Action by the City Commission on a request of Deerfield Lakes, Phase II, for accepting for maintenance the utility improvements in said project. City Manager Fellows said that they had received all the documentation on this with the exception of the bill of sale which was received on October 26, 1987. Mr. Fellows stated that all the documentation appears to be in order. Commissioner Edwards asked where Deerfield Lakes was. Mr. Fellows replied that it was in the Buccaneer District. Ordinance No. 58-87-8 - Final Reading and Public Hearing AN ORDINANCE AMENDING CHAPTER 2, ARTICLE VI, DIVISION 3, SECTION 2-281 TO INCREASE THE PERCENTAGE OF AVERAGE FINAL COMPENSATION FOR ALL MEMBERS OF THE RETIREMENT SYSTEMS; ADDING SECTION 2-298, PROVIDING -OR MEMBER CONTRIBUTIONS; PROVIDING AN EFFECTIVE DATE. Mayor Howell presented in full, in writing, Ordinance No. 58-87-8 on second and final reading. He opened the floor for a Public Hearing and invited comments from the audience. As no one spoke for or against, the Mayor declared the Public Hearing closed. Motion: Passage of Ordinance No. 58-87-8 on second and final Edwards x x reading. Miscellaneous The City Manager stated that the city had aquired two vehicles and he wanted to discuss with the Commission the disposition of the vehicles. One was a 1979 MG. The Naval Intelligence Service made a narcotics buy in October, 1986 that resulted in the confiscation of the vehicle. The final judgement has been in the name of Atlantic Beach but the task force was not even in operation at the time of the confiscation, and for that reason the Chief of Police felt the Naval Investigative Services should be entitled to the car. He stated that due to the fact that the car was in the name of Atlantic Beach, it was up to the City Commission to act to transfer the vehicle to the NIS. Following discussion, the City Attorney advised he saw no problem with the transfer. Mr. Fellows also reported the Task Force activity had confiscated a 1975 Mercury Station Wagon that had a $281.00 outstanding lien and also needed repairs. After evaluating the situation, the city did not feel it would be worth the money and effort to utilize the vehicle, but Jacksonville Beach said they would satisfy the lien and use the car if the Commission would transfer the vehicle to them. The City Attorney asked the Police Chief if he was following the State Statute on disposing of surplus property, as he did not wish to set a preceden:. Howell x * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * The City Manager noted several executive sessions had been held relative to a new contract with the Fraternal Order of Police. He advised they had agreed to the final offer made by the City of Atlantic Beach: accept the same cost of living increase which was awarded to other city employees, there will be a Senior Patrol Officer position that would re- quire certain procedures for a person to apply for same, including a written examination, also at least five years of service, and duties above and beyond those of the normal staff officer. Motion: Approve the three (3) year contract with the Fraternal Edwards x x Order of Police, with a re-opener in Apri1,1988 for wages Gulliford x x and a negotiation of a new grievance procedure. Motion carried unanimously. * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * A lengthy discussion was held on the finish of the new Public Safety building. The Architect had proposed to put a sealer that would weather the building prematurely. Motion: Put a clear sealer on the building only if necessary. MSYN Miscellaneous - continued Mr. Gene Nordan requested approval to move a house he recently purchased in Mayport to his property on Beach Avenue. The recently purchased house was originally the Daniels residence, and held historic value. Mr. Nordan explained he had permission from the Navy to move the house through the Navy base and down Seminole Road to Beach Avenue with minimal in- terruption of the city facilities. Following discussion relative to the house meeting the Southern Standard Building Code, and the city's regulations. The Building Inspector, Mr. Ford, advised he had already discussed the matter with Mr. Nordan who understood everything in the house would be considered as new upon inspection. There were no object- ions from the Commission.
