The meeting was called to order by Mayor Gulliford. The
invocation, offered by Commissioner Cook, was followed by the
pledge to the flag.

1. Recognition of visitors:
;andra Sheppard, 44 Dewees Avenue, inquired whether the proposed
project to lay water and sewer lines in the Dewees Avenue area
included any plans for paving in that area. She said while the
water lines were badly needed, she hoped the streets would be left
in their natural state. The City Manager said he was not aware of
any plans for paving but he would check into the matter. Mayor
Gulliford said he would be happy to go along with the verbal
agreement of the former mayor to leave the streets unpaved.
3. Old Business:
A. Locked gate at Aquatic Gardens subdivision
City Attorney Jensen said the developer had been instructed to pave
Cutlass Drive, primarily for use by emergency vehicles. He said
with both accesses open the subdivision would be in compliance with
the city code.
Chief Rew said the Fire Department could respond to emergencies in
Aquatic Gardens a minute and a half to two minutes faster if the
gate was open. Chief Thompson said on a number of occasions the
closed gate had impeded the Police Department in responding quickly
to calls and said it would be his recommendation that the gate
remain open.
Ron Summers, 348 Aquatic Gardens, said speeding and not observing
stop signs was already a problem and he felt this situation would
worsen if the gate was opened. He presented petitions from
residents opposing the opening of the gate and said he was more
concerned about the possibility of an accident due to increased

traffic than he was about a slower response to a situation
involving the fire or police.
Chris Blanchard, 588 Aquatic Drive, said he felt the provision in
the city code requiring two separate entrances was for the safety
and protection of the citizens and urged the opening of the gate.
Ruth Gregg, 905 Sailfish Drive and Kathy Russell, 2117 Seminole
Road, both spoke in favor of opening the gate.
Barbara Bonner, 463 Selva Lakes Circle, said her interest in the
situation was as a property owner, not a resident. She outlined in
chronological order the actions taken by the city in connection
with this gate since 1982.
The mayor said in view of the legal liability incurred by the city
in keeping the gate closed, and based on the opinion of the City
Attorney, he did not see that the city had any choice but to remove
the gate. However, he said action regarding the gate was within
the administrative powers of the City Manager and he deferred final
action on the matter to him.
The City Manager said due to the liability to the city as a whole,
it was his intention to order removal of the gate.
1. Consent Agenda:
A. John TienBroeck, President of the Jacksonville Track Club,
requesting permission to use no more than three vehicles on

Commissioner Weldon inquired what the additional $8,000 covered.
Tom McNett of Clements Rumpel said the original fee of $36,000 had
peen for a building of 5,000 - 5,500 sq. ft. Preliminary
programming indicated 6,500 - 7,000 sq. ft. would be required and
the City Commission approved an increase in the contract to

$44,000. Subsequent to that there was a discussion on planning for
anticipated expansion to the year 2000 and the mezzanine level was
designed to accommodate this future expansion. A fee had not been
established for the additional work. The mezzanine level which
will be left unfinished with the exception of carpeting and
painting, has been included as a part of the current bid package.
Commissioner Weldon said he was unhappy about the additional cost
and further discussion ensued relative to the additional work
involved in the redesign to accommodate the mezzanine level. Mr.
McNett said he would reduce his charge to $6,000 and donate $2,000
to the new city hall.

5. Committee Reports:
A. Commissioner Edwards, Chairman of the Awards Ccnmittee with a
report and recommendation on the sports lighting at Russell Park
Commissioner Edwards reported after review of the two bids
received, the Awards Committee had determined the bid of Mardant
Electric of Jacksonville, at a total price of $27,824.00 was the
lowest and best bid. An amount of $25,000.00 had been budgeted for
the lighting and Commissioner Edwards said funds saved on two other
projects would be utilized to fund the $2,824.00 which is over
budget on this project.

Commissioner Edwards reported eight bids had been received for the
construction of a basketball court at Russell Park. After review
of the bids it was the recommendation of the Awards Committee that
the city accept the bid of Robert Lawrence Construction at
$3,965.00 which was well below the budgeted amount of $6,500.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF
ATLANTIC BEACH, AMENDING CHAPTER 12, NUISANCES, ADDING UNDER SEC.
12-1(b) PARAGRAPH (9) TO PROVIDE FOR RETRIEVAL OF SHOPPING CARTS BY
OWNERS THEREOF, PROVIDING AN EFFECTIVE DATE.
Mayor Gulliford presented in full, in writing, Ordinance No.
95-89•-43 on second and final reading. Said ordinance was posted in
accordance with Charter requirements. The Mayor opened the floor
for a public hearing and invited comments from the audience.
?at Pillmore, 995 Camelia Street, said abandoned carts were an
eye-sore throughout the city and said some kind of regulation was
necessary. William McGee, 1831 Selva Marina Drive, questioned
whether it was fair to penalize store owners for what amounted to
theft of their property. The City Attorney explained store owners
had been reluctant to prosecute offenders and the carts were being
abandoned on city property, vacant lots and ditches and, even when
picked up by city crews, the owners had not retrieved them. This
ordinance would require the owners to establish a retrieval policy. Cook x

Commissioner Cook inquired regarding penalties and the City
Attorney advised it would be covered by the general penalty
established in Chapter 12 of the city code. The question was

REPORTS, REMOVAL AND MAINTENANCE OF TREES, AND PROVIDING AN
EFFECTIVE DATE

Pat Pil]more, 995 Camelia Street, said removal of the trees in
connection with the Section H project had increased the noise.
Other Section H residents who spoke in favor of sparing as many
trees as possible and properly sealing those trees which had to be
trimmed included Beverly Hadden, 500 Orchid Street; Helene
Demarest, 750 Jasmine Street; Charles Nolan, 851 Begonia Street;
Shirley Taylor, 480 West Ninth Street; and Tarry Williams 580 West
Ninth Street
Larry Figart, Urban Forester with Division of Forestry for Duval
County, said it was a fair ordinance and encouraged its approval.
Others who supported the ordinance included Dezmond Waters, 1835
Seminole Road; Sandy Sheppard, 44 Dewees Avenue; William McGee,
1831 Selva Marina Drive; and Kathy Russell, 2117 Beach Avenue.
After everyone had been given an opportunity to speak to the
ordinance, the Mayor declared the public hearing closed.

to make amendments to the ordinance at a later date. Mayor
Gulliford said he was not anxious to establish another board, and
pointed out the ordinance did not contain any provision requiring
the board to respond in a timely manner to requests for permits.
He asked Jody Ford, Chairman of the Beautification Committee, for
her comments on the ordinance. She said since there was currently
no tree protection in the city, she urged the commission to act on
the ordinance tonight and consider amendments at a later date. She
said Lyman Fletcher of the Beautification Committee, had reviewed
the ordinance and would submit suggestions for amendments. The
question was called and the motion carried on a 4 - 1 vote with
Commissioner Cook voting nay.
C. Ordinance No. 90-89-150 - Public Hearing

In discussion before the vote the City Attorney pointed out two
public hearings would be required, one of which could be before the
Community Development Board. However, in view of the schedule for
Community Development Board meetings, it was felt the matter could
be handled in a more timely manner by having both public hearings
before the City Commission. The public hearings were scheduled for
January 22 and February 12, 1990 and the City Clerk was asked to
mail notices of the public hearings to all owners of property
within 200 feet of the development (Tiffany by the Sea) .
kt this time Commissioner Cook announced a meeting regarding the
Wonderwood Expressway would be held at Jacksonville Community
Center at 7:00 PM on Wednesday, January 17, 1990, and urged
everyone to attend and make their opinions known. He said the new
Wonderwood Expressway would help alleviate much of the traffic
congestion on Mayport Road. Mayor Gulliford designated this
meeting as a meeting of the committee of the whole of Atlantic
Beach City Commission.

Mayor Gulliford said he had received a telephone call from Mrs.
Williams of Section H regarding trees which were being destroyed.
He said in some cases where the trees were in the right of way,
nothing could be done to save them. The city was required to
comply with the specifications of other governmental agencies
involved. Complaints were voiced about the disruption in garbage
collection, electrical and cable television service and the lack of
concern shown by the project manager. A meeting was scheduled for
Wednesday, January 10, 1990 to give the Section H residents an
opportunity to direct their questions and concerns to the
engineers, contractor, and project manager.

7. New Business:
A. Welcome to Atlantic Beach signs (Carl Walker)
Mr. Walker presented a proposal to replace four Welcome to Atlantic
Beach signs to replace the very old and damaged signs currently in
place. The total price of four signs of the design recommended by
the Beautification Committee, including demolition of the current
signs, was $6,985.00. He said the city had withdrawn its
application to Keep America Beautiful program and they hoped the
fee of $1,500.00 would be refunded and could be applied to the cost
of the signs.
While the City Commission was generally in favor of the new signs,
in view of the cost it was pointed out it would be necessary to
prepare specifications and invite bids.
B. Preliminary plat approval - Sam Waters, part of Lot 5, Block
3, Lewis Subdivision (Community Development Director, Rene' Angers)

regarding the drainage easement to the east of the the subject
property and asked Attorney Paul Eakin, attorney for Mr. Waters, if
he would check and see if this drainage easement had ever been
granted to the City of Atlantic Beach. Mr. Eakin said he would
check into the matter.
C. Change Order No. 1 Liao Atlantic Coast Asphalt, Inc. in the
amount of $2,940.00 for the construction of Third Street 16' wide
by 130' in lieu of 50' x 18' as shown on plans
The City Manager explained in the original specifications, the

8. City Manager reports and/or correspondence
A. Report on carports in Royal Palms subdivision
The City Manager reported he had attended the last meeting of the
Community Development Board and learned it had been at their
request the permits in the Royal Palm subdivision had been
reviewed. He said that board was handling the carport matters and
he did not feel any action would be required by the Commission
unless a problem arose. He also said the code was being uniformly
enforced throughout the city. The City Attorney said he felt the
carport owners should be encouraged to apply for the variances.
B. Recommendation to hire a City Engineer for Public Works
Lhe City Manager confirmed that the Commissioners had received his
memorandum relative to retaining an engineer as Public Services
Director.

Mr. Leinbach also reported staff members had met with Gee and
Jenson relative to consolidation of the Buccaneer and Atlantic
Beach wastewater plants and were ready to present their report to
Commissioner Edwards.
The City Manager also suggested setting a date for a goal setting
session and after brief discussion this was scheduled for January
27, 1990.
City Attorney Jensen confirmed that the commissioners had received
a copy of the noise ordinance which had recently been passed by the
City of Jacksonville Beach.
fr. Jensen also said he had reviewed the amendment to the Ocean
Terrace development which had been approved at the previous
meeting. He said the Statute required two public hearings for such
amendments.
Mr. Jensen said he had met with several different parties,
including the property owner, in connection with the Sixteenth
Street access and was hopeful this matter could be resolved. He
will report further at the next meeting.

Mayor GUlliford said he had requested the City Attorney to check
into the possibility of purchasing a piece of property adjacent to
Donner Park, currently owned by Pete Mabry. Mr. Jensen had
negotiated a purchase price of $76,000,with Mr. Mabry and the city
to split the closing costs.
Notion: Authorize the City Attorney to formalize an offer to Cook x x
purchase the property for $76,000, to be paid for Edwards x
frau $125,000 received frau the City of Jacksonville Tucker x
and the closing costs to be split between both Weldon x x
parties. Gulliford x

SKr. Jensen said he had been requested by the Sea Turtle to provide
a written opinion stating they can rent their rooms on a weekly

basis. He said the city code permitted weekly rentals but since
they had stated they intended to have rentals for terms up to
fifty-two weeks he wanted to bring the matter before the
Commission. Mayor Gulliford requested the decision on the matter
be deferred till the next meeting. Commissioner Weldon inquired
into the status of the green light at the Sea Turtle and was
advised no contact had been made with the new manager on the
matter.

The City Clerk reported the terms of three members of the Code
enforcement Board had expired as had the terms of two of the
Community Development Board members.

Mayor Gulliford said he felt it was important that the City
Commission have a an informal meeting with Pension Board members
within the next month or so.
The Mayor expressed disappointment relative to Community
Development Grant funds and said he had not been informed of a
-leeting which had been held with residents of the Jordan Park
rea.
Mayor Gulliford said the Finance Director had prepared a projection
on the operations of the Oak Harbor water and sewer through 1992/93
which showed a net loss of $71,000 in 1989 continued the losing
trend through 1993. He said the engineers had indicated the city
would pay less than $10,000 per year to rehabilitate the system and
$100,000 had been budgeted for this fiscal year. He asked Mr.
Royal and Mr. McNally to review figures for recent months and
directed the City Attorney to check further to see if there may
have been any misrepresentation.
There being no further business to come before the Commission, the
Mayor declared the meeting adjourned at 10:45 PM.
