The meeting was called to order by Mayor Howell. The invocation,offerel

2. Recognition of visitors - None
Report and recommendations from engineers, Smith and Gillespie, on
award of contract for the reconstruction, replacement or repair of nine
manholes in the City's continuing sewer rehabilitation project
On April 20th, four bids were received for the project of reconstructing
nine manholes on Selva Marina Drive, Seminole Rd. , and 11th St. , and
reconstruction or replacement of two manholes, one at 17th and one at
19th St. Mr. Jacques of Smith and Gillespie reported their firm had
verified and evaluated the four bids, and they recommended the project
e awarded to the low bidder for the modified total base bid, (they
recommended, based on the low bid, the two manholes on 17th and 19th
Sts. be replaced) . The low bidder was J. C. Kimberly Co. of Amelia
Island, Fl. , in the amount of $57,219. They also recommended proper
performance and payment bond. As previously directed under their
project # 8505-06-03, Smith & Gillespie will provide an on site
resident observer for the construction period.
Smith & Gillespie's estimate was approximately $81,000. The four bids
received ranged from $52,219 to $108,000. Bid tabulation is attached
hereto and made a part thereof. Mr. Fellows added that money was budge:-
ed for the manholes.
Motion: Award the contract for the reconstruction or replacement of Cook x
eleven manholes to the low bidder, J. C. Kimberly of Amelia Edwards x x
Island, Fl. in the amount of $52,219.00 as recommended by Gulliford x x

During discussion before the vote, Mr. Jacques advised the performance
bond will be delivered as soon as the letter of award was received. The

4. Action on Exceptions:
A. Action by the City Commission on an application for exception by
Bennett Construction Company for the sale of beer and wine at 100 W. 1st
Mayor Howell acknowledged receipt of the application for exception by
Mr. Bennett for the sale of beer and wine at his new bar-b-que restaurant
at 100 West 1st St. He set a Public Hearing for May 9, 1988.
B. Action by the City Commission on an application for Fred Lewis, Inc ,
for a Use by Exception for an auto service Goodyear tire store in a CG
zoning district.
Mayor Howell acknowledged receipt of the application for Use by Except-

access. The Mayor said the city may get 75% of the approximate $38,600,
price on the condemnation of the 20th St. access.

Mayor Howell presented in full, in writing Ordinance No. 95-88-33 on
second and final reading. Said Ordinance was posted in line with Charter
requirements. The Mayor opened the floor for a Public Hearing and invi :ed
comments from the audience.
animal Control Officer, B. J. Lester explained to the audience why she
uad asked for the amendments. One family was keeping a goat in the city
limits. Another problem that had to be cleared up was that a dog cannot
be vaccinated against rabies until it is four months of age, according
to the local veterinarian.
Ms. Lester recommended the Ordinance be changed to increase the maximum
length of the leash from eight (8) to twelve (12) feet in order to ac-
ommodate the elderly citizens who walk their dogs on the beach.She also
10Frecommended the Ordinance should permit people who like to swim in the
ocean with their pets to remove the leash while in the water, providing
they immediately re-leash the dog when coming out of the water. Ms.
Lester recommended the dog owners be required to carry something with
them to clean up, such as a plastic bag, or a small shovel or trowel
to clean up, to comply with the Ordinance. Do not bury the waste.
Ms. Lester recommended the city register dogs on a permanent basis, non-
transferable, for the life of the dog, as long as the rabies tags were
up to date. Tags would be $5.00 for spayed or neutered pets, and $15.00
for others. Pet owners could get a $10.00 rebate whenever they provided
proof that a registered pet had subsequently been spayed or neutered.
Mrs. Ruth Gregg, 905 Sailfish Drive asked why they had removed,from the
Ordinance, the number of dogs allowed at one residence. Ms. Lester ex-
plained the city could control that problem under the nuisance section
of the Ordinance.
Mrs. Kathleen Russell, 2117 Beach Avenue, asked what harm would it be
to allow dogs to run unleashed on the beach with their owners before
7:00 a.m. Mayor Howell told her the city had tried that in vain.

Julia Hyatt, 6th St. asked what citation would be issued for people
who didn't clean up after their pets. Ms. Lester told her she had to
witness the incident before issuing a citation. She would issue a
warning first until new signs are erected. The charge would be $25.00
for 1st offense and $5.00 court cost; $40.00 for 2nd offense and
$5.00 court cost, and $75.00 for third offense and $5.00 court cost.
Gene Nordan, 1160 Beach Avenue, suggested pet owners who were willing
to abide by the law, be allowed to cite violators of the Ordinance.
The City Attorney said if the individual saw the violation occur, and
knew the person, a complaint could be filed with the Animal Control
Officer. Discussion followed.
s no one else spoke for or against the Ordinance, the Mayor closed the
Public Hearing. A lengthy discussion followed on replacing the city's
annual registration of dogs with permanent licenses. Following discus-
sion, the Commission unanimously agreed to change Section 4-22 (c)
lines 2, 3, and 5 the words should to shall.
The Commission instructed the Animal Control Officer to have new signs
posted at the beach accesses, and issue citations, not warnings, even
-or a first offense, for any dog caught on the beach without an Atlantic
Beach registration tag. Dog owners must also have a rabies tag or be
able to prove their rabies inoculations are current.
Mayor Howell pointed out the Ordinance did not differentiate between the
beach and anywhere in the city, so if a visitor came from Jacksonville
with proper tags issued by Jacksonville, the Animal Control Officer
would have to give them a citation if they had not purchase an Atlantic
teach tag. He felt that should be changed. Mr. Mullis asked if dogs on
the beach would be more dangerous to health and safety than the dogs on
the streets. Commissioner Gulliford said yes, as many people walk bare-
foot on the beach, but not on the street. Mayor Howell said the signs
would have to be posted to say if a dog goes on the beach, he must have
an Atlantic Beach tag. Mr. Mullis commented the last sentence under
Section 4-26 (c) was "This provision shall also apply to dog owners
whose dogs defecate on people's lawns, on the street ends to the beach ,
in the public parks, and public right-of-ways." Following discussion,
it was the consensus of the Commission that anyone who takes an animal
on the beach must have an Atlantic Beach tag.
Mr. Mullis said the Ordinance could be enforced, even if a visitor's dog
had a valid tag issued by the city where he lived, or was from a com-
munity that did not require registration.
Motion: Passage of Ordinance No. 95-88-33 on second and final Cook x

AN ORDINANCE GRANTING TO CARL STUCKI CREDIT IN THE CITY'S RETIREMENT
SYSTEM DURING THE PERIOD OF TIME BETWEEN AUGUST 8, 1982 AND APRIL 1,
1988; PROVIDING METHOD OF DETERMINING BENEFITS AND PROVIDING AN
EFFECTIVE DATE.
Mayor Howell said the Ordinance was to correct the intent of an agree-
ment made in 1982. He asked the Commission to waive the rules and pass
the Ordinance on emergency.

Miscellaneous
Mr. Vincent Akra, 4430 Landover Drive, Jacksonville. He was the owner
of property containing a strip shopping center northeast of Plaza on
:ayport Road. He was concerned relative to actions taken on a request
oy Fred Lewis for a Use by Exception for an auto service Goodyear tire
store. Mayor Howell told him the request was merely accepted in order to
set a Public Hearing for citizen input. Mr. Akra stated he had checked
with Goodyear and they had no application for a franchise at this time
Mr. Akra complained of garbage and beer cans in the 20' easement in back
of his stores that were thrown there by the occupants of M & L. Mayor
Howell suggested he attend the meeting of June 13, 1988 for the Public
4110-Tearing.
Mr. Fellows reported that sometime ago he sent to Mary Nogas,Jacksonvi=le
some information relative to the city's proposed acquisition of land for
solid waste transfer station in our plan to prepare ourselves for the
closing of Girvin Road landfill. Mrs. Nogas called and informed him that
the City of Jacksonville, as far as transfer stations were concerned,
were not going to do anything for several years, and if they did, it
would be down toward the Mandarin area. She also said the one our city
planned would not be available or useful for the City of Jacksonville,
but could be useful for Neptune and Jacksonville Beaches. Mrs. Nogas
warned Mr. Fellows that the Girvin Road landfill would be closed on
December 1, 1988. Our city has acquired about four acres for the possi-
bility of constructing a solid waste transfer center. Mr. Fellows sug-
gested the city go out under the Competitive Negotiation Act and acquire
engineering services to do some site studies.
Motion: Authorize the City Manager to initiate inquiry under the Cook x
Competitive Negotiation Act to seek an Engineer. The Edwards x x

Mayor Howell announced the city had obtained an injunction to close down
one of the establishments on Mayport Road that had created many problems
for the city. The owner had done everything he could to clean up the
building, and had recently leased it to a new tenant who will be opening
a lawn service comany in the near future.
The Mayor mentioned he had been in negotiations with the owners of the
Oak Harbor utility system, Atlantic Utilities out of Miami. It appeared
it might be viable for the city to take a look at the purchase of the
distribution system, and collection system, not their plant. We could
tie it into the Buccaneer system and pick up 400 customers. This would
provide a big service to the people in that area, because most of them
were paying about $80 to $90 per month for water and sewer only. Under
:he Buccaneer rate system, they would be paying approximately $45. mo.

Mr. Mullis commended Chief Thompson and the other members of the Police
Department of Atlantic Beach, and in particular the Narcotics Division,
for the professional manner in which they did the investigative work on
the Big L establishment.He assured Chief Thompson it impressed the Judge
in that particular case, for the professional manner in which they went
bout it, and reflected great credit on the City of Atlantic Beach. Mr,
ullis said he was proud to have them for witnesses.

Mr. Mullis recommended the institution of legal action against the
contractor, engineers, and others to recover for defects in the epoxy
contents and its application, or the design thereof, on the faulty work
in the sewer construction project on the six (6) wet wells which has
been pending for quite sometime. Mr. Mullis expressed the opinion we
probably would end up going to court to recover anything, but assured
the Commission he had found nothing to indicate it was the city's fault.
Byer Industries were the contractors, and Robert Bates & Associates were
the Engineers. Mr. Mullis suggested the Commission authorize Smith &
Gillespie to pin point the blame. Their report reflected an estimated
cost to correct the defects of approximately $50,000 to $60,000.
A lengthy discussion followed.
Motion: Authorize the City Attorney to institute legal action Cook x x
to recover for defects in the epoxy contents and its Edwards x x
application, or the design thereof, on the faulty work Gulliford x
