Adjourn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, JULY 23, 1973, AT 8:00 P . M. PRESENT: William S. Howell, Mayor--Commissioner R. R. Rosborough, II L. W. Minton, Jr. F. W. Fogg D. W. Speed, Commissioners AND R. C. Vogel, City Manager Oliver C. Ball, City Attorney Gloria June Knight, City Clerk The meeting was called to order by Mayor-Commissioner, Mr. Howell. The invocation was given by Commissioner Minton, followed by the pledge to the flac. The minutes of the meeting of July 9, 1973, were approved as written upon a motion by Commissioner Minton, seconded by Commissioner Ros- borough and carried, Mayor Howell recognized visitors and called for any business from the floor not on the agenda. There was none. The next order of business was a letter from Mr. John C. Lowe re- questing the West 200 feet of Kestner Road, Atlantic Beach, be closed. Mr. Lowe owns the property on both sides and it dead ends into his property. Mayor Howell suggested that the City Commission authorize the City Attorney to prepare an ordinance to be presented at the next regular meeting of the City Commission on first reading to close the road. Mayor Howell also suggested that Mr. Lowe get in touch with a title insurance company and see whether the only action that would be needed should be taken by the City of Atlantic Beach or if this action should be handled by Duval County. Mayor Howell stated that no action could be taken on this request tonight. Mr. Joel Kaufman appeared before the City Commission with a request for building permits on three single family houses on Lots 1, 2, 3, Block 1, Atlantic Beach Parkway. He stated he had already received one permit for the corner lot, located at 10th Street and Ocean Boulevard. Mr. Kaufman stated that when the plans were drawn up, for the sake of economy, he submitted only one exterior on all four sets of plans. However, he intends to vary the exterior of the homes . He presented drawings of the exterior of the homes. After lengthly discussion, Commissioner Rosborough moved, seconded by Commissioner Speed that plans submitted with the elevation changes be approved. The vote was: Aye - Commissioners Minton, Rosborough, Speed and Mayor Howell. Nay - Commissioner Fogg ; The motion carried. MINUTES JULY 23, 1973 PAGE TWO The City Commission received an application from Mr. R. W. Maxwell for Planned Unit Development for a motel at Ardella Road and May- port Road, Atlantic Beach, Florida. Mr. Vogel stated that the Advisory Planning Board passed this back totheCity Commission re- commending that this not be approved based on the fact that it could be, without alterations converted into apartment houses. The plans call for a kitchen, dining area, living area and bedroom, which constitutes an apartment. Mr. Vogel stated that this does not come under "PUD" because the area is already zoned "Business B" which allows motels, but before the City Commission can look at the plans they will have to be approved by the Hotel and Restaurant Commission. Mr . Carl Burr, representing, Mr. R. W. Maxwell, stated that plans have not been prepared and this was simply a sketch to see what would be allowed. Mayor Howell stated that if it is a motel, the property is already zoned for it and does not require any action from the City Commission other than the plans will have to be approved, built according to the Southern Standard Building Code and meets all set-back requirements, etc. No action can be taken by the City Commission until the City of Atlantic Beach gets the final approval from the Hotel and Restaurant Commission. Mayor Howell declared the meeting open for a Public Hearing on an ordinance, second reading, voter registration. At this time, Mayor Howell stated that the law pertaining to one registration in the County does not take effect until January 1, 1974, and suggested that the Public Hearing be postponed until the next meeting. It was moved by Commissioner Speed, seconded by Commissioner Fogg and carried the the ordinance pertaining to voter registration, second and final reading, be postponed until the next regular City Com- mission meeting and the Public Hearing be held August 13, 1973. Mr. Hilliard, Director of Public Works, requested City Commission approval for additional money to clean the lagoon because of the slime that is forming. It was moved by Commissioner Minton, seconded by Commissioner Speed and carried that the Public Works Department be allocated money, not to exceed $1,000.00, for the purpose of cleaning the lagoon. Mr. Vogel stated that he had received a request from the Royal Palms Theater to build another theater adjoining the present one. After discussion, it was moved by Commissioner Speed, seconded by Commissioner Minton and carried that a permit be issued to the Royal Palms Theater, Atlantic Beach, Florida, for their addition providing that the fence be modified so that access can be maintained on the easement and that drainage pipe be installed and the ditch covered to the West property line of the proposed addition. MINUTES JULY 23, 1973 PAGE THREE Commissioner Speed reported that he had received numerous complaints from citizens living near Le Chateau Restaurant, 7th Street and Beach Avenue, concerning the unpleasant odors from the garbage con- tainers. Commissioner Speed also suggested that a blinking light be placed at Ocean Boulevard and Seventh Street because of the dangerous curve and the number of accidents that have occurred in the area. Chief Stucki stated he would look into the matter and report back to the City Commission in regard to street signs, blinking lights, etc. in this vicinity. Commissioner Fogg suggested that something should be done about cleaning the area around the Pic and Save, Atlantic Beach, Florida. Mayor Howell instructed the City Manager to write a letter to Le Chateau and also the Pic and Save in reference to these complaints. Mayor Howell read in full Resolution No. 4-73-19 providing for compliance with certain requirements under the Florida Revenue Sharing Act of 1973. It was moved by Commissioner Minton, seconded by Commissioner Fogg and carried that Resolution No. 4-73-19 be adopted. Copy of said resolution is attached hereto and made a part hereof. There being no further business Mayor Howell declared the meeting adjourned. ATTEST: 1 Orin cwe11, Mayor �— 4tea., Gloria Jun Knight, City Clerk (Seal) - RESOLUTION NO. 4-73-19 A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA PROVIDING FOR COMPLIANCE WITH CERTAIN REQUIREMENTS UNDER THE FLORIDA REVENUE SHARING ACT 1973 WHEREAS, the City of Atlantic Beach, Florida, desires to participate in and receive from the State of Florida, at the earliest possible time, all funds which the City of Atlantic Beach is entitled to receive under the Florida Revenue Sharing Act 1973, as said Act may from time to time be amended, and WHEREAS, in order to qualify for said revenue sharing funds during the 1973-74 fiscal year, the City of Atlantic Beach is required to complete and return to the Florida Department of Revenue on or before June 1, 1973, an application for Revenue Sharing 1973 including certification that, a. All police officers, as defined by subsection 23.061 (1) , Florida Statutes, employed by the City of Atlantic Beach, meet the qualifications for employ- ment as established by the Police Standards Board of the State of Florida, b. The salary structure and salary plans of the City of Atlantic Beach for law enforcement officers meet the provisions of Part IV of Chapter 23, Florida Statutes, and c. All police officers as defined in subsection 23.061 (1) , Florida Statues of Atlantic Beach are compen- sated at an annual salary rate of $6,000 or more, and WHEREAS, upon due investigation, the City Commission of the City of Atlantic Beach has determined that all police officers employed by the City do meet the qualifications for employment established by the Police Standards Board, and that no police officer employed by the City of Atlantic Beach is compensated for his services at an annual salary rate of less than $6,000, and the City Commission of the City of Atlantic Beach desires to hereby evidence by this resolution said City' s compliance with the provisions of Paragraphs (a) , (b) and (c) above; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION, OF THE CITY OF ATLANTIC BEACH, FLORIDA, AS FOLLOWS: 1 - PAGE TWO RESOLUTION NO. 4-73-19 SECTION 1. QUALIFICATIONS OF POLICE OFFICERS: The Atlantic Beach City Commission has duly investigated the qualifications of each police officer presently employed by the City of Atlantic Beach, and has determined that all such po- lice officers do meet the qualifications for employment estab- lished by the Police Standards Council of the State of Florida; and all police officers hereafter employed by the City of Atlantic Beach shall, prior to employment, be required to show that they meet said qualifications for employment. SECTION 2. MINIMUM SALARY FOR POLICE OFFICERS: All police officers employed by the City of Atlantic Beach, Florida are compensated at an annual salary rate of $6,000 or more. SECTION 3. SALARY INCENTIVE PROGRAM: The salary incentive benefits as defined in Section 23.078, Florida Statutes and authorized hereby shall be payable in accordance with the rule and regulations established by the Bureau of Police Standards through its Council in cooperation with the Department of Community Affairs. SECTION 4. SUBMISSION OF REPORTS: The City of Atlantic Beach shall submit quarterly reports to the Police Standards Council as of December 31, March 31, June 30 and September 30, of each year containing information relative to compensation of police officers employed by it, and such other information as the Council may require. SECTION 5. EFFECTIVE DATE: Except as herein otherwise specifically indicated all pro- visions of this resolution shall be and become effective immedi- ately upon its adoption hereof.
