MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH COMMISSION
HELD AT THE CITY HALL ON MONDAY, JANUARY 10th , 1972 at 8:00 p.m.

The meeting was called to crder by the Mayor-Commissioner Mr.
Howell.
The Invocation was given by Commissioner Minton, followed by the
pledge to the flag.
Mayor Howell deviated from the agenda to present a Resolution
paying tribute to Henry G. Isaacs, Sr. , who died today. Mr.
Isaacs served as Town Councilman and later as Mayor-Commissioner.
Mayor Howell read Resolution No. 72-1 paying tribute to Mr. Isaacs
and expressing sympathy to his family, then moved its passage,
seconded by Mr. Rosborough and unanimously carried. Copy of said
Resolution No. 72-1 is attached hereto and made a part hereof.
The minutes of the meeting of December 27, 1971 were approved as
written upon motion of Mr. Rosborough, seconded by Mr. Minton and
carried.
Mr. Vogel presented the only correspondence which was a letter
from J. L. Lyons of Somerset, Kentucky, expressing a desire to
have concessions on the beach. A copy of the letter was sent to
all Commissioners with tonight' s agenda. Mr. Minton moved we reply
in the negative since we are not interested in this type of bus-
iness in Atlantic Beach, seconded by Mr. Rosborough and carried.
Mr. Howell then read Resolution No. 72-2 covering the closing of
the East-West alley in Block 36 running from Ocean Boulevard to
the 10 foot alley called Beach Avenue; and Resolution Nc. 72-3
closing the north-south alley in Block 36 from Ahern Street to
Atlantic Boulevard. Mr. Howell stated we do not usually hold
Public Hearings on Resolutions, but tonight we will have Public
Hearing on these two Resolutions prior to action by the Commission.

wishes to speak for or against said Ordinance. A petition
was presented, with 123 signatures, headed "We, the undersigned
are opposed to the closing of a portion of Beach Avenue without
referendum by the citizens of Atlantic Beach. " Those speaking
against the closing cf the alleys were Messrs. Glover Weiss,
Thomas Galt, D. B. Hood, Charles Moore, Bernard Kane, Mesdames
Zoe Moore, Joan Hood, Dorothy Weiss, and Miss Charlotte Reid.
They feel the road has been in use for years and should not be
closed tc traffic, especially for bicycles and pedestrians and
do not feel Beach Avenue should be deadended. Speaking in favor
of the closing were Messrs. George Pharr, Nat Wilson, Preben
Johansen, Robert Wardrep, Richard Snyder, Peter Pace, William
R. Thompson, and Mrs. Margaret Then. There was a lengthy
discussion in which it was brought cut that the traffic driving
between First Street and Atlantic Boulevard on road called Beach
Avenue have been using private property. Also the Public Hearing
is on closing the alley and not as to whether the motel can be
built which was what a great deal of the discussion was about.
The property for the motel is zoned Business "A" which allows
hotels and motels. There seemed to be no objection to the closing
of the East-West alley. Mrs. Moore requested a call vote on
the second resolution closing the North-South alley. Mr. Bob
Cook, exhibited plans for the motel and parking and advised that
the 10 foot North-South alley strip would be open, there will
be no obstruction to keep people from walking through cr riding
bicycles, even automobile traffic can go through. Following
further discussion the Public Hearing was closed. Mr. Rosbcrough
moved passage of Resolution No. 72-2 closing East-West alley,
seconded by Mr. Fogg and carried. Copy of Resolution Nc. 72-2
is attached hereto and made a part hereof.
Mr. Rosboreugh moved passage of Resolution No. 72-3 closing Ncrth-
South alley, seocnded by Mr. Minton. Mr. Speed inquired if 10
feet was wide enough for those between Ahern Street and First
Street to get in and out of garages. Also he asked Mr. Cook if
Atlantic Beach gave up the 10 feet between Ahern and Atlantic
Boulevard would they be willing to give 10 feet between First
Street and Ahern. Mr. Cook said not willing to abandon their
property, but in line with their plans their parking lot will
not be built up to the 10 foot alley. Mr. Speed thinks they
should give the 10 feet to the city in crder to make a 20 feet
street so that we can keep it and maintain it for the people
who live there. Mr. Speed spoke on transients, and undesirable
conditions and feels the motel will bring far better quality

of people than trailer courts, and he urged the Commissioners
to vote against this Resolution until Mr. Cook sees fit to donate
to this city 10 feet to make adequate street for the residents
of that area. The question was called and the vote was:
Aye: Fogg, Minton, Rosborough, Howell
Nay: Speed
Whereupon Mr. Howell declared the motion carried and Resolution
No. 72-3 passed. Copy cf said Resolution is attached hereto and
made a part hereof.
Mr. Rosborough reported for committee on appointment of Advisory
Planning Board recommended and moved that the City Commission meet
as a committee of the whole and outline the criteria to select
people to serve on the Board, seconded by Mr. Minton and carried.
Mr. Speed reported that he had not had a chance to confer with
Mr. Howard on zoning time extension on Lots 1 to 11, Block 26,
Royal Palms, and asked that he be allowed an extention of time
to report back later. It was granted.
Mr. Minton reporting for committee on lot coverage exemption of
Lot 5, Block 27 , requested by Miss Charlotte Reid, recommended
and moved that the City Commission meet as a committee to discuss
the necessary ordinance to effect this zoning change, seconded
by Mr. Rosborough and carried.
Mr. Vogel presented plans of a warehouse on Levy Road. He
advised that the building and zoning requirements were in line
with the city codes. Mr. Rosborough inquired if it needed the
Commission approval. It was advised that it did not but it was
being brought to their attention for information. The type of
industry using will be electronics, which is a very clean industry.
Chief Stucki requested call for bids for 2 police cars, which
are set up in the 1972 budget. It was agreed the call for bids
be made to be received at the next meeting on January 24, 1972.
Resolution No. 72-4 was presented and read in full. The resolution
levies and imposes special assesment on Let 26, Block 10, for
removal of 4 dead and dangerous trees. Mr. Speed moved passage

of said Resolution Noe 72-4, seconded by Mr. Rosborough and
carried. Copy of said Resolution is attached hereto and made
a part hereof.
Mro Howell announced a meeting to be held Tuesday, January 18th,
1972, at 6000 p.m. , at Jacksonville Beach City Hall. Proposed
bills will be presented to the Duval Delegation at this meeting.
He asked all interested citizens to be present.
There being no further business, the Mayor declared the meeting
adjourned.

a • RESOLUTION #k 72-1
MEMORIAL AND RESOLUTION
Henry Garcia Isaacs, who served on the Atlantic Beach Town Council
from 1940 through 1944; served as Mayor/Commissioner of the City of
Atlantic Beach, Florida, from 1961 through 1963, and was appointed Chairman
of the Board of Adjustment of the City of Atlantic Beach, Florida on
September 1968, died on Monday January 10th 1972.
Mr. Isaacs was born on December 22nd 1897 in St. Louis, tissouri and
came to live in the Jacksonville Beaches area 35 years ago from Now Orleans,
Louisiana.
During his time as a resident of Atlantic Beach, Florida, Mr. Isaacs
always gave most generously of his time and energy for the benefit of the
citizens of the City of Atlantic Beach, Florida, and the Mayor/Commissioner,
Cannissioners and Officers of the City of Atlantic Beach, Florida, acknowledge
that they have lost one of their most valued and respected citizens.
In spite of the time given for the benefit of the citizens of Atlantic
Beach, Florida, Mr. Isaacs also found tine to give his time and services for
the benefit of the servicemen of the United States of America. He served as
President and Director of the Jacksonville Beaches U.S.O; was a Past
President of the Jacksonville Beaches and Mayport Council of the Navy League,
and was also a Charter member of the Jacksonville Beaches American Legion
Post No. 129; the members of these organizations acknowledge that they have
lost one of their finest and most active members.
Mr. Isaacs was a member of St. Paul's By The Sea Episcopal Church and
was a former Trustee of the Diocese of Southern Virginia.
Mr. Isaacs is survived by his widow Grace Isaacs, a son Henry G. Isaacs,
Jr., a daughter Mrs. Patricia Morgan, two grandsons, one granddaughter and a
sister Miss Lily Isaacs, all of Atlantic Beach, Florida.
In consideration of the foregoing,
BE IT RESOLVED by the Mayor/Carr.issioner, the Commissioners and Officers
of the City of Atlantic Beach, Florida, that we hereby express our profound
and sincere appreciation for the life and services of Henry Garcia Isaacs, and
that we hereby express to his family our most sincere sympathy.
BE IT RIMIER RESOLVED that a true copy of this Resolution be made a
part of the permanent records of the City of Atlantic Beach, Florida, and that
the original, duly inscribed by the Mayor/Camtissioner, the Commissioners and
Officers of the City of Atlantic Beach, Florida, be forwarded to his widow.

RESOLUTION NO. 72-2
WHEREAS, that certain alley in the City of Atlantic Beach,
Florida, being bounded on the South by Lots 1, 2, and 3,
Bleck 36, ATLANTIC BEACH SUBDIVISION, and on the North by
Lets 9, 10, and 11, Block 36, ATLANTIC BEACH SUBDIVISION,
all as recorded in Plat Book 5, page 69, of the current
public records of Duval County, Florida has never been
developed, and
WHEREAS, the members of the City Commission of the City of
Atlantic Beach, Florida feel it is in the best interest of
the citizens of the City of Atlantic Beach, Florida, to
abandon the said alley as described above, and
WHEREAS, the said alley is a Ten (10) foot right of way as
shown on the official City of Atlantic Beach map;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF ATLANTIC BEACH, AS FOLLOWS:
1. That the City of Atlantic Beach, Florida, abandon that
alley bounded on the South by Lots 1, 2, and 3, Block
36, ATLANTIC BEACH SUBDIVISION, and cn the North by
Lots 9, 10, and 11, Block 36, ATLANTIC BEACH SUBDIVISION,
all as recorded in Plat Book 5, page 69, .of the current
public records of Duval County, Florida.
2. That the abandonment of this alley is subject to the
issuance of valid Building Permit(s) , development and
construction of improvements, said development and
construction of improvements to commence within a period
of Twelve (12) months from the passing of this Resolution.
3. That upon abandonment of said alley, the City of Atlantic
Beach will quit-claim forever all right, title, interest,
claim and demand in respect of said alley, and will not
be held liable in any way whatsoever in respect of any
interest, lien, equity or claim either in law or equity,
in respect of said alley.

RESOLUTION NO. 72-4
A RESOLUTION LEVYING AND IMPOSING SPECIAL ASSESS-
MENT FOR THE REMOVAL, SUPPRESSION OR ABATEMENT OF
DANGEROUS, UNSAFE, DILAPIDATED, OR UNSANITARY
STRUCTURES , PURSUANT TO THE PROVISIONS OF ORDINANCE
NO. 25-67-6 OF THE CITY OF ATLANTIC BEACH, FLORIDA,
AGAINST THAT CERTAIN PROPERTY SUPPRESSED AND ABATED,
AND PROVIDING FOR THE OTHER MATTERS IN RELATION
THERETO.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC
BEACH, FLORIDA:
SECTION 1 . It is hereby ascertained, determined and declared
that, the removal from that certain property described as:
Lot 26 Block 10
Known As 353 Eighth Street
of dangerous, unsafe, dilapidated, or unsanitary structure, pur-
suant to the provisions of Ordinance No. 25-67-6, which was here-
tofore allowed to exist upon said above described property was here-
t_fore completed on the 4th day of January , 19 72 ;
that the total cost of performing said work is hereby ascertained,
determined and declared to be the sum of $ 395 .00 ; that
the above described property has been specially benefited by
said work to an extent greatly in excess of the aforesaid sum of
$ 395.00 ; and that, .accordingly, the sum of $ 395.00
is hereby levied, assessed and imposed against and upon the above
described property, and that unless said special assessment is
paid within thirty (30) days after publication of this resolution,
the same shall bear interest thereafter at the rate of 8% per
annum; and the City of Atlantic Beach shall have, assert and
possess a lien, superior to all other claims, except taxes, against
and upon the above described property for the respective amount of
such special assessment. as indicated above, together with interest
and all costs of collection until fully paid.
SECTION 2 . That the City Clerk as City Tax Collector be and is
hereby commanded to collect out of the property and from each
owner thereof the special assessment set down opposite each name,
lot, tract, or parcel of land herein described.
SECTION 3 . Any person desiring to contest in any way the validity
of any special assessment or lien hereinabove levied and imposed
shall, within thirty (30) days after the adoption of this reso-
lution, institute suit to have the enforcement thereof enjoined,
or its invalidity legally declared, and any and all persons not
instituting such suit shall not thereafter be heard to question
the validity thereof, or to defend against the enforcement of the
lien upon the grounds of its invalidity.

SECTION 4. This resolution shall take effect immediately upon
its passage.
ADOPTED by the City Commission of the City of Atlantic Beach,
