Action by the City Commission on recommendations from the Code Enforcement Board relative to naming Karen Moore as Secretary to the Code Enforcement Board, and assigning the duties of Code Enforcement Officer to Rene' Angers, Community Development Director 8. Discussion regarding the advisability of creating a new school zone crossing area on Seminole Road in the vicinity of its intersection with Selva Marina Drive 9. Action by the City Commission on proposed program of Special Assess- ment Improvements Mayor Howell presented in full, in writing, Resolution No. 88-11, a Resolution of the City of Atlantic Beach, Florida, to adjust and equalr ize special assessments for Section (H) and to confirm such special assessments as adjusted and equalized following a Public Hearing; esta")- lishing that the final assessment roll is on file with the City Clerk; authorizing use of the Ad Valorem Tax Collection method for collection of such special assessments following a Public Hearing; directing that bids be obtained for the improvements upon receipt of final plans and specifications; and providing an effective date. The Mayor asked for a motion to table the Resolution and explained to the audience if the Commission tabled the Resolution, the project would be on hold. In the event other alternatives could be found that were economically feasible to go ahead with the project, the Commission wound not have to start all over again. Motion: Table Resolution No. 88-11. MSYN 4. Commissioner Jensen's Report-continued Commissioner Jensen reported the Committee met at 1 :35 p.m. on Wednes- day,July 6, 1988 at City Hall. He requested the minutes of the meeting be corrected. The fourth paragraph should read A study of each of the individual bids showed that some confusion apparently existed in the minds of the bidders as to exactly what the City was requesting. Commissioner Jensen said the five bids received ranged from approximately $1,200 to $35,000. The Committee recommended that the City Commission reject all bids, redraw the specifications, be more precise, and re- advertise the project. Gulliford x x Jensen x During discussion before the vote, Commissioner Jensen asked if there Howell x would be a sign permitted, or would a sign be allowed. Mayor Howell said the Ordinance provided for a small announcement sign. Commissioner Cook stated the State required that if you had a licensed real estate office, you must have a sign. He asked if the sign would be visible from the street. Mr. Moller had stated in a letter to the Commission the sign would not be visible to the public. Ordinance No. 90-88-133 - Public Hearing AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY OF ATLANTIC BEACH, FLORIDA; AMENDING CHAPTER 24, THE COMPREHENSIVE ZONING ORDINANCE AND LAND DEVELOPMENT CODE BY AMENDING THE OFFICIAL ZONING MAP TO REZONE LAND OWNED BY BEVUE, LTD. , AND DESCRIBED ON EXHIBIT "A" ATTACHED HERETO FROM OPEN RURAL (OR) TO A PLANNED UNIT DEVELOPMENT (PUD) ; PROVIDING AN EFFECTIVE DATE. Mayor Howell presented in full, in writing Ordinance No. 90-88-133 on first reading. To comply with requirements of the Department of Commun_ty Affairs and other agencies, Mayor Howell opened the floor for a Public Hearing and invited comments from the audience. One lady asked if there would be more condominiums or apartments. The Mayor told her the project called for single family homes, zero lot line. Mayor Howell x Howell set the Public Hearing on the proposed budget for September 12, 1988 at 7: 15 p.m. • * * * * * * * * * * * * ;: * * * * * * * * * * * * * * * * 10. Miscellaneous Mayor Howell advised that Judge Mitchell was to announce this week that an order of taking for the 20th St. beach access would be issued in favor of Atlantic Beach. The court has under consideration a request from the property owners that the access not be opened until after August 15th, because of construction activities. MSYN Miscellaneous - continued Mayor Howell announced the City would be receiving from the State approximately $30,000 - $35,000 in financial assistance for the acqui- sition of the 20th Street access. The Mayor added that case was a mile- stone in Florida. It was the first case he knew of where eminent domain had been used specifically for the purpose of acquiring a beach access. * * * * * * * * * * * * * * * * * * A short discussion was held on the Preliminary Engineer's Report on Drainage Canal Improvements for the city submitted by Smith and Gillespie Engineers, Inc. Mr. Mullis suggested the subject be discussed at the meeting to be held on Thursday at 2:00 p.m. on the transfer station and solid waste.
