Adjourn 1 MINUTES OF THE MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT TH , CITY HALL ON MONDAY, DECr3+'13ER 10, 1973, AT 8:00 P . M. PRESENT: William S. Howell, Mayor-Commissioner L. W. Minton, Jr. F. W. Fogg Robert R. Rosborough, II AND R. Ce Vogel, City Manager Oliver C. Ball, City Attorney Gloria June Knight, City Clerk ABSENT: Robert B. Cook, Sr. , Commissioner The meeting was called to order by Mayor-Commissioner, Mr. Howell.. The invocation was given by Commissioner Minton, followed by the pledge to the flag. The minutes of the meeting of November 26, 1973 were approved as written upon a motion by Commissioner Rosborough, seconded by Commissioner Fogg and carried. Mayor Howell recognized visitors and called for any business from the floor not on the agenda. At this time, Mr. Clegg Rees requested permission from the City Commission for the Seventh-Day Adventist Church to be allowed to go through the neighborhood singing Christmas Carols and invite the citizens to give a contribution if they so desire. The singing will be done during the evening hours. The City Attorney, Oliver C. Ball, stated that the State law forbids soliciting money without a permit. Mr. Ball asked Mr. Rees if the Seventh-Day Adventist Church was registered with the State of Florida? Mr. Rees stated that at this time he did not know. After discussion, it was moved by Commissioner Rosborough, seconded by Commissioner Fogg and carried that the City Commission give permission to the Seventh-Day Adventist Church to sing Christmas Carols in the evening and solicit contributions sub- ject to having proper clearance from the State of Florida. Resolution No. 73-26- - 4. Mayor Howell presented in full and in writing Resolution No. 73-26 covering burning 10 - 3.90% General Obligation Sewer Bonds in the amount of $10,000.00, said bonds bearing maturity date cf April 1, 1973. Commissioner Fogg moved for passage of said resolution, se- conded by Commissioner Pointon and carried. Copy of Resolution 73.26 is attached hereto and made a part hereof. MINUTES DECEMBER 10, 1973 PAGE TWO Resolution Noe 73-27 : Mayor Howell presented j.n full and in writing Resolution No. 73-27 covering burning 20 - 7% General Obligation Sewer Bonds in the a- mount of $20,000.00, said bonds bearing maturity date of July 1, 1973. Commissioner Fogg moved for passage of said resolution, se- conded by Commissioner Rosborough and carried. Copy of Resolution No. 73-27 is attached hereto and made a part hereof. Resolution No. 73-28: Mayor Howell presented in full and in writing Resolution No. 73-28 covering burning 10 - 31% Utility Bonds in the amount of $10,000.00, said Bonds bearing maturity date of March 1, 1973 . Commissioner Rosborough moved for passage of said resolution, seconded by Commissioner Fogg and carried. Copy of Resolution No. 73-28 is attached hereto and made a part hereof, Water and Sewer Service: Mayor Howell stated that he had several conversationswith Mr. Parks, City Engineer, concerning the City' s need for adequate water and sewer service for the City of Atlantic Beach and also providing this service outside the City Limits. He stated that the City Commission should realize that the City of Atlantic Beach is not an island and the City does have some responsibility to areas outside the City Limits. In those areas outside the City Limits, the City of Jack- sonville is unable to provide sewer and water service to the citi- zens Over the last year, the City has had many request from de- velopers outside the City Limits to furnish sewer and water service. The City is reaching a maximum capacity on our own sewer plant. The City has several choices on financing to follow; either applying for a Federal Grant or doubling the City ' s present sewer plant through connections outside the City. In discussion with Mr. Parks, he re- commended that the City' s first move would be to immediately apply to the State of Florida and the Environmental Pollution Control Board for a permit to construct. This application to construct does not obligate the City in anyway.. It was moved by Commissioner Minton, seconded by Commissioner Fogg and carried to instruct the City En- gineer to proceed with the request for a permit to construct in order to double the size of the present sewer plant from one million gallons to two million gallons. MINUTES DECEMBER 10, 1973 PAGE THREE Lots 3 & 4 Block 106 Section H, Permit to Operate Foster Group Home: Reverend Giles stated that a foster home is simply his residence. He stated that he has five boys at the present time that are wards of the State of Florida. When he rented the house, located at 350 Main Street, he did not realize he needed Commission approval to keep young people in his home. A foster home is a program set up to keep boys from being sent to boys homes. In essence, a boy commits a small crime. He steals a bike and takes a ride. He is picked up by the police officer and placed at the Juvenile Shelter. If you send this particular boy to Marianna, it will probably per- manently damage him or you can place him in a corrective home and/or a foster home. In a foster home he will get proper guidance and taught to respect others rights . When he is rehabilitated, when he knows right from wrong, then he can return to his own home. Mayor Howell stated that in a sense what Rev, Giles is doing is similar to a day care center and that the City Commission has the authority, in this particular zoning area, to allow a foster home. He suggest- ed that Rev. Giles call on the neighbors within a 250 feet radius with a petition stating fully the number of children (not in excess of five) and present it to the Commission at the next meeting. There were no objections from the City Commission. Lots 1-6 Block 70 Permit to Construct Warehouse and Office: Mr. Vogel presented plans from Sery-Ex Sales, lots 1-6-70, Section H, to the City Commission. He stated the plans meat all the re- quirements of the Southern Standard Building Code. It was moved by Commissioner Minton, seconded by Commissioner Rosborough and carried that the plans for a warehouse located on lots 1-6, Block 70, Section H, Atlantic Beach be approved. 7itchen Remodel: "A Nice Place" , 469 Atlantic Boulevard: Plans were submitted for remodeling the kitchen at "A Nice Place" , 469 Atlantic Boulevard. The plans meet all specifications establish- ed by the Southern Standard Building Code. It was moved by Com- missioner Minton, seconded by Commissioner Fogg and carried that the plans to remodel "A Nice Place" , 469 Atlantic Boulevard be approved. MINUTES DECEMBER 10, 1973 PAGE FOUR Additional Sewer Connections, Pecan Grove (Outside City) : The City Commission received correspondence from Stephen B. Lewallen, attorney for Pecan Grove Property, requesting sewer hookups for approximately 184 apartments. It was moved by Commissioner Fogg, seconded by Commissioner Rosborough and carried to instruct the City Manager to advise Stephen Lewallen that if and when the City constructs a new sewer plant and the owners of Pecan Grove Property wish to commit themselves to whatever hookup charges the City es- tablishes, then the Commission will take it under consideration. At this time, the City Commission can not take action on this re- quest. Terry McCue Re: Lots 1 to 7 Block 28, Section H: Mr. McCue requested clarification of zoning of the Code of the City of Atlantic Beach, Section 28-14 Business A Section 4 "Restaurant, offices, ice delivery stations, laundries, shops for making articles sold at retail on the premises and for any other similar enterprise, not a nuisance, the chief characteristic of which is a service to the neighborhoods " Mr. McCue wishes to construct mini warehouses on the property and the ordinance does not state whether this type building is allowed. After lengthy discussion, it was moved by Commissioner Fogg, seconded by Commissioner Rosborough and carried that this request for clarification of Section 28-14, Atlantic Beach Code, be referred to the Board of Adjustment. Insurance for Nine Months, 1974: Mayor Howell stated that State law required the City of Atlantic Beach to change the budget year from October, 1973 to October, 1974. The City Commission must come to some decision as to whether or not to attempt to call for insurance bids for nine months or let the present carrier go ahead and carry the insurance for the additional nine months. After length,, discussion, it was moved by Commission- er Fogg, seconded by Commissioner Minton and carried that the City award the insurance to McNeil Insurance Company on an emergency basis providing the City receives the same credits that were receiv- in 1973. The vote was unanimous. MINUTES DECEMBER 10, 1973 PAGE FIVE Mayor Howell presented Ordinance No. 20-73-28 revising the budget for the City of Atlantic Beach, Florida, for the fiscal year 1973-74 and appropriating money to provide for the debts and expenses of the City on first reading by title only. Said Ordinance was presented in full and in writing. Commissioner Rosborough moved that the ordinance be approved on first reading by title only, seconded by. Commissioner Fogg and carried. Mr. Hilliard stated that the City has been informed that the land- fill, located at Jacksonville Beach, will close January 1, 1974. Mr. Hilliard contacted the City of Jacksonville and they require a check for the first months dumping. The City' s estimated amount of yardage would cost approximately $860.00. This money will be put in escrow until the City of Atlantic Beach cease and desist doing business with Jacksonville. It was moved by Commissioner Fogg, seconded by Commissioner Minton and carried that the City of Atlantic Beach post with the City of Jacksonville a check in the amount of $860.00 for the use of their landfill. N1r. Hilliard stated that he was going to call for bids on a pick-up truck, There were no objections from the City Commission. Mr. Vogel requested Commission approval to pay for electrical per- mits ordered. The total amount of the invoice was $538.20. It was moved by Commissioner Rosborough, seconded by Commissioner Minton and carried that Mr. Vogel be given approval to pay for the elec- trical permits. Commissioner Fogg brought up questions pertaining to the recent fire at Cavalla Arms Apartments, Cavalla Road. He stated, in his opinion, the City was allowing shoddy construction in Atlantic Beach. Commissioner Fogg recommended that the City Commission review the Southern Standard Building Code and improve on the requirements. Mayor Howell suggested that a committee beformed with Commissioner Fogg as chairman, to study the Southern Standard Building Code and bring back recommendations to the City Commission. There were no objections from the City Commission. Mayor Howell stated that the next regular meeting of the City Commission is on December 24, 1973 and recommended that the meeting be postponed until December 26, 1973 , It was moved by Commissioner Rosborough, seconded by Commissioner Minton and carried that the December 24th meeting be postponed until Wednesday, December 26, 1973, at 8:00 at the City Hall. MINUTES DECEMBER 10, 1973 PAGE SIX Public Hearing on Ordinance No. 20-73-28 will be held December 26, 1973, 8:00 Pe Me at the City Hall. Mayor Howell stated that due to the energy crisis he would like to suggest that the City inform Jacksonville Electric Authority to dis- connect every other light out to the Mayport Road Overpass. Nep- tune Beach will be doing the same thing. In other words, the street lights will be staggered along Atlantic Boulevard. On May- port Road, the City should cut where it will not be detrimental to public safety. Mayor Howell stated if there are no objections, the City Commission will instruct the City Manager and the Chief of Police to inform the Jacksonville Electric Authority which street lights are to be disconnected. There were no objections.
