The meeting was called to order by Mayor Fletcher. The
invocation was followed by the pledge to the flag.
1. Approval of the minutes of the Regular Commission meeting

2. Recognition of Visitors
William Gulliford, representing the Donner Community
Development Corporation, distributed a floor plan and
proposed layout for affordable houses in the Donner area and
he indicated it was hoped a contractor would be selected
before the end of the summer.
Donald Wallis, Chairman, Beaches Fine Arts Series, Inc. ,
reported the annual Sprint Triathlon Series would be held
Saturday, June 17, Saturday, July 25, and Saturday, August 12,
1995. Mayor Fletcher asked City Manager, Kim Leinbach, to
meet with Mr. Wallis to coordinate and approve the events.
Chip Drysdale, Captain, Atlantic Beach Patrol, presented and
read in its entirety a "Resolution for the Request for an
Investigation into the Management of the Atlantic Beach
Patrol" dated June 12, 1995 (copy attached hereto and made a
part hereof - Exhibit A.) He indicated members of the
Atlantic Beach Patrol felt they were operating in what they
perceived to be unsafe conditions.
During discussion, Commission Weiss felt if the situation was
a serious threat to lifeguards and citizens, perhaps it would
be prudent to close the beach.

Leinbach, and John Ruley, Fire Chiet, would meet—win Mr.
Drysdale on Tuesday, June 13, 1995 to address the matter.
George Cummings, 395 12th Street, presented a letter which was
read in its entirety to the Commission. The letter indicated
his support of the lifeguards (attached hereto and made a
part hereof - Exhibit B) .
Stewart Hicks, Chairman of the Pension Board of Trustees,
requested authorization for the city to join the Florida
Public Pension Trustees Association. He indicated a
conference would be held June 25-28, 1995. The Commission
asked Mr. Hicks to meet with Kim Leinbach for the purpose of
processing the application for one or two of the pension board
members to attend educational programs and joining the
Association.
Sharette Simpkins presented a petition from residents and
friends of the Donner neighborhood and Donner park requesting
action of the Commission relative to the Donner Park Community
Center (petition attached hereto and made a part hereof -
Exhibit C) . It was requested that the existing bathrooms
be demolished, that the proposed site be readdressed, and that
the new community center needed four, not two bathrooms, with
two bathrooms accessible from the outside of the building,
only, and two bathrooms accessible from the inside of the
building, only.
The Mayor asked the City Manager to determine the status of
the project with the architect. It was explained issues
relative to the bathrooms could be readdressed, but that since
$2,000 had already been spent on soil tests for the eastern
site of the new building, that it might not be prudent to
suggest moving the site.
Commissioner Shaughnessy requested that discussion concerning
demolishing the existing building be placed on the next agenda
when a full Commission would be present.
Mayor Fletcher agreed to ensure that a copy of the
construction plans be made available to Sharette Simpkins,
when available.
Bob Rosoy, Public Works Director, introduced David Fussell, a
new Public Works employee who would serve as Assistant Public
Works Director.
3. Consent Agenda:
a. Acknowledge receipt of monthly reports from Building, Code
Enforcement, Parks & Recreation, and Fire Departments
b. Acknowledge receipt of Public Works project status report
Following a brief discussion, the Commission accepted the
above reports.

4. Action on Resolutions:
a. Resolution No. 95-19 - A RESOLUTION TRANSFERRING CERTAIN
MONIES BETWEEN FUNDS.
Mayor Fletcher presented in full, in writing, Resolution No.
95-19.
Bob Kosoy explained the purpose of the transfer of funds was
to mill and resurface Royal Palms and Sailfish Drive from
Atlantic Boulevard to Plaza. It was recommended that the work
be done under the City of Jacksonville contract prices at a
total cost for both streets of $82,178.81.

Commissioner Waters felt Sherry Drive was in need of repair.
Mr. Kosoy explained that Sherry Drive had a lot of
infrastructure to be done, and he indicated that if work was
not done on Royal Palms and Sailfish Drive as soon as
possible, it would be necessary to completely reconstruct the
streets.
The question was called and the vote resulted in 3-1 with
Commissioner Shaughnessy voting nay. The motion carried.
b. Resolution No. 95-20 - A RESOLUTION TRANSFERRING CERTAIN
MONIES BETWEEN FUNDS.
Mayor Fletcher presented in full, in writing, Resolution No.
95-20.
It was explained the purpose of the transfer of funds was to
pay for a fence to be constructed to provide privacy for
neighbors who lived adjacent to the dune crossover at 16th
Street. Bob Kosoy indicated he and Kim Leinbach met with
neighbors concerning the matter, and as a result of the
meeting it was recommended that the Commission approve
the funding to construct a fence to provide privacy to the
residents who lived north of the crossover. SHAUGHNESSY X

Several commissioners indicated they were in favor of the
construction of the fence, but that they would prefer
using funds from another source rather than using bed tax
funds.

The question was called and the motion carried unanimously.
Property owners who lived adjacent to the dune crossover
indicated their desire to participate in discussions
concerning the construction of the crossover. Mayor Fletcher
invited participation of interested parties.
Alan Jensen, City Attorney, reminded everyone that the city
was bound by a court agreement on how the crossover would be
built.
c. Resolution No. 95-21 - A RESOLUTION TRANSFERRING CERTAIN
MONIES BETWEEN FUNDS.
Mayor Fletcher presented in full, in writing, Resolution No.
95-21.
Kim Leinbach reported that a problem had arisen relative to
the beginning of termite infestation in City Hall, the Public
Safety Building and the Adele Grage Community Center and it
was recommended that the transfer of $7,370 be approved to pay
for treatment. He indicated staff had taken bids and were
proposing to award the job to the lowest bidder.
Motion: Approve Passage of Resolution 95-21 and HAUGHNESSY X

5. Action on Ordinances:
a. Ordinance No. 58-95-20 - Final reading
AN ORDINANCE OF THE CITY OF ATLANTIC BEACH, FLORIDA, AMENDING
CHAPTER 2, ADMINISTRATION, ARTICLE VI, EMPLOYEE BENEFITS,
DIVISION 3, RETIREMENT SYSTEM, SEC. 2-279(A) , DISABILITY
RETIREMENT, BY ESTABLISHING A MINIMUM BENEFIT FOR POLICE
OFFICERS AND FIREFIGHTERS DISABLED IN THE LINE OF DUTY, AND
PROVIDING AN EFFECTIVE DATE.
Mayor Fletcher presented in full, in writing, Ordinance No.
58-95-20, said ordinance having been posted in accordance with
Charter requirements. He opened the floor for a public
hearing and invited comments from the audience.

Commissioner Waters felt the city was moving very rapidly to
pass this legislation. He felt if the city had three or four
people who retired on disability at a youthful age at one
time, the city's pension fund would be strained. He felt the
city had a responsibility to look after all employees, and he
suggested the matter should be brought up through proper
channels.

Amended motion: Postpone action on ordinance No. WATERS X
58-95-20 to allow City Manager and staff to conduct WEISS

Motion died for lack of a second.
Commissioner Waters felt all options had not been explored. He
suggested the possibility of purchasing disability insurance.
When asked how the benefit would be funded Lt. Jared Smith,
representative for the Pension Board, explained the Pension
Fund was very strong and the Actuary indicated it would be no
problem funding the benefit under discussion. Lt. Smith
explained originally public safety officers requested this
benefit and offered to pay for it, and that the general
employees did not wish to have the benefit. It was explained
the contributions would not be required until 1995/96. Lt.
Smith indicated he would get a written statement from the
Actuary indicated that the benefit would begin this year, but
that contributions would not be required until next year.
The question was called on the original motion and it carried
unanimously.
6. New Business:
a. Public hearing and final action on an application for a
Use-by-Exception filed by Frank Thrower of Thrower Homes,
Inc. to operate a construction company office at property
located at 645 Mayport Road, zoned CPO, Commercial
professional & offices
George Worley, City Planner, explained Frank Thrower was a
general building contractor desiring to operate an office at
645 Mayport Road, Suite F. Mr. Thrower proposed to operate a
business office, only, with no outside storage or heavy
construction vehicle parking. The zoning district (CPO)
permitted similar office uses as Uses-by-Exception. Mr.
Worley indicated the Community Development Board found the
request to be consistent with the intent of the district and
unanimously recommended approval of the request with the
conditions that no outside storage of materials occur and that
no parking of large commercial vehicles be permitted

Bob Kosoy reported it was the consensus of the Awards
Committee that the City accept the low bid from Consumers
Applied Technologies in the amount of $13.90 per meter, with
the work to be completed by both the contractor and city
workers to achieve maximum savings.

Bob Kosoy explained the history and use of the sludge pump
under discussion, and he indicated the pump had been reliable
in the past.

d. Accept water, sewer, drainage, and streets in Selva
Linkside Unit II for public maintenance
Bob Kosoy indicated the developer, Centex Homes, had corrected
problems with the outlet structure in the retention basin and
continued to make repairs to paving and curbing as the
remaining homes were being built. He recommended accepting
Selva Linkside Unit II, Phase 2 for maintenance by the City,
with a Maintenance Bond of $10,000 for remaining curbing,
paving, and drainage structure repairs.

the Police Department
Kim Leinbach reminded the Commission that at the last
commission meeting approval was granted for the Police
Department to buy three new vehicles. Specifically, the
Commission allowed purchase of the vehicles through the
Florida Sheriff's Association. Mr. Leinbach recommended that
the Commission waive the formal bid procedure and reaffirm the
purchase of three vehicles from the Florida Sheriff's
Association.

Kim Leinbach reported Jacksonville Electric Authority was
actively working to improve service in the City.
Maureen King, City Clerk, reported GATX, Inc. would be having
a groundbreaking ceremony Saturday, June 17, 1995,
10:30 a.m. , on Francis Avenue.
Commissioner Weiss referred to the trackless trolley car that
was on display at Neptune Beach. He indicated it was an
interesting concept for transportation in areas of the
beaches.
Commissioner Shaughnessy reported in addition to Sharette
Simpkins, another Atlantic Beach resident was a finalist for
the Eve Award.

RESOLUTION FOR THE REQUEST FOR AN INVESTIGATION
INTO THE
MANAGEMENT OF THE
ATLANTIC BEACH PATROL
June 12 , 1995
WHEREAS: The Atlantic Beach Patrol is operating without :
1 . Safe or reliable emergency response vehicles .
2 . A safe and habitable lifeguard station .
3 . Safe and effective lifeguard towers .
WHEREAS: Unsafe and inadequate equipment has resulted in reduced
or no vehicular response to water rescue emergencies , an injury
to a lifeguard, and increased operational expenses .
WHEREAS: Management policy dictating the allocation of tower
services , contrary to past standards established by the Atlantic
Beach Patrol , has jeopardized the safety of many of the citizens
for the convenience of a few.
WHEREAS: Many of the current problems that have currently
crippled the Atlantic Beach Patrol in it ' s effective delivery of
service could have been prevented if management had followed the
budgetary and operational plans created and presented in 1994 .
All contingencies which are now problematic had previously been
anticipated, planned, and budgeted.
WHEREAS: The causes and detailed methods , including alternatives
for the solutions to the current problems , were presented to the
Fire Chief as early as January of this year .
WHEREAS: The Fire Chief , John Ruly, has had ample time and
opportunity to allocate resources and provide administrative
support to solve the current crisis with Beach Patrol operations .
NOW, THEREFORE, BE IT RESOLVED: By the undersigned employees and
citizens of the City of Atlantic Beach, request that the City
Commission :
Section 1 : Investigate the management problems associated with
the safe and effective operations of the Atlantic Beach Patrol .
It is also requested that if this investigation takes the form of
a committee, that this committee does not have the City Manager
as one of it ' s committee members .
Section 2 : Approve and institute solutions to the problems of the
Atlantic Beach Patrol management .
