwater Review Committee and representatives of R-A-M Professional Group to be held at 5:30 pm on Wednesday, January 27, 1999; announced that the Jacksonville Planning and Development Department would hold two meetings relative to the census and requested that a City Commissioner attend. Commissioner Beaver indicated he would be interested if he could work it into his schedule; reported on a meeting with a Karen Scheffer, Division Chief, Planning Research and Grants, and indicated Ms. Scheffer would attend the City Commission parks workshop; inquired into the status of the large map which had been ordered for Commission Chambers; requested City Commissioners to submit to the City Manager their Stopten criteria for a City Manager, this information to be forwarded to the search firm. This trial is a follow-on trial to USS JOHN PAUL JONES DDG 53), which was successfully tested in June 1994. WINSTON CHURCHILL's design includes significant combat system and structural upgrades from JOHN PAUL JONES so that survivability testing by shock trial is required. Some of the more significant upgrades include the addition of a dual helicopter hangar, a new gun, a more survivable electrical distribution system, and blast hardened bulkheads. The ship will be subjected to no more than four explosive charges of 10,000 lbs. each, over a four week period between May 1 and September 30, 2001. The Navy will evaluate the effect that shock waves, resulting from the explosions that emulate conditions encountered in combat, have when they propagate through the ship's hull. The Navy evaluated the East, West, and Gulf coasts against a set of operational parameters necessary to conduct the trial. Mayport, Norfolk, and Pascagoula are the only areas that adequately meet all of the Navy's criteria for an acceptable test location. The trial will occur at one of these possible test areas. As part of trial planning, the Navy is preparing an Environmental Impact Statement(EIS), which will thoroughly evaluate the possible alternative locations for the shock trial. The EIS will include analysis of the physical, biological, and socioeconomic environments of the test areas. When the DEIS is completed, the Navy will again hold public meetings to accept comments which will be addressed in the Final EIS. The dates, times, and locations of these meetings will be announced in the Federal Register and a variety of newspapers local to the potential test areas. As part of the National Environmental Policy Act(NEPA)process, the Navy requested that National Marine Fisheries Service (NMFS) be a cooperating agency. As a cooperating agency, NMFS would review and comment on the EIS, with particular attention to those issues over which it has cognizance under the Endangered Species Act, the Marine Mammal Protection Act, and the Magnuson-Stevens Fisheries Conservation Act. The Navy will seek a letter of authorization from NMFS if there is a potential to take marine mammals.
