Adjourn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, AUGUST 27, 1973, AT 8:00 P .M. PRESENT: William S. Howell, Mayor-Commissioner R. R. Rosborough, II L. W. Minton _ D. W. Speed, Commissioners AND R. C. Vogel, City Manager Oliver C. Ball, City Attorney Gloria June Knight, City Clerk ABSENT : F. W. Fogg, Commissioners The meeting was called to order by Mayor-Commissioner, Mr. Howell. The invocation was given by Commissioner Minton, followed by the pledge to the flag. The minutes of the meeting of August 13, 1973, were approved as written upon a motion of Commissioner Minton, seconded by Commission- er Speed and carried. Mayor Howell recognized visitors and called for any business from the floor not on the agenda. At this time, Mayor Howell recognized Mr. Gerry Adams, 890 Beach Avenue, Atlantic Beach. Mr. Adams requested that the City Commis- sion contact Le Chateau Restaurant, Seventh and Beach Avenue, about cleaning up the area around Le Chateau. He stated that the air con- ditioning is out in the street and that a fence has been erected blocking the driveway. Mayor Howell instructed the City Manager to lock into this and report back at the next meeting . Commission Consideration: Phase II, Fox Garden Apartments Mayor Howell stated thzt this item was held over from the last Commission Meeting to give those members of the City Commission an opportunity to further study the plans. Commissioner Speed stated that he was totally opposed to this type of complex. He brought to the attention of the City Commission other apartment complexes, namely Cavalla Arms, Cavalla Road, Atlantic Beach, where there has been work stoppage. The Cavalla Arms have air conditioners that are sitting on the ground with im- proper drainage; they have not been properly landscaped nor have the owners provided off street parking . The residents are putting garbage on the street without containers. The owners of the pro- perty have not picked up the remaining building construction material and the drainage ditch behind the property has not been filled in as promised or the fence erected as per the plans. MINUTES AUGUST 27, 1973 PAGE TWO Mayor Howell stated that he thought Commissioner Speed had some points that were well taken, but that he wanted to point out that Cavalla Arms is not Planned Unit Development. The property was re- zoned and is not under P ,U„D< Mayor Howell stated that the City Commission should direct the City Manager to cease any further in- spections on the remaining buildings until such time as they get their off street parking and complete the buildings according to their plans . Mr. Ball, City Attorney, stated that this particular apartment complex is in violation of the building and zoning codes and the owner and resident manager could be taken to municipal court each day these violations take place . After discussion, it was moved by Commissioner Speed, seconded by Commissioner Minton and carried that the City Commission direct the City Manager and the City Attorney to take whatever steps that are necessary to stop further rentals of Cavalla Arms and to: bring a- bout the completion of those that are already rented to the plans and specifications as submitted, and report back to the Commission at the next meeting. Commissioner Speed pointed out that because the City has had so much difficulty with apartment complexes that he would like to see Phase I, Fox Garden Apartments, completed and occupied before the City Commission gives authorization for Phase II and recommended to the City Commission that Phase II be postponed until Phase I is properly completed. Mayor Howell stated that Mr. Fox ' s Phase I , II , and Phase III were given tentative approval by the Advisory Planning Board and then passed on by the City Commission. After lengthly discussion, it was moved by Commissioner Rosborough, seconded by Commissioner Minton and carried that the City Commission approve the preliminary plans for Phase II, Fox Garden Apartments, 900 Plaza, Atlantic Beach. The vote was: Aye - Commissioners Rosborough, Minton and Mayor-Commissioner Howell. Nay - Commissioner Speed. MINUTES AUGUST 27, 1973 PAGE THREE Request for Water Service Ocean Grove - Lots 46, 47, 48, 49, 50. Commissioner Minton reported to the City Commission that he had met with Commissioner Speed, Mr. Walter Park, Consulting Engineer and Mr. Vogel, City Manager, to discuss whether or not to supply water to Ocean Grove, Lots 46, 47, 48, 49 and 50, which is outside the City Limits. The committee recommended that this request be granted. It was moved by Commissioner Minton, seconded by Commissioner Speed and carried that the City of Atlantic Beach extend water service to Lots 46, 47, 48, 49 and 50 Ocean Grove, Unit #2. Request for Water Service: Mayport Road. Commissioner Minton stated that after consulting with Mr. Parks, Consulting Engineer, and after talking with Mr. Vogel, that due to the size of this trailer park and the amount of water that will be used the committee recommends that this request be denied. At the present time, the City will be unable to give this project good water service without putting in another pump at the City Yard. Commissioner Minton moved, seconded by Commissioner Speed that the request for water service - Mayport Road be denied at this time until further study could be made. The motion carried. Open Bids Re: Water and Sewer Lines to Ocean Village One. The following bids were received: A. J. Johns, Inc. (Bid Bond from Commercial Union Companies) Water Bid: Item A. Lump Sum Bid $43,673 . 37 Item B Alternate - Add to Lump Sum Bid 3, 500.00 The bidder acknowledges addendum No. 1 dated August 23, 1973 . Sewage Force Main: Item A. Base Bid $25, 112 .00 Item B. Alternate - Add to Lump Sum $ 3, 350.00 MINUTES AUGUST 27, 1973 PAGE FOUR Art Reinerston Construction Co. (Bid Bond from Safeco Ins. Co. ) Water Bid: Item A. Lump Sum Bid $31,430.97 Item B. Alternate - Add to Lump Sum $ 1, 500.00 The bidder acknowledges addendum No. 1 dated August 23, 1973. Sewage Force Main: Item A. Base Bid $18,479. 22 Item B. Alternate - Add to Lump Sum $ 1, 500.00 It was moved by Commissioner Speed, seconded by Commissioner Minton and carried that the bid be awarded to Art Reinertson Construction Company subject to Ocean Village One depositing with the City of Atlantic Beach the entire amount of the bid. Request for Water Service: Lots 1 and 2 Ocean Grove. Commissioner Speed moved, seconded by Commissioner Minton that the City of Atlantic Beach grant water service to lots 1 and 2, Ocean Grove and that a two inch line be installed but that no additional hookups be allowed to the two inch line. After lengthly discussion, a substitute motion was introduced ,-y Commissioner Speed, seconded by Commissioner Minton and carried that the request for water ser- vice outside the City Limits be tabled until the Commission can meet as a whole and bring back a report at the next meeting. Mayor Howell presented Ordinance No. 20-73-26 revising the budget for the City of Atlantic Beach, Florida, to comply with State Statutes for the fiscal year 1973, on first reading by title only. Said Ordinance was presented in full and in writing. Commissioner Speed moved that the Ordinance be approved on first reading by title only, seconded by Commissioner Minton and carried. Public Hearing to be held on September 10, 1973 . Mayor Howell presented Ordinance No. 20-73-27 adopting the budget for the City of Atlantic Beach, Florida, for the fiscal year 1973- 1974, on first reading by title only. Said Ordinance was presented in full and in writing. Commissioner Speed moved that the Ordi- nance be approved on first reading by title only, seconded by Commissioner Rosborough and carried. Public Hearing to be held on September 10, 1973. MINUTES AUGUST 27, 1973 PAGE FIVE Chief Stucki stated that when Atlantic Beach elementary School opened the City provided sidewalks and walkways to most of the areas in the community with the exception of the Selva Marina area. Chief Btucki stated he would like a committee appointed to see what can be done about providing a sidewalk from Plaza to the main en- trance of Selva Marina . Mayor Howell appointed Commissioner Ros- borough to be chairman of the above mentioned committee .
