AGENDA ITEM: Public hearing and final reading to enact Ordinance 90-09-209 modifying the
Selva Residential PUD to merge the previously approved Selva Preserve and
Selva Marina Country Club projects.

BACKGROUND: The Selva Marina Country Club and the owners of the Selva Preserve
property have proposed to combine these two projects. Selva Preserve was approved in May of
2008 for 16 lots, and the Selva Marina Country Club PUD was approved in September of 2007 for
1141ots. In summary, the combined projects would: 1) provide for a reduction in the total number
of lots in the combined projects to not more than 114; 2) shift the development to the north and west
so that a larger area of the Selva Preserve project will be designated as conservation area; and 3)
eliminate the access and roadway extending from 11th Street. The Selva Preserve lots would be
accessed from the extension of an internal cul-de-sac roadway within the Selva Marina project.
Staff is of the opinion that the merger of these projects will provide a number of desirable outcomes
by requiring less street construction with no access to 11th Street and also preservation of a larger
portion of the Selva Preserve site as conservation area with less impact to existing wetlands.
Combining the two projects will also provide for some efficiencies in utility and stormwater
infrastructure.
RECOMMENDATION: Approval of Ordinance 90-09-209 on final reading.

AN ORDINANCE OF THE CITY OF ATLANTIC BEACH, AMENDING
PREVIOUSLYADOPTED ORDINANCE NUMBER 90-07-202 TO INCORPORATE
ADDITIONAL LANDS INTO THE SELVA RESIDENTIAL PLANNED UNIT
DEVELEOPMENT WITH NO INCREASE IN THE TOTAL NUMBER OF
RESIDENITAL LOTS; PROVIDING FOR SPECIAL CONDITIONS; REPEALING
ORDINANCE 90-08-205, PROVIDING FINDINGS OF FACT; PROVIDING A
SAVINGS CLAUSE; REQUIRING RECORDATION AND PROVIDING AN
EFFECTIVE DATE.
RECITALS
WHEREAS, the City Commission of the City of Atlantic Beach, Florida hereby finds that the
combining of the Selva Residential PUD and that project known as Selva Preserve into a single Planned
Unit Development serves the welfaze of the public by decreasing needed new infrastructure,
minimizing wetland impacts and preserving increased conservation azea, and
WHEREAS, combining the two projects provides for the orderly development of land and
supports the goals and objectives of the Comprehensive Plan, and
WHEREAS, first reading of the proposed Ordinance by the City Commission was held on the
24th day of August, 2009 at 6:OOpm. After required notice was published, second reading of the
proposed Ordinance and a public hearing to heaz, consider and adopt said Ordinance was held on the
14th day of September, 2009 at 6:00 p.m.
NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION ON BEHALF OF THE
PEOPLE OF THE CITY OF ATLANTIC BEACH, FLORIDA:
SECTION 1. The Selva Residential Planned Unit Development as previously approved on
September 24, 2007 by Ordinance 90-07-202 is hereby amended to incorporate additional land azea of
approximately 7.2 acres, as described within attached Legal Description, Exhibit A.
SECTION 2. Development shall not exceed 114 residential lots as set forth within the original
Selva Residential Planned Unit Development and shall proceed in accordance with the revised Final
Development Plan attached hereto as Exhibit B.
SECTION 3. Development of additional lands as described within this expanded PUD shall
commence and proceed in accordance with all terms and special conditions as set forth within
Ordinance 90-07-202 creating the Selva Residential PUD.
SECTION 4. Enactment of this Ordinance shall repeal Ordinance 90-08-205, with this new
ordinance reclassifying lands subject to that ordinance from RS-1 to PUD, with minimum development
standazds as prescribed within the RS-1 Zoning District to be retained in this portion of the PUD.

SECTION 6. This Ordinance shall take effect immediately upon its final passage and adoption
and shall be recorded in a book kept and maintained by the Clerk of the City of Atlantic Beach, Duval
County, Florida, in accordance with Section 125.68, Florida Statutes.
Passed upon first reading by the City Commission of the City of Atlantic Beach this 24th day of
August, 2009.
Passed and enacted, upon final reading and public hearing and adoption this 14th day of
