Item 3AAGENDA ITEM # 3A JiJNE 22, 2009 June 15, 2009 MEMORANDUM TO: The Honorable Mayor and Members of the City Commission FROM: Jim Hans City Manager SUBJECT: Follow-up eport 4uestion about minutes from Commission Meeting on Mav 26, 2009; A correction to the minutes was proposed concerning a comment made by the Public Works Director Rick Carper. Commissioner Woods asked that Mr. Career's statement that the curbing installed on 18~' Street was a public safety issue be added to the minutes of the May 26~' meeting. Mr. Carper was not at the meeting on June 8"' when the minutes were considered and was therefore not able to confirm what he had said. The City Clerk then typed a verbatim transcript from the audio recording of the May 26~' meeting a copy of which is attached. Some of Mr. Career's comments were not clear on the tape so he was asked if he had stated that the curb posed a safety hazard. His response has been added at the bottom of the transcript. Drainage Ditch; A complaint was passed along at the last Commission meeting about a tree that had fallen in the drainage ditch outside of Atlantic Beach leading to the Intracoastal and a question about who is responsible for maintaining the ditch. The City of Atlantic Beach has a contract with the FDOT for maintenance of the ditch going all the way to the Intracoastal Waterway, including portions that are outside of our city limits. The downed tree will be removed to prevent a drainage problem in the future. AGENDA ITEM # 3A JUNE 22, 2009 Notes from the Commission Meeting of May 26, 2009 (after listening to audio on June 9, 2009) CW: "Does this curb present a safety hazard?" RC: "I would say it is not a safety hazard, because the 38 ft from this curb this curb to the edge of the pavement on the north side is a parking area opposite the 20 ft from the parking area ....you almost have .......you still have 14 ft of travel way." CW : "Somewhere in here I believe it says it is in a safety zone:' RC: "That is the words from our city code, yes. " Within 2 feet from the edge of the pavement is called a safety zone. CW: "If it is within a safety zone, why is it not a safety hazard?" " I am a little confused." " I mean, what's the definition of the safety zone? " RC: "The safety zone by definition is within two feet of the edge of any road in the city." RC: "In this specific case, it is probably not a safety hazard, but it is within the safety zone by definition." MB spoke about the grandfathering. Also about impervious surface in the driveway. PP: Asked about honoring waivers. CW: I'm sorry, I didn't really get to finish my question I have about the safety issue." CW: "You said there is 14ft between the parking space and the curb? RC: "Yes." CW: "And it's a two way street? " RC: "It is:' CW: "And two cars can pass in 14ft?" RC: "No:' CW: "Sounds to me like it's a safety issue." RC : .........................(Said afew things that were not clear on the tape and then) "Yes, I won't argue with that, you cannot get two cars pass with cars parked in the lot." Note: I spoke to Rick today. He does not recall his exact words to place in the blank space aboveā€¢ however, he did aeree there is a safety issue with two cars not being able to pass while cars were parked in the lot.
