Equipment, Jacksonville, Fl. ,the low bidder. The bid also met the
specifications.

The Commission discussed at length the possible reasons for the city
only receiving one bid on many items recently offered for bid.
5. Action by the City Commission to approve execution of an interlocal
agreement between the police departments of the three beaches communities
for mutual aid.
Mayor Howell presented, for approval, the annual interlocal agreement
the police departments of the three beach communities have entered into
for the past few years for mutual aid. Commissioner Cook asked if we
should include the new force at Ponte Vedra in the agreement. Mayor
Howell replied they were in a different county. The City Attorney said
you could perform your services outside your corporate limits and into
another county provided you were in hot pursuit of someone. As it was
jurisdictional, he would have to research the subject. Commissioner
Morris requested a Committee be selected and volunteered to serve. Com-
missioner Morris also commended Mayor Howell for his letter sent to
Mr. Basford, and said he would like to see a breakdown on how many calls
our police department are making to Neptune Beach and Jacksonville every
year and the cost incurred. It was pointed out that only emergency calls
to the north were directly answered until Jacksonville could arrive.
Otherwise, the calls are referred to either Jacksonville or Neptune Beach.
11 other calls were for assistance. Commissioner Morris said in response
.o Mr. Basford's news report, we needed to point out to him that what we
were doing was a good neighbor policy to the north free of charge out of
love and not out of gratuity. Mayor Howell noted that Commissioner Morris
was correct, we had always cooperated and certainly we were not going to
stop, there was no question about that, but the main thrust of the agree-
ment was to determine responsibility. Following discussion, Commissioner
Morris moved for the following:

6. Discussion of the Jacksonville Electric Authority franchise and
manner of paying franchise fees.
Mayor Howell stated he had discussed the franchise with JEA with the
City Attorney and they determined the Commission should take a look
at the current situation. The current franchise agreement provided for
biannual payments of the fees, but JEA had been collecting a 6% monthly
fee from each customer in Atlantic Beach since 1983 when the State Public
Service Commission ruled that such fees paid to a municipality must be
,ollected only from the residents in the municipality charging the fee,
tnd that the fee could not be included in the rate structure. Mayor
Howell said "the JEA are sitting up there holding it for six months and
drawing interest on it. Even if invested at only 7% interest, we're look-
ing at somewhere close to $1,000 a month that we're losing."

6. JEA Franchise fees - continued
The City Attorney said the JEA should agree either to send the franchise
fee to the city each month, or remit to the city interest on those fees.
He suggested the city sue the JEA, if necessary, to force the utility to
pay the franchise fees monthly. Commissioner Gulliford said "I don't want
to pussyfoot around with them. I'd" just as soon be off the JEA system."
Commission agreed. Commissioner Morris suggested the electric fee monies
be collected at city hall and we would send JEA their share every six
months.
Motion: The Mayor appoint himself, the City Attorney, and any other Cook x x
person the Mayor might need as a Committee to negotiate a Edwards x
solution to the problem. Gulliford x

During discussion, the City Attorney recommended the City of Atlantic Howell x
Beach give the JEA notice of terminating the franchise 90 days hence
unless they knew an agreeable franchise could be negotiated.
Mayor Howell reminded the Commission the City of Atlantic Beach collects
Utility taxes for the City of Jacksonville with no administrative fees
and remits the utility taxes to them monthly. The question was called
and the motion carried unanimously. The Committee will present a report
,ack at the next meeting.
7. Committee reports:
A. Commissioner Edwards with a report and recommendation of the committee
appointed to evaluate the bids received for construction of the beach
dune overwalk project
Commissioner Edwards reported the committee met at 10:30 a.m. Wednesday,
February 26, 1986. Discussion ensued relative to the capability of the
two apparent low bidders, Scott Barnett and Bennett Construction Co. with
the consensus seeming to be that Scott Barnett, the apparent low bidder,
was qualified to undertake the project. During discussion relative to a
required bond, it was decided to allow the contractor the option of post-
ing a 100% payment bond, in which draws could be made on the project as
portions were completed, or no bond would be required and no payments
would be made until the project had been fully completed and certified
as acceptable by consulting architect, George Bull, Jr. Commissioner
Edwards reported the Committee recommended the contract for the con-
struction of the beach dune overwalks be awarded to Scott Barnett in
the amount of $16,212.00.

B. Commissioner Edwards to report for the committee apointed to evaluate
the bids received on a new 400,000 GPD waste water treatment plant in
the Buccaneer Water and Sewer District
Commissioner Edwards reported the committee met on Wednesday evening,
March 5, 1986 and after considering all factors such as the apparent
low bidder, the committee recommended unanimously the contract be
awarded to Jax Utilities Management of Jacksonville, in the amount of
$302,166.52.
Motion: Award the contract to Jax Utilities Management of Jackson- Cook x

AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY OF ATLANTIC BEACH,
FLORIDA; AMENDING CHAPTER 13 TO ADD SECTIONS 13.6 AND 13.7, SAID SECTION
MAKING IT UNLAWFUL FOR THE DISTRIBUTION AND SALE OF OBSCENE MATERIAL
WITHIN THE MUNICIPAL LIMITS OF THE CITY OF ATLANTIC BEACH, AND NUDITY BY
EITHER MALE OR FEMALE IN ANY MANNER WITHIN THE MUNICIPAL LIMITS OF THE
CITY OF ATLANTIC BEACH; PROVIDING AN EFFECTIVE DATE.
Said Ordinance was presented in full, in writing by Mayor Howell on
first reading.

During discussion before the vote, Commissioner Cook objected to the
wording of an Ordinance that would prohibit nudity only in businesses
that sold alcoholic beverages. The City Attorney commented the Supreme

Court of Florida have ruled that you can regulate obscenity, in a recent
case involving the City of Daytona Beach, as it relates to the sale and
serving of alcoholic beverages. You have a much broader regulatory power
over a place serving alcoholic beverages than an art museum or bathing
beach, etc.

AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY OF ATLANTIC BEACH,
FLORIDA; AMENDING CHAPTER 22, ARTICLE III, DIVISION 7, TO REWRITE IN
ITS ENTIRETY SECTION 22-166, PROVIDING QUARTERLY SEWER BASE CHARGES AND
EPA/DER MANDATED REVENUE GENERATION CHARGES; PROVIDING AN EFFECTIVE DATE.

Commissioner Gulliford asked what the impact would be on Buccaneer. Morris x
Mr. Fellows replied Buccaneer was excepted in regards to the fee Howell x
for the revenue generation system. As far as the regular change in
the Ordinance, there would be a slight increase in Atlantic Beach and
Buccaneer would be 11/2 times greater. Mayor Howell explained the gener-
ation fee applied only to our sewer plant and it certainly would not be
fair to charge people outside the city. Also, the fee would be listed
specifically on the bill as a separate item. Mayor Howell noted he
wanted it clearly understood the revenue generation fee was a mandated
charge and when the sufficient funds were on deposit to meet those re-
quirements, the Ordinance could be cancelled out. The question was called
and the motion carried unanimously. Mayor Howell set the Public Hearing
for March 24, 1986.

9. Action on Ordinances - continued - C. Public Hearing
Mayor Howell presented in full, in writing Ordinance No. 90-86-101
on second and final reading. Said Ordinance was posted in line with
Charter requirements. The Mayor opened the floor for a Public Hearing
and invited comments from the audience. Mr. James Byrd, 297 Magnolia
St. opposed passage of the Ordinance. He advised the Commission he
had attended the Advisory Planning Board's meeting and offered a
petition signed by 30 residents who opposed the construction of any
more duplexes in that area. He was told the Commission had received
copies of the petition. Commissioner Morris asked if the copies were
in the agenda packet. He was told all information pertaining to the
Ordinance was in the agenda packet of the last meeting, but not this
one. Commissioner Morris asked, in the future, for all information on
continuing items to be included in his agenda packet for each meeting.
As no one else spoke for or against, the Mayor declared the Public
Hearing closed.

10.Action on Exceptions
A. Public Hearing on a request for an exception filed by the First
Baptist Church of Atlantic Beach for a child care center
Mayor Howell advised the proposed child care center request filed
by the First Baptist Church, 1050 Mayport Road, was located on Blks.
42 and 43 Section H. He opened the floor for a Public Hearing and
invited comments from the audience. As no one spoke for or against,
the Mayor declared the Public Hearing closed.
Motion: Grant the "Use by Exception" for a child care center to Cook x

Miscellaneous
Commissioner Gulliford asked if the Committee would ask JEA at their
fleeting to be held, the process with respect to JEA providing lines
in a new subdivision. He wondered if the developer was paying for
the installation of those new lines. Mr. Fellows said the developer

paid for water and sewer lines. The developer also pays the JEA
an installation fee for the poles, lines and lights and the property
continues to belong to the JEA. Commissioner Gulliford said if the fee
was basically covering the cost of construction, the developer could go
to an outside electrical contractor and have him install the service
and then dedicate that service, provided it met certain standards, to
the JEA. He pointed out there was a lot being given to the JEA in the
confines of Atlantic Beach as each new development was built, and why
should that be given to the JEA if the costs were being assumed by the
developer. Why not instead, see if there was some method by which we
could have the developer dedicate the lines to the City of Atlantic
Beach and we in turn would lease the usage for some minimum fee annual-
ly to the JEA. The City Attorney replied that was fairly common in water
and sewer, but it was not in electric, unless the JEA had changed their
policy. Mr. Mullis will look into the matter and report back.
There being no other business to come before the Commission, the Mayor
declared the meeting adjourned at 8:22 p.m.
