Recognition of Employee of the Month - Terry Masters Mr. Masters was not present and recognition was not given at this time.. B. Alan Potter of 374 Second Street stated the Beaches Aquatic Club (BAC) had offered to donate its retention pond to the City in April and the matter was referred to the City Manager. He then inquired if a decision had been made regarding the offer because the Club receives no benefit from the retention pond and has no interest in retaining ownership of the property. It was further stated the Club had been cited by the Code Enforcement Board for weed growth around the perimeter of the pond and was facing up to a $250 per day fine if the situation was not remedied. Mr. Potter continued by stating the City should be more concerned with homeless people living in the overgrown vacant lot at the northwest corner of Atlantic Boulevard and Aquatic Drive than with the retention pond area. MS Y N October 14, 1996 As stated in April, City Manager Jarboe reiterated the City's position of no interest in the offer because it would present another maintenance chore for the City and could set a bad precedent for similar properties within the City. At this point in the meeting, Mayor Fletcher stated if there were no objections, he would address Item 5, Resolutions A- E on the agenda and then return to the regular order of business. There were no objections. 5. Action on Resolutions: A. NO. 96-42 A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA, HONORING RAYMOND D. City Manager Jarboe presented Officer Kaczmarczyk his gun and badge, and Public Safety Director Thompson presented him with an engraved clock. Officer Kaczmarczyk stated that he enjoyed his work with the City and would continue working with the Police Department as a Reserve Officer. B. The Mayor, City Manager and Public Safety Director praised the men's vigilence, quick thinking, and teamwork in apprehending the suspect thought to be involved in a recent murder in Atlantic Beach, and thanked them for a job well done. 3. Unfinished Business: A. Report and related action relative to Bull Park Improvements Mayor Fletcher accepted Ed Preston's report and opened the floor for V V NAME OF Minutes Page -4- COMMRS. Under discussion, Mayor Fletcher stated that since a consensus had not been reached concerning relocation of the memorials in the park, he believed they should be left where they are. He also stated the number of east and west side parking spaces should be reduced. Commissioner Rosenbloom stated he first wished to apologize to members of ABET who may have taken some "heat" for a comment he made in jest at a recent Workshop Meeting. He further stated that he believed it was time to move forward and take action; that the park should be a quiet park for children, have tennis courts and contain a central meeting place. He also stated he believed the memorials could be moved and grouped together in a special area. Motion: Authorize Staff to issue a Request for Proposals for a MESERVE X design firm architect to design a plan for the park utilizing Ed REED X ROSENBLOOM X X Preston's report and the design presented by the Parks and SHAUGHNESSY X X Recreation Board. FLETCHER X Commissioner Shaughnessy stated that she would like the Community Center to contain a large room in the back for meetings and smaller rooms for crafts and offices. Commissioner Shaughnessy also stated that more playground space was needed and some of the proposed parking spaces would have to be eliminated. She then thanked Mr. Preston for conducting a good, productive meeting. There being no further discussion, the motion carried unanimously. City Manager Jarboe also thanked Mr. Preston for his services. Joseph J. Welch Letter At this point in the meeting, Mayor Fletcher read in its entirety a letter dated October 2, 1996, from Joseph J. Welch, C.P.A. with the firm of Purvis, Gray and Company, commenting on a letter dated September 30, 1996, from Alan Potter to City Attorney Alan Jensen. The letter is attached and made part of this official record. (Attachment A). B. Storm Water Drainage Report - England, Thims and Miller Hugh Mathews and Peter Malls representing the engineering firm of England, Thims and Miller distributed handouts pertaining to City's Stormwater, Water Distribution and Sewage Collection Improvement Project. V V NAME OF Minutes Pa•e -5- COMMRS. MS Y N October 14, 1996 Background information was presented, and Mr. Mathews stated that the recent 10 year storm combined with a northeaster had given the company a chance to inspect the present drainage system under extreme conditions and locate the problem areas. Mr. Mathews referred to page -3- of the report and indicated drainage ditch improvements, as well as improvements to the box culverts at A-1-A and Wonderwood Drive were needed. These areas are located outside the city limits and would cost approximately one million additional dollars to correct. Commission Rosenbloom questioned if drainage improvement would occur if only one item was addressed. Mr. Mathews stated that it would not, and the existing constrictions result in flood conditions. Mr. Mathews informed the Commission that the design for the system is based on a two year/twenty-four hour storm with normal tides. It was pointed out that East Coast and Sherry Drives drainage would greatly benefit from the project. Secondly, Mr. Mathews presented two options for the reconstruction of roads affected by the project. The Base Project, which had the lower cost, and the Curb and Gutter Alternate were discussed in detail (page -5- of the report). In conjunction with the road reconstruction, individual homeowners lot drainage plans were discussed (page -9- of the report). It was pointed out that if chosen, the Curb and Gutter Alternate would add approximately 1.2 million dollars to the project cost. Commissioner Shaughnessy questioned the longevity of the better road and was informed the rebuilt roadway with curb and gutter would last twenty years if the ground water is removed and the overlayment of existing streets would last between 3 and 10 years. The third item reported was the stormwater treatment alternatives(pages 6-7 of the report) proposed for Johanson Park and Howell Park. Three alternatives were presented for each park, and each option was discussed in detail. At the end of the report, Seminole Ditch improvements were reported to include synthetic erosion matting with grass to stabilize the banks and a guardrail to be installed by the City. After the presentation, much discussion ensued. Commissioner Reed asked Mr. Mathews the capability of the current drainage system and was informed that they could not tell because of the outfall problems. Commissioner • • Minutes Page -.- October 14, 1996 Rosenbloom questioned the amount budgeted for the project and the cost of additional items over the original project budget. City Manager Jarboe recapped the figures listed on page -13- of the report. Commissioner Shaughnessy questioned if the City could spend money to repair outfall structures lying outside the city limits, even if the improvements are for the benefit of the citizens of Atlantic Beach. City Manager Jarboe believed the City could act so legally if it benefited the project, but also stated that he was working with the DOT, MPO and City of Jacksonville for resolution of the problem. City Attorney Jensen will provide a legal opinion concerning this matter before the next Commission meeting. Due to the additional costs involved with the project, Mayor Fletcher requested staff to recap the proposed project and research funding availabilities for the additional items (curb and gutter and outfall improvements) over the original project scope and report back to the Commission at the next meeting. Hugh Mathews stated that he needed a decision on the curb and gutter alternative as soon as possible. The report dated October 14, 1996, is attached and made part of this official record. Request for Information - Fire Department Statistics As requested by Commissioner Shaughnessy, City Manager Jarboe presented a report from the Fire Department concerning firefighter retention, response times and insurance ratings to clarify issues raised from inaccurate statements quoted in the Beaches Leader and Shoreline newspapers. A copy of the report is attached and made part of this official record. (Attachment C). Consent Agenda: A. MS Y N October 14, 1996 Public Works Director Kosoy. B. Capital Improvement Projects Report The Commission received and acknowledged the monthly Capital Improvements and Projects Report. C. Report relative to Kent Theater renovation Community Development Director Worley advised the Commission Kent Theater representatives would go before the Community Development Board the following evening to request variances to the minimum parking and landscaping requirements of the City Code. A brief discussion ensued concerning the issuance of the Certificate of Occupancy (CO). Mr. Worley explained that the CO was issued because it was a renovation project, but the company had not complied with the landscape and parking requirements as approved in the plans of the renovation. Mr. Worley further advised that staff was recommending denial of the request Commissioner Rosenbloom questioned if the request would be brought before the Commission and City Attorney Jensen advised Kent Theater could appeal the Community Development Board's decision in the Circuit Court. D. Sea Oats Apartment Complex Request for Reimbursement City Manager Jarboe reported that the Sea Oats Apartment Complex had experienced major water leaks and was requesting a rebate of$25,000 as compensation for sewer charges. No Commission action was taken on the request. E. Publix Request to Sell Beer and Wine Before 1:00 PM on Sundays City Manager Jarboe advised the Commission that Publix Supermarket had expressed an interest in being able to sell beer and wine before 1:00 p.m. on Sundays and indicated they would probably put the request in writing. 9. MS Y N October 14, 1996 City Clerk King stated there would be a meeting at 7:15 p.m. on Monday, October 21, 1996 with Dames and Moore to discuss their conceptual plans for Tresca Park. It was also reported a meeting would be held at 6:30 p.m. on Monday, October 28, 1996 with Captain Jan Gaudio of Mayport Naval Station to discuss items of mutual interest. City Attorney Jensen stated that he had participated in a conference call with Ann Perry of the Florida Community Trust concerning negotiations regarding the possible purchase of Dutton Island. Mr. Jensen then requested that the City appointment him their designated representative with authority to sign confidential documents required in the negotiations. FLETCHER X Commissioner Rosenbloom requested the Commission prepay the Beaches Historical Society $500 for a slide show, which was previously approved by the Commission but never paid. There being no further discussion, the motion carried unanimously. Commissioner Shaughnessy questioned the type of alarm system being installed in the Adele Grage Community Building. Jensen from Mr. Alan W. Potter. Sr. expressing concern about what Mr. Potter calls "Off-the-Top" Costs totalling $1,113,021.35. We are currently performing the City of Atlantic Beach, Florida's (the City) financial audit for the fiscal year ended September 30, 1996, which includes a review of the transactions relating to the Series 1996 Bonds, so Mr. Jim Jarboe has asked me to comment independently on Mr. Potter's figures. Original Issue Discount Mr. Potter's characterization of the Original Issue Discount (OID) as an "Off-the-Top" Cost is inappropriate. The OID of$635,380.70 is not a cost of issuance. This figure does not represent a cost to the City, but rather a reduction in the purchase price to the bondholders. This figure is 2.78% of par and means that on average, each$5,000 bond was purchased for$4,861 (97.22%). During the sale of bonds there will always be a trade-off between higher discounts and higher interest rates. There is an optimal mix of OID and coupon rates at the point of sale which will yield the lowest true interest cost to the City. Your financial advisors (First Union Capital Markets Corp_) determined that the optimal mix was the average OID of 97.22% with an average coupon rate of 5.4241%. The combination of the two components yields a true interest cost of 5.6957%. The financial advisors represent the City and have sophisticated programs to assure the City receives the optimal mix. Again, the OID is not considered a cost of issuance. If the bonds had not been issued with an OID, your true interest cost would have exceeded 5.6957%, which would have meant a higher overall cost to the City. Insurance There are two other items which Mr. Potter refers to as "Off-the-Top" Costs which were determined by your financial advisors to be worthwhile, as they lowered the coupon rate on the bonds resulting in an overall savings to the City. They included the following: • Bond Insurance - $115.000 (Insures against a payment default by the City and allows for a higher bond rating. thus lower coupon rate; bond insurance normally requires a reserve account equal to two semiannual payments) • Surety Bond - $36,000 (Replaces the requirement for a reserve account, lowering the par amount required, and eliminating the related debt service and additional issuance costs thereon.) Mr. Potter also refers to a$28,452 insurance premium to AMBAC Indemnity Corporation to insure against nonpayment of invested monies in the event of default by the investment custodian. Although this policy appears in the City's bond documents (Tab 33), the premium was not paid by the City, but by AMBAC Indemnity Corporation. Other Issuance Costs Total Costs of Issuance, including insurance were$443,664. Total Costs of Issuance, excluding insurance, were$292,664. The latter amount represents all amounts paid by the City to the bond attorneys, financial advisors, underwriters, consulting engineers, rating agencies, and other parties in connection with the bond issuance, not Mr. Potter's$1,113,021.35 figure. The issuance costs of$292,664 represent 1.28%of the total amount of the$22,835,000 bond issue. Based on our experience with other municipalities, these costs are very low. The largest single cost was the Underwriter's Discount, at$118,514 ($5.19/$1,000 par value), which is the lowest percentage rate I have seen in ten years. These overall low issuance costs are a reflection on the excellent performance of your financial advisors. I hope these observations have been helpful. Please call me if you have any questions. Jarboe City Manager JRJ:tl Attachment interoffice MEMOPANDUM to: Jim Jarboe, City Manager from: The Atlantic Beach Fire Rescue Department subject: Newspaper Articles Oct. 9, 1996 /4 ` date: October 14, 1996 On October 9, 1996 there were two (2) articles written about Atlantic Beach Fire Rescue Department. Within those articles there were three(3) areas that required clarification, as those quotes are not quite accurate. 1. Firefighter retention: It is true that Atlantic Beach Fire Rescue has lost many of it staff; and we are scheduled to lose several more. It is also true that many like size departments have experienced the same losses. This has nothing to do with the city's level of fire protection and level of service, it's merely a matter of dollars and cents to the individual firefighter in his pursuit to better provide for his family. The reason that there are a large number of firefighters exiting smaller departments this year is because Jacksonville has had about 80 people retire in the last year and a half. Most, if not all of Jacksonville's replacement firefighters came from surrounding smaller departments. We are not saying that this is the only time we have lost firefighters to Jacksonville. Over the last several years we have slowly lost firefighters to the bigger cit to the west. if Neptune Beach, or a like city with a predominate volunteer department were to become a fully staffed and paid Lire department. they would surely experience the same manpower loss, unless they were willing to match the salary and benefits of the larger cities. 2. Insurance Ratings: The insurance classification which is being referred to. is the ISO Commercial Risk Services grading of a Public Protection Class. The article in the Shorelines stated that Neptune Beach had a higher rating than Atlantic Beach, and according to the Beaches Leader, Atlantic Beach and Neptune Beach both had a rating of 6. The actual rate is that both cities have a "6" The Neptune Beach classification was awarded in May of 1994. The Classification awarded to Atlantic Beach was September of 1982. There have been many changes in fire protection in the City of Atlantic Beach since 1982. When we were last graded, we were just emerging from a Volunteer/Public Safety department and only had 4 full time firefighters with limited equipment. Since that time the department has grown to a 17 man staff with 2 being Chief officers, as well as additional firefighting apparatus that wasn't availably in 1982. Jim Jarboe, City Manager Page 2 October 14, 1996 Currently we are scheduled to be regraded this month. It is with the addition of 3 new firefighters positions and 2 dispatchers positions, a new fire truck, additional equipment, and better water distribution service. We are anticipating a rating of a 4. However, with a concentrated effort on behalf of the city, it would not be unlikely for the department to achieve a class 2 rating in the very near future. For your information there are only five(5) class 2 rated cities in the state. 3. Response times: The times indicated in the Shorelines appear to have been inverted. In a meeting with the Neptune Beach City Manager and the Atlantic Beach City Manager the Neptune Beach City Manager stated that Neptune Fire Department response time was 3.6 minutes. Over the past year as indicated in Monthly Staff Reports the Atlantic Beach Fire Rescue Department has maintained an averaged 3 minutes response time. It should be noted that these response times are predicated on the response of a fire engine responding to a scene of an incident within the 7 plus square mile jurisdiction of Atlantic Beach. Conversely the response time of Neptune Beach Fire Department could be distorted due to an on duty police officer arriving at the scene in a police car, within a 2 square mile jurisdictional boundary. The response times of the two (2) cities are not a fair comparison. Atlantic Beach responses are measured with a fully equipped and fully manned fire engine, and the City of Neptune may be measured with a roaming police officer in a patrol car with only a set of bunker gear. I have particular concern over the statement in paragraph 14 with regard to our rating used by insurance companies to set rates with regard to fire service. Can you also comment on the respective response times for fire mentioned in paragraph 15. In light of the fact that we operate a full-time paid firefighting force, it is hard to believe that we do not favorably compare with one that is essentially a volunteer force.
