10-11-99 vMINUTES OF ATLANTIC BEACH CITY COMMISSION WORKSHOP MEETING HELD IN COMMISSION CHAMBERS AT 4:00 PM ON MONDAY, OCTOBER 11, 1999 Commission members present were the Mayor Shaughnessy and Commissioners Beaver, Borno, Meserve and Mitchelson. Staff members present were City Manager Hanson, David Thompson (who had served as Interim City Manager until Mr. Hanson was hired), Public Works Director Bob Kosoy, Assistant Public Works Director Donna Kaluzniak, and City Clerk Maureen King. Mayor Shaughnessy called the meeting to order and introduced Neil Aikenhead of Aikenhead and Odom,the engineers for the city's stormwater improvement project,to update the City Commission on what they had done so far. Mr. Aikenhead introduced Karl Hankin, Director of Distribution Coordination Management for the Jacksonville Electric Authority (JEA), to address the City Commission regarding the feasibility of installing underground electric lines. Mr. Hankin distributed notes setting forth the JEA position on underground electric lines, and the estimated related costs, a copy of which is attached as Exhibit A. He said that JEA would need to go door to door and interview homeowners regarding their willingness to pay for the conversion and said the two payment options were a lump sum payment,or monthly payments over five years at 7% interest. He felt that there would be no cost to the city for the installation of the lines . Mr. Hankin said the JEA had a goal of installing twenty miles of underground lines every year for seven years and this project, in conjunction with Aikenhead and Odom, would be an opportunity to get some of this work done. He indicated that the JEA would like to get an 80% commitment from affected homeowners before they would proceed with the installation of underground lines. He also pointed out that decorative or historic style lights would increase the cost. Mr. Aikenhead then gave an overview of what he had learned so far with regard to the stormwater project. He said he had had several meetings, including a meeting with the Stormwater Review Committee, and he had reviewed the England, Thims& Miller design. He said his objective was to do everything possible to retain the natural character of the city;not to utilize the parks any more than necessary; search for more storage within the city; and consider some pumping options. Mr. Aikenhead said they had reviewed all the flooding complaints and it was his opinion that the city did not have a serious flooding problem,and felt they could develop a very workable system. He said that a suggestion had been made at the meeting with the Stormwater Review Committee, to install pipes along Church Road. The design would pump stormwater from the lagoon, near Selva Marina Country Club,through Church Road,and into the Intracoastal Waterway. He felt that while this was a viable option, it would be expensive since it would involve laying over a mile of large force main. He pointed out,however,that the JEA was in the process of ordering large diameter pipe for another project,and he felt that it may be possible to realize a savings in the cost if this pipe could be ordered through the JEA. While it was too early to estimate the cost of this option,Mr. Aikenhead said he felt it would "blow the budget." He said he needed to design everything first, and then, once the Page Two Minutes - Commission Workshop October 11, 1999 system is designed, if it was too expensive to do the entire project at one time, it could be done one step at a time, but he felt sure that they had a solution which would solve the city's major flooding problems. Mr. Aikenhead said his firm had just completed a detailed street by street review of the core city area including interviews with homeowners, and he felt that while there was considerable nuisance flooding towards the eastern end of the numbered streets, there was no really serious flooding; however, in some cases it would be necessary for homeowners to be able to connect to the drainage system. He said he would try to minimize the amount of work on the numbered streets and felt that some streets would need only to be resurfaced and other streets would be designed with inverted crowns. He said they have gathered a large amount of information and would do a great deal more work before bringing it back to the City Commission so they can decide exactly how they wish to go. The Mayor inquired whether any federal money would be available to raise homes which are located at sub-standard elevations, and Mr. Aikenhead responded that FEMA was considering not covering houses that suffered catastrophic flooding more than three times;however he was not aware of any funds available to raise houses. The Mayor inquired whether the area east of Fleet Landing and west of Oceanwalk could be used for storage. Mr. Aikenhead responded that he was aware of the area but he felt it would require a tremendous amount of data collection and very complex analysis and could triple the engineering costs. He felt the Church Road option was a better option. Discussion ensued and Commissioner Borno pointed out there was a large ditch in Section H and Mr. Aikenhead said he would be glad to look at this ditch to see if it could be used for this project. Further discussion ensued and Commissioner Meserve inquired whether the beach outfalls would be eliminated, and was advised that they would be eliminated. He also inquired regarding the possible using the parks and Mr. Aikenhead responded that Johansen Park may be used to some degree;also, restrictions will need to be removed from the existing drainage in Howell Park,but construction will be kept to a minimum and he intended to work with Early Piety to make sure it will be esthetically pleasing. Discussion ensued and Commissioner Mitchelson inquired regarding limitations which should be required on impervious surfaces,and Mr. Aikenhead indicated that he would make recommendations in this regard at a later time. The Mayor noted that Mr. Aikenhead had indicated earlier that they could present a positive, workable solution which accomplishes the goals of the city,and inquired regarding Mr. Aikenhead's confidence level that this was a reachable goal. Mr. Aikenhead responded that the problems could Page Three Minutes - Commission Workshop October 11, 1999 be solved with sufficient funds; however, he reported that the direction of the project has been changed based on the consideration of using Church Road. He felt it would be stretching the budget, but he felt it was within the ability to achieve. The Mayor inquired in the event Sherman Creek was found to negatively impact the drainage flow, whether there would be any financial and permitting incentives to restore the drainage. Mr. Aikenhead said there would be a permitting incentive, but he was not aware of any financial incentives. The Mayor, however, said she felt that funding was available from the St. Johns River Water Management District to correct negative situations which existed as a result of an error in judgement by their personnel, and Mr. Aikenhead said he would follow up on this matter. There being no further discussion, the Mayor declared the meeting adjourned at 6:05 p.m. Maureen King City Clerk EXHIBIT A-MINUTES 10/11/99 411 Atlantic Beach OH to UG Notes for 10/11/99 Meeting- Karl Hankin JEA is in favor of undergrounding existing overhead facilities. To that end, JEA is trying to establish a list of candidate projects for undergrounding. The Atlantic Beach water, sewer, and storm drainage project is an opportunity for us to underground some of our existing overhead facilities. Obviously there are costs involved. The estimate(from 2 years ago) for converting this system is close to $1,000,000 and the cost to convert the services could be another 1,000,000. We can't be specific on the estimate until we see the latest water, sewer, and storm drainage plans, which we would use to design our project. There are design issues that will need to be resolved such as easement availability, construction coordination, impact on trees, etc. Following our traditional procedure, JEA will need to go door to door and ask the home owners if they would be willing to help pay for the conversion. Customer feedback will be used as input to determine JEA commitment to this project. Typically, JEA is looking for an 80%commitment level from affected customers. There are 2 payment options: 1 lump payment or monthly payments up to 5 years at 7%. Our next step is to obtain a copy of the latest set of plans so that we can determine what 410 the costs will be. Then we will go door to door and poll the neighbors. Example Project: Avondale/Challen/Pine/Edgewood 52 homes Total cost per homeowner: 968 - $ 5,090 Conduit cost per homeowner: 0- $ 247 Electric Service cost per homeowner: 0 - $ 3,500 Street Light cost per homeowner:968 Monthly payment per homeowner: 19 - $ 101 MIBS Service cost per homeowner:0—$ 375 (handled by M1BS, not JEA) MediaOne contact is Marcus Lyles at 619-4985 &BellSouth contact is Mark Belton at 348-2530. In the example project JEA financed the M1BS portion of the project. It is unlikely that JEA will do this on future projects. MINUTES OF ATLANTIC BEACH CITY COMMISSION WORKSHOP MEETING HELD IN COMMISSION CHAMBERS AT 6:00 PM ON MONDAY, OCTOBER 11, 1999 Commission members present were the Mayor Shaughnessy and Commissioners Beaver, Borno, Meserve and Mitchelson. Staff members present were City Manager Hanson, David Thompson (who had served as Interim City Manager until Mr. Hanson was hired), City Attorney Alan Jensen, and City Clerk Maureen King. The meeting,which was called for the purpose of reviewing the contract with the City Attorney,was called to order at 6:24 p.m. by Mayor Shaughnessy. The Mayor noted that the current contract was approved in 1994 and she asked Commissioners to present their questions or comments. Commissioner Borno suggested annual evaluations. He referred to Section 2 ofthe contract and said he had no problem with the retainer but felt that the billing lacked sufficient detail. He also said he would like to receive quarterly reports. Commissioner Mitchelson also felt the retainer was reasonable. He referenced Section 5 of the contract and said he disagreed with the health insurance provision. 411 Commissioner Meserve agreed with Commissioner Mitchelson's comment regarding health insurance. He felt that in the event the city terminated the contract for cause, benefits should cease the day notice of termination was given. He referred to Section 6, and said he felt that this was a more appropriate section to address the health insurance matter. He asked Mr. Hanson if he wished to make any comments about the contract. Mr. Hanson responded as follows: Section 1(c) He pointed out that all civil complaints do not necessarily go through the City Attorney. For example,insurance claims are handled by the attorneys for the insurance companies Section 2 Mr. Hanson said he would like to have written monthly reports, instead of quarterly reports, and in addition, he would like to include in the retainer, monthly meetings with the City Manager and top city staff Section 3 Correct the reference to "all litigation," similar to Section 1(c). He also pointed out that all the items in Section 3 would be billed on an hourly basis. The City Manager questioned whether any member of the City Commission should be able to independently request written legal opinions. He felt this could involve considerable work and expense. Section 5 The City Manager agreed with earlier comments regarding health insurance coverage for family members. Page Two Minutes - Commission Workshop October 11, 1999 Commissioner Meserve again suggested that health insurance be included in Section 6, and he felt that, as written, the amount of health insurance coverage was excessive. Commissioner Beaver agreed with the comments regarding health insurance coverage. He felt the amount of the retainer was reasonable,and indicated he,also,would like to see more detail in billing. The Mayor felt more detail should be included regarding what was covered in the retainer. She also inquired into the feasibility of straight hourly billing. She felt that the City Charter required annual review of contracts with Charter employees, and the City Attorney pointed out that the contracts were open ended and review was not required by the Charter. Following further discussion, Commissioner Meserve suggested that a more formal review process be established for Charter employees. It was agreed the City manager would work with the City Attorney to revise the language and bring the contract back to the City Commission for approval. Mayor Shaughnessy recognized the attendance of Scott Perry's Civics Class from Fletcher High School and welcomed them to the meeting. Kay Friedemann of 1898 Selva Marina Drive inquired concerning the placement of "No Parking" signs in the medians of the 1800 and 1900 blocks of Selva Marina Drive. Public Safety Director Thompson stated that the signs had been phased-in over a period of time in response to citizen complaints of parking and damage to the medians. Mrs. Friedemann requested that the city review the need for the signs in the 1800 and 1900 blocks of Selva Marina Drive since the street is narrow in that area and cars cannot park on the street. 1110 M S O E T C I O Y Minutes Page 2— N D E 0 COMMISSIONERS N D S 0 III October 11, 1999 I Mrs. Friedemann also complained of poor yard trash pick up before and after the hurricane and stated it took three weeks after the hurricane for her yard trash to be picked up. Former Interim City Manager Thompson indicated that Waste Management had eliminated the backlog caused by the storm and was now operating on schedule. 3. Unfinished Business From Previous Meeting A. SHAUGHNES SY X Using an overhead projector, Public Works Director Kosoy explained the Base Bid and Additive Alternates 1, 2 and 3 of the Stormwater System Improvements. Mr. Kosoy indicated that the project was funded in the 1998/1999 budget, complied with the city's consent order and had negligible affect on the core city project. The staff recommendation for the project is attached and made part of this official record as Attachment A. Commissioner Mitchelson confirmed that all three alternates were included in the project cost. Commissioner Borno inquired as to the tide gate for the Aquatic Drive culvert improvements. Public Works Director Kosoy explained that it would be a manually operated five panel gate, which may be used once or twice a year to prevent adverse backwater conditions. There being no further discussion, the motion carried unanimously. Mayor Shaughnessy stated that she would like to act on Item 7A at this time since it provided funding for the stormwater improvements. 7. Action on Ordinances: A. Select a name for the park referred to as "Tresca Property" Mayor Shaughnessy announced that the ribbon cutting ceremony for the opening of the park would be held at 10:00 a.m. on Saturday, October 30, 1999. It was reported that staff had suggested naming the park for Carl Walker, the city's longtime Beautification Coordinator who passed away last year. Mayor Shaughnessy stated that she favored naming the park after Mr. Walker. Dezmond Waters suggested the use of "nature preserve"instead of"park" and that no more parks be named after individuals. Commissioner Mitchelson stated the preferred Osceola Park citing the Native American influence in the area. The following park names were suggested: Mayor Shaughnessy - Walker Waterway Park Commissioner Mitchelson - Osceola Nature Preserve Commissioner Meserve - Tide Views Nature Preserve Discussion ensued and by a show of hands,the Commission unanimously approved Tide Views Preserve as the name for the park, and suggested the park be named in Memory of Carl Walker. 9. City Manager Reports: Former Interim City Manager Thompson: Reported on a meeting held at the Holiday Inn on Saturday,October 11, 1999 attended by representatives from the Department of Health, the Center for Disease Control in Atlanta and numerous scientists who were present to study the effects of the Red Tide being experienced here at the beach. It was further reported that M S O E T C I O Y Minutes Page 10— o N E N COMMISSIONERS N D S 0 October 11, 1999 few studies exist on Red Tide and the scientists were present to study the effects of the Red Tide toxin on people who live on the ocean and work outdoors. Mr. Thompson confirmed that the phenomenon was Red Tide and there was no indication on how long it would last. Commissioner Mitchelson inquired if a follow-up report would be provided. Mr. Thompson assured the Commission that the follow up information would be received. 10. Reports and/or requests from City Commissioners and City Attorney Commissioner Borno Commented that it was not practical to expect yard trash to be cleaned up in 24 - 48 hours after a storm. He felt that the cleanup was quick and systematic and that 10 - 14 days was reasonable considering the volume of debris generated by the storm. Commissioner Mitchelson Stated that he and Dezmond Waters had been appointed to a committee to review Pension Board recommendations and it was his understanding that the other committee members could not serve. He then inquired if other appointments would be made to the committee. Mayor Shaughnessy indicated that John Fletcher and Dorothy Kerber would not be able to serve on the committee and she would make additional appointments and circulate a letter as soon as the appointees agree to serve. In accordance with the specifications, the contract shall be awarded on the basis of the lowest Total Base Bid and any selected Additive Alternate Bid Items. RECOMMENDATION:, Award the low base bid to Petticoat Contracting, Inc. in the amount of$315,878.42. Paragraph 16 does not state that implementation must begin with the core city. Therefore, implementing stormwater projects outside the core city area that reduces the impacts to the sanitary sewer system would also meet the intent of this paragraph. Paragraph 14 of the Consent Order states that improvements shall be made to the core city area beginning with televising and cleaning of the sewer lines. It is the Department's understanding that this has already been initiated. Any improvement to the stormwater system that re-directs stormwater and prevents inflow into the sanitary sewer system is seen as improvement to and meeting the requirements of Paragraph 16 of the Consent Order.
