02-05-96 v MINUTES OF THE WORKSHOP MEETING OF ATLANTIC BEACH CITY COMMISSION, HELD IN COMMISSION CHAMBERS ON MONDAY, FEBRUARY 5, 1996. Present were Mayor Fletcher and Commissioners Meserve, Reed, Rosenbloom and Shaughnessy. Staff members present were City Manager Jim Jarboe, City Planner George Worley and City Clerk Maureen King. Members of the Tree Conservation Board and Tree Ordinance Review Committee were also in attendance. The meeting, which was held for the purpose of holding in-depth discussions of the proposed tree ordinance, was called to order by Mayor Fletcher. The Mayor complimented those who had worked to revise and rewrite the ordinance and asked if they were all in agreement regarding the draft which had been presented to the City Commission that evening. It was pointed out that this was the first time the committee had seen the new draft and after a cursory review of the ordinance, had discovered that the last sentence of Section 23- 17, Tree Protection, Paragraph 3(b)(1), which they felt had been deleted, was still included in the ordinance. They pointed out this sentence had been the subject of much discussion during the committee's deliberations, and it was the recommendation of the committee that this sentence be deleted. Discussion ensued regarding the remainder of the ordinance and the committee agreed that unless other discrepancies were found, they were in agreement and recommended approval of the final draft now being considered. Commissioner Meserve pointed out that while the ordinance was long, it was specific and could be easily understood. He indicated that the only time a property owner would need approval for tree removal was when a building permit was required. The ordinance did not prohibit the removal of any tree; however, there may be certain consequences to consider. Commissioner Reed confirmed that George Worley was satisfied that the role and responsibility of staff vis a vis the Tree Conservation Board had been addressed to his satisfaction and Mr. Worley indicated that these responsibilities had been clarified to his satisfaction in the current draft. Following further discussion of the ordinance, Mayor Fletcher indicated he would talk with the City Attorney regarding whether the amendments which had been made to the ordinance since the public hearing were substantial enough to require that the ordinance be scheduled again for first and second reading.
