Adjourn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, FEBRUARY 12, 1973, AT 8:00 P. M. PRESENT: William S. Howell, Mayor R. R. Rosborough, II L. W. Minton, Jr. F. W. Fogg, Commissioners AND R. C. Vogel, City Manager Oliver C. Ball, City Attorney Adele S. Grage, City Clerk ABSENT: D. W. Speed, Commissioner The meeting was called to order by Mayor-Commissioner, Mr. Howell. The invocation was given by Commissioner Minton, followed by the pledge to the flag. The minutes of the meeting of January 22, 1973, were approved as written upon motion of Commissioner Minton, seconded by Commissioner Fogg and carried. Mayor Howell recognized visitors and called for any business from the floor not on the agenda. At this time, Mr. John Hanna appeared before the Commission with plans for building in the Donner Subdivision. He stated he has twelve lots containing 84,000 square feet located on Church Road and George Street. The property extends West on Church Road 400 feet from George Street and South on George Street 210 feet from Church Road. After a lengthly discussion, Mayor Howell advised Mr. Hanna that he must submit his plans to the Advisory Planning Board and the Commission would act upon their recommendations. The following committee reports were given: Report cn Calling for Bids on Police Cars - Chairman Minton Commissioner Minton recommended and moved that Thor Chevrolet, Inc. be awarded the bid on two police cars and one Chevelle station wagon in the amount of $8, 591 .65. It was seconded by Commissioner Rosborough and carried. Report on Calling for Bids on Garbage Trucks - Chairman Rosborough Commissioner Rosborough recommended and moved that the bid for a garbage truck be awarded to Thor Chevrolet, Inc. in the amount of $16, 900.00 for one garbage truck. It was seconded by Commissioner Fogg and carried. MINUTES FEBRUARY 12, 1973 PAGE TWO Mr. George Bull appeared before the City Commission requesting application for the Planned Unit Development Zoning on the acreage west of the lagoon and north of Plaza. He stated he wish to give 4.78 acres, located next to the Sewer Plant, to the City of Atlantic Beach in exchange for 1.33 acres now owned by the City of Atlantic Beach for the purpose of changing the City Garage site and he would like for the City to abandon Eleventh Street West of the lagoon. After lengthly discussion, it was moved by Commissioner Fogg, seconded by Commissioner Minton and carried that Mr. Bull' s plans and application be accepted and referred to the Advisory Planning Board for their recommendations to the Commission. Mr. Patterson appeared before the City Commission for the purpose of replacing two easements in Block 16 and 26 Royal Palms Subdivi- sion. The present easement is now located under his proposed apartment complex. Mr. Oliver Ball, City Attorney, stated that we need a letter from Mr. Patterson that will give the alternate ease- ment. It was moved by Commissioner Minton, seconded by Commissioner Rosborough that Mr. Patterson sign the necessary papers releasing the proposed easement based on the condition that we get the necessary papers in writing. After discussion, the motion was amended by Commissioner Rosborough, seconded by Commissioner Fogg and carried that the easement be released as soon as the City cf Atlantic Beach can determine the cost to the City and this amount be deposited with the City or until proper drainage is accomplished as per City specifications and necessary papers are drawn and then the release will be duly executed and signed by the Mayor and City Clerk. Mr. Vogel stated he had received a request from Mr. Robert Jacobs, North Atlantic Beach, for garbage service and also tc respond to the alarm system which he has connected to our Police Headquarters. Mayor Howell stated that this is outside the City Limits of Atlantic Beach and we would be infringing on the City of Jacksonville and the franchise that covers this area and the police do not respond outside the City Limits except when requested to assist. Mayor Howell also stated that we have been giving emergency garbage ser- vice to Mrs. Jordan, 2031 Cecil Road, just outside the City of Atlantic Beach, and instructed the City Manager to notify Mrs. Jordan that the City can no longer continue to do this. Commission- er Minton moved, seconded by Commissioner Rosborough and carried that the City of Atlantic Beach no longer pick up garbage outside the City Limits of Atlantic Beach. Mayor Howell presented and read Resolution No. 73-6 levying and imposing special assessment for the removal, suppression or - MINUTES FEBRUARY 12, 1973 PAGE THREE abatement of dangerous, unsafe, dilapidated, or unsanitary struc- tures, pursuant to the provisions of Ordinance No. 25-67-6 of the City of Atlantic Beach from that certain property described as Lot 279, Saltair Subdivision, known as 341 Seminole Road, Atlantic Beach. Commissioner Fogg moved for passage of said Resolution, seconded by Commissioner Rosborough and carried. Copy of Resolut- ion No. 73-6 is attached hereto and made a part hereof. Mayor Howell presented and read Resolution Noo 73-7 levying and imposing special assessment for the removal, suppression cr abate- ment of dangerous, unsafe, dilapidated, or unsanitary structures, pursuant to the provisions of Ordinance Noo 25-67-6 of the City cf Atlantic Beach from that certain property described as Lct 278 Saltair Subdivision, known as 345 Seminole Road, Atlantic Beach. Commissioner Fogg moved for passage of said Resolution, seconded by Commissioner Rosborough and carried. Copy of Resolution 73-7 is attached hereto and made a part hereof. Mayor Howell presented and read Resolution Nce 73-8 levying and imposing special assessment for the removal, suppression or abate- ment of dangerous, unsafe, dilapidated, or unsanitary structures, pursuant tc the provisions cf Ordinance No. 25-67-6 of the City of Atlantic Beach from that certain property described as Lot 277, Saltair Subdivision, known as 351 Seminole Road, Atlantic Beach. Commissioner Fogg moved for passage cf said Resolution, seconded by Commissioner Rosborough and carried. Copy of Resolution No. 73-8 is attached hereto and made a part hereof. Mayor Howell instructed the City Manager to start the legal pro- ceedings on Lots 276, 261, 268, 269 Saltair Subdivision. These lots have water standing on them creating an unsanitary condition. Mr. Vogel and Mr. Hilliard recommended to the City Commission that we call for bids on a new Comminutor. After discussion, it was moved by Commissioner Minton, seconded by Commissioner Rosborough and carried that the Commission call for bids on a Comminutor for the Sewer Plant. Mrs. F. W. Mehrtens, 758 Vecuna Road, Atlantic Beach asked to speak before the City Commission about the lack of adequate sidewalks for the school children down Seaspray Avenue between Sailfish and Seminole Road. After lengthly discussion about paving of sidewalks and streets, Chief Stucki reported that he and Mr. Hilliard had been working on this particular problem and will give a full report and recommendations to the Commission at the next meeting. w MINUTES FEBRUARY 12, 1973 PAGE FOUR Mr. Vogel introduced the new secretary, Mrs. Mary Fletcher, to the City Commission. At this time, Commissioner Minton asked if he might have the floor. He called the City Commission' s attention to the minutes c•f August 28, 1972 as regards Coach Suttcn' s request for assistance in building tennis courts at Fletcher Junior High School. He quoted as follows: "wherein Commissioner Minton moved that if we can straighten out the Revenue Sharing and if monies are approved for the Pop Warner League, then we will consider the approval tc Fletcher Junior High School as requested. " After discussion, Commissioner Minton moved that the City of Atlantic Beach allocate $1000,00 from Account 9-101.2 to Fletcher Junior High School for the purpose of finishing their new tennis courts. This amount tc be turned over to them when they are within $1000.00 of having the necessary funds for completion of the tennis courts. The vote was: Aye - Commissioners Minton, Rosborcugh and Mayor Howell Nay - Commissioner Fogg The motion carried. There being no further business Mayor Hewell declared the meeting adjourned. Grage, City Clerk RESOLUTION NO. 73-6 A RESOLUTION LEVYING AND IMPOSING SPECIAL ASSESS- MENT FOR THE REMOVAL, SUPPRESSION OR ABATEMENT OF DANGEROUS, UNSAFE, DILAPIDATED, OR UNSANITARY STRUCTURES, PURSUANT TO THE PROVISIONS OF ORDINANCE NO. 25-67-6 OF THE CITY OF ATLANTIC BEACH, FLORIDA, AGAINST THAT CERTAIN PROPERTY SUPPRESSED AND ABATED, AND PROVIDING FOR THE OTHER MATTERS IN RELATION THERETO. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, FLORIDA: SECTION 1. It is hereby ascertained, determined and declared that, the removal from that certain property described as: Lot 279 Saltair Block Known as 341 Seminole Rcad, Atlantic Beach, Florida of dangerous, unsafe, dilapidated, or unsanitary structure, pursuant to the provisions of Ordinance No. 25-67-6, which was heretofore allowed to exist upon said above described property was heretofore completed on the 2nd day of February 1973 that the total cost of performing said work is here- by ascertained, determined and declared to be the sum of $ 300.00 ; that the above described property has been specially benefited by said work to an extent greatly in excess of the aforesaid sum of $ 300.00 ; and that, accordingly, the sum of $ 300.00 is hereby levied, assessed and im- posed against and upon the above described property, and that unless said special assessment is paid within thirty (30) days after publication of this resolution, the same shall bear interest thereafter at the rate of 8% per annum; and the City of Atlantic Beach shall have, assert and possess a lien, superior to all other claims, except taxes, against and upon the above described pro- perty for the respective amount of such special assessment as in- dicated above, together with interest and all costs of collection until fully paid. SECTION 2. That the City Tax Collector be and is hereby commanded to collect out of the property and from each owner thereof the special assessment set down opposite each name, lot, tract, or parcel of land herein described. Any person desiring to contest in any way the validity of any special assessment or lien hereinabove levied and imposed shall, within thirty (30) days after the adopting thereof en- joined, or its validity legally declared, and any and all persons not instituting such suit shall not thereafter be heard 'to question the validity thereof, or to defend against the enforcement of the lien upon the grounds of its invalidity. SECTION 4. This resolution shall take effect immediately upon it ' s passage.
