2009 03-10(meeting minutes)CITY OF ATLANTIC BEACH CODE ENFORCEMENT BOARD MINUTES 7:00 P.M., March 10, 2009 Call to Order: PRESENT: Chairman Carl Russell Vice-Chairman Ron Pendleton Juliette Hagist Ray Martin Richard Ouellette Barbara Weiss UNEXCUSED: Veda Bernstein AND: Alex Sherrer, Code Enforcement Officer Susan Gorman, Secretary Suzanne Greene, Prosecuting Attorney Chairman Carl Russell called the meeting to order at 7:07 p.m., followed by the Pledge of Allegiance to the Flag by all present. Secretary Susan Gorman read the roll and determined that there was a quorum. 1. Following a brief review, the Board voted unanimously to approve the minutes of the Code Enforcement Board meeting of November 17, 2008. Chairman Russell asked all Respondents and witnesses to step forward to be sworn in. 2. Old Business: Prosecuting Attorney Suzanne Greene advised the Board of their obligation to hear and consider action on cases with waivers that were denied by the Commission and referred back to the Code Enforcement Board for review Case #372-08: Brian Christy, 1651 Mayport Rd; Code Enforcement Officer Alex Sherrer gave a presentation to the Board based on current photographs. He reported progress at this location, but recommended the Board give Mr. Christy more time for recent landscaping to flourish and provide plant cover. Discussion ensued and Board Member Weiss asked the Respondent questions regarding his efforts to maintain the vegetation growing along the fence at his business property. Barbara Weiss advised Mr. Christy that he is responsible for maintaining the vegetation and it must provide adequate coverage in order for Mr. Christy to be in compliance. Page 2. March 10, 2009 Chairman Russell asked the Board for a motion. Board Member Richard Ouellette motioned to give Mr. Christy additional time to come in full compliance and the Board will determine if Mr. Christy has met compliance by July 14, 2009, when the Board will hold a regular meeting. If compliance is not met by the aforementioned date, the Board can impose a fine of $50.00 per day plus administrative fees. Hagist seconded Votes: Aye: Hagist,Ouellette,Pendleton,Russell,Weiss Ney: Martin Motion carried. b. Case #365-08, Respondent in compliance c. Case #366-08, Respondent did not appear before the Board. Officer Sherrer recommended the fence at this property be replaced and the Respondent given thirty days to come in compliance. Ray Martin motioned to find the Respondent guilty and the existing fence must be removed by April 10, 2009 or face a fine of $50.00 per day plus administrative fees. Juliette Hagist seconded and the motion carried unanimously. d. Case #414-08, Respondent did not appear before the Board. Officer Sherrer recommended the Board defer until the next regular meeting scheduled for May 12, 2009. Ray Martin motioned to give the Respondent until the next Code Enforcement Board meeting to come in compliance or face a fine of $50.00 per day plus administrative fees. Ron Pendleton seconded and the motion carried unanimously. New Business: Officer Sherrer advised the Board to expect more cases related to the Mayport corridor and that Board Member Mamie Hurd is unable to serve out her term due to her recent relocation where she now resides in Jacksonville. 3.
