Howell x * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * 3. Recognition of visitors - None 4. Bob Hill of Bessent Hammack and Ruckman to present the Master Plan for Section H. Mr. Bob Hill offered a presentation on the master plan to provide city services in Section H subdivision. They looked first of all at roadway, right-of-way, and then at utilities. In right-of-way portion, he said at some point, the city should consider some modification to the right- of-way, because we had the canal and the city will be maintaining that. Mr. Hill said the plan could be implemented in three stages, 1.) east of Main St. , 2.) north of Levy Rd. , and 3.) west of Main St. He present- ed drawings of the roads and utility lines the engineers considered would be the backbone of the system, and all they thought the city should be responsible for ultimately. Everything else would be put in as the area developed. Preliminary Cost Estimate for Phase I, Part I for 2nd and Main Streets and Levy Road was $638,038. including 20% contingency & Engineering costs. For options, he recommended doing the utility work first and waiting on the roadway. Mr. Hill added the cost estimate included not putting the curb and gutter in as it was $47,000. The City could set the grades for future curb and gutters and go back later. Commissioner Morris asked if they had considered serving the area Trom the Buccaneer system. Mr.Braid said that was not feasible. Grand total estimate for Areas I,II, and III was $3,389, 160. A lengthy dis- cussion followed on how to finance the project. Mayor Howell suggested they take a section at a time, determine the cost for each lot, and assess the land owners for their portion. PAGE THREE V V MINUTES NAME OF JULY 14, 1986 COMMRS. MSYN 4. Master Plan for Section H continued Mr. Fellows asked Mr. Hill how long would it take, after the Commission had an opportunity of evaluating a method of financing, to develop plans and specifications for the public improvements in Area I. Mr. Hill said he could probably have some plans and specifications in approximately ninety days. Cost estimates will be furnished for all Area I as soon as possible. Mayor Howell reminded them they had left out West 12th, 13th, and 14th on their drawings. They will check on those. 5. Action by the City Commission on approving Change Order No. 4 on Project No. 2, increasing the contract price by $4,433.00. Following discussion on the necessity of the change order, Commissioner Gulliford moved for the following: Motion: Authorize change order #4 and direct City Attorney Mullis, Cook x x City Manager Fellows, and Public Service Director Braid to Edwards x review the change orders and come back at the next meeting Gulliford x x with what they felt should have been our responsibility Morris x and what should not have been our responsibility and attach Howell x a figure thereto. Committee report by Commissioner Robert Cook on evaluation and recommendation of bids received for resurfacing of a number of city streets Commissioner Cook reported the Committee met and unanimously recommended the bid of the Lillard Group of Jacksonville be accepted as the lowest and best bid in the amount of $90,160.00. Copy of report with street listings attached hereto and made a part hereof. Motion: Award a contract for resurfacing a number of city streets Cook x x to Lillard Group of Jacksonville, the lowest and best bid Edwards x in the amount of $90,160.00, contingent upon receiving Gulliford x x funds from the Florida League of Cities bond program, Morris x otherwise the contract will be null and void. Ordinance No. 95-86-30 - First Reading AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY OF ATLANTIC BEACH, FLORIDA; AMENDING CHAPTER 4, ARTICLE II, TO REWRITE SECTION 24-22 IN ITS ENTIRETY; AMENDING SECTION 4-23 AND SECTION 4-24 TO PROVIDE ANIMALS PLACED IN SHELTERS MUST BE HELD FOR A MINIMUM OF THREE DAYS WITH EXCEPT- IONS FOR RELEASE SOONER; AMENDING SECTION 4-26 TO CREATE SUBPARAGRAPH (c) PROVIDING THE OWNER OF ANY DOG OR CAT FOUND DEFECATING UPON ANY PUBLIC PROPERTY WITHIN THE CITY LIMITS OF THE CITY OF ATLANTIC BEACH SHALL BE FINED IN ACCORDANCE WITH THE TERMS OF THIS ARTICLE UNLESS SAID DEFECATION IS IMMEDIATELY CLEANED UP BY SAID OWNER; CREATING SECTION 4-30 TO PROVIDE CITATIONS AND PENALTIES; PROVIDING AN EFFECTIVE DATE. Mr. Fellows advised the Ordinance Morris x hould be amended to say the owner will have a minimum of three days Howell x -nd not more than seven days to retrieve the animal. Discussion was held on whether City of Atlantic Beach tags should be sold to people from other cities who take their dogs to walk on Atlantic Beach's shore, and temporary tags sold to dogs owned by tourists or relatives visiting people in Atlantic Beach for only short periods of time. Ordinance No.90-86-103-Second and Final Reading - Public Hearing AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY OF ATLANTIC BEACH, FLORIDA; AMENDING CHAPTER 24, ARTICLE III, DIVISION 5, TO ESTABLISH A SINGLE USE DISTRICT; PROVIDING AN EFFECTIVE DATE. Mayor Howell presented in full, in writing Ordinance No. 90-86-103 on second and final reading. Said Ordinance was posted in line with Charter requirements. He opened the floor for a Public Hearing and invited comments from the audience. Mr. Harry Mahon, attorney representing Mr. David Baker, opposed the Ordinance. Mr. Baker recently constructed and sold 20 houses in the subject area for approximately $45,900 each, and Mr. Mahon had forwarded to the city a letter setting forth that Mr.Baker was opposed to the proposed Ordinance. He submitted the proposed Ordinance was deficient in several respects: No notice was given to adjacent property lwners (Sec. 24-62 (2e) , also FS 166.041 and possibly FS 166.041 3C1; ;ode Sec.24-102(2c) in that no minimum lot requirement was provided; and Code Sec.24. 102 and Sec.24. 113. Mr. George Prom, 2451 Anniston Road,Jax. ; Mrs. Jean Porcelli, 1723 Park Terrace E. ; Mr. Louis MacDonell, 1535 Selva Marina Dr. and Mr.Marcus Prom,1398 Main St. also objected to the Ordinance. MS Y N Action on Ordinances - continued Mr. Alan Jensen, 447 Atlantic Blvd. ,representing Mr. Raymond Dagley, advised they had no objection to the notification of land owner re- quirements. He stated he did not feel the proposed Ordinance was re-zoning as the zoning was not being changed by the Ordinance, it was only clarifying the existing uses of the property and use of the property prior to any zoning at all on that property . He said the Ordinance drawn set forth the requirements, and also set forth minimum lot requirements. It was not a change in permitted use because the use had been, as the Code Enforcement Board found, grandfathered in, because it was used as such prior to any zoning there. The 1st zoning on the property was 1959 and Mr. Dagley began his operation on the property in 1956. He said they had no objections to further notice, but he did not want to see the Commission impose additional restrictions that were not currently in any Code of the City of Atlantic Beach, such as requiring fencing, buffer zones, etc. He did not feel anyone that had purchased property since 1970 was not aware of Mr. Dagley's operation. Mr. Jensen was asked if Mr.Dagley had secured an occupational license from the City of Atlantic Beach prior to the zoning of the property. Mr. Jensen said no. The minutes of the Code Enforcement Board reflect Mr. Dagley testi- fied he applied to Mrs. Grage for an occupational license for several rears and was told he did not need one. As no one else spoke for or Lgainst the Ordinance, the Mayor declared the Public Hearing closed. Motion: Defer action on the Ordinance and affect thirty (30) days Gulliford x written notice to the adjacent property owners within 300 Cook x feet, and re-advertise thirty (30) days notice for another Public Hearing. Mr. Mahon was asked if that satisfied his legal objections and Mr.Mahon replied in the affirmative, but he added one other concern in his opinion was the Ordinance did not provide minimum lot requirements. He asked if the Ordinance could provide "amends Sec. 24-101 through (2)e. and amend Sec.24-102 to provide an additional special use district". Mayor Howell said he would personally take a look at those objections. That could be an amendment to the Ordinance at the final reading. The question was called and the motion carried unanimously. Miscellaneous Mr. Fellows stated he had mentioned in the status report if the City applied for a Recreation Grant next year, they would need to have an Advisory Recreation Committee. He had submitted a list of individuals he had talked to who had indicated an interest in serving on the Commit- tee.He requested Commission approval of the list submitted. Commissioner qulliford requested an ad be placed in the Beaches Leader and/or Sun 'imes in order to let everyone in Atlantic Beach be aware of the fact that anyone could volunteer to serve on the Committee. MSYN Miscellaneous Commissioner Edwards said he was pleased the Police Department was making progress in the Royal Palms area with junk or abandoned cars, and people are cleaning up and mowing lawns. Commissioner Cook commented he was greeted by the city's new Animal Control Officer as he was walking his dog. He commended her for her very friendly manner. Mayor Howell announced the next meeting of the Northeast Florida League of Cities would be held July 24, 1986 at 6:30 p.m. in St. Augustine.
