A]INUTES OF THE REGULAR MEETING OF ATLANTIC BEACH CITY COMMISSION
HELD AT THE CITY HALL ON MONDAY, MAY 8, 1972, AT 8:00 p.m.

The meeting was called to order by Mayor-Commissioner, Mr. Howell.
The invocation was given by Commissioner Fogg, followed by the
pledge to the flag.
The minutes of the regular meeting of April 24, 1972, were approved
as written upon motion of Mr. Speed, seconded by Mr. Rosborough and
carried.
Mr. Howell recognized visitors. There was no business to be
considered not appearing on the agenda. Mr. Howell asked for corre-,
spondence. Mr. Vogel presented a letter from Savage and Brant
General Contractors, Inc. , contractors for the city ' s sewage treat-
ment plant, asking for an extension of 60 days on their contract.
The original contract has a deadline of May 11, 1972, but some of
the equipment to be installed will not be here until June 1. Mr.
Howell read a letter from Mr. Walter J. Parks, Jr. , City Engineer,
substantiating this delay and recommending the extension of 60 days
to the contract. Mr. Speed moved that we allow an extension of
60 days on our contract with Savage and Brant General Contractors,
Inc. , seconded by Mr. Fogg, and carried.
Mr. Vogel also introduced a letter from Teigh, Groh & Robinson,
Counselors of Law for the bankrupt estate of Benjamin L Lowe, owner
of Lot 234, Saltair Subdivisions The letter is asking for a firm
offer to be forwarded to the referee of the estate . It was advised
that the appraised value of the Lot 234 is $150.00 and suggested we
make this our firm offer. Mr. Speed moved that the City Attorney
send a letter with a firm offer of $150.00 for Lot 234, Saltair

Subdivision, to the lawyers of the estate of Benjamin I. Lowe, seconded
by Mr. Fogg and carried. This lot is to be used as part of a proposed
park in Saltair.
Bids for water extension, sanitary sewer extensions, and paving and
drainage facilities for Selva Marina Unit 8 were received as follows:

Commissioner Speed moved that the bids go to committee for study and
report back at next meeting, seconded by Commissioner Fogg, and carried.
Members appointed to the committee were Commissioners Fogg and Minton;
City Manager, Mr. Vogel; and City Engineer, Mr. Walter J. Parks, Jr.
The awards committee chairman, Mr. Rosborough, reported to the
Commission on their study of the bids for a pick-up truck. Two bids
were submitted from Thor Chevrolet and Lynch Davidson; the latter being
higher with a difference of $85.43 ,in bid price. Mr. Rosborough said
that the committee found the Ford bid to be the best for the City of
Atlantic Beach in that the optional equipment of the Chevrolet was
already included in the bid price of the Ford and they, therefore,
recommended award to Lynch Davidson. Mr. Minton moved that we accept
the recommendation of the committee and award the bid to Lynch Davidson
Ford for a pick-up truck for the City of Atlantic Beach, seconded by
Mr. Fogg and carried.
Miss Charlotte Reid asked for permission to apply for a building permit
for construction of a secondary single dwelling. Plans were presented
to the Commission for study. There are apparently two separate kitchens
in the house; one on the first floor is indicated as refreshment area,
the other on the second floor is indicated as a kitchen. The Commis-
sion is concerned with the potentiality of the structure becoming a
duplex. However, it does not meet the square footage requirement to
become a duplex. After some discussion, Mr. Speed moved that we
issue Miss Reid a building permit with the stipulation that it shall
be a single family dwelling, or any other zoning that may be in effect
from time to time. Motion was seconded by Mr. Fogg and carried.
Copies of the Advisory Planning Board special and regular meeting
minutes were given to the Commissioners for their information.
Mayor Howell presented in full in writing an ordinance establishing
"Planned Unit Development" or "PUD" Zones in Atlantic Beach. Mr.
Fogg moved that said ordinance be passed on first reading by title
only, seconded by Mr. Minton and carried. Public hearing will be

of the City of Atlantic Beach. Mr. Fogg moved that said ordinance be
passed on first reading by title only, seconded by Mr. Minton and
carried. Public hearing will be May 22, 1972, at 8:00 p.m.

of the City of Atlantic Beach. Mr. Fogg moved that said ordinance be
passed on first reading by title only, seconded by Mr. Minton and
carried. Public hearing will be May 22, 1972, at 8:00 p.m.
Mr. Howell presented in full in writing an ordinance amending Chapter

Mayor Howell, reported that he, along with the City Attorney and
City Manager, attended a Seminar on State-Municipal Revenue Sharing
in Tallahassee, Florida, last week, April 30 to May 1. In 1972 the
Florida Legislature successfully passed legislation relating to taxa-
tion and revenue sharing with local governments. The legislation
provided stipulations for salary incentive programs for law enforce-
ment officers and provided that the State Police Standards Council
establish the rules and regulations pertaining thereto, with an
effective date of July 1, 1972. In order for municipal governments
to qualify for participation in revenue sharing the State of Florida,
Department of Revenue, must receive a Certified Municipal Report prior
to June 1, 1972. The report shall contain certified answers to Police
standard matters, which is not effective legislation until July 1,
1972. We have to submit the Certified Municipal Report with the
appropriate criteria answered either "yes" or "no" as to compliance
of the particular criteria. Mayor Howell suggested that a resolution
be adopted declaring that the City of Atlantic Beach, Florida, intends
to fully abide by the letter and the spirit of the present and future
effective legislation and reasonable rules and regulations thereunder,
including Police Standards. Mr. Rosborough moved that we adopt
Resolution No. 72-25 as suggested with copy to be attached as an
addendum to the Certified Municipal Report to be submitted prior to

officials are directed to file with the Department of Revenue, proper

application forms for Revenue Sharing, with a Certified copy of this
resolution attached as an addendum thereto. Copy of Resolution No.
72-25 is attached hereto and made a part hereof.
Mayor Howell suggested that the Commission direct Mr. Vogel to not
issue any building permits to anyone during the interim period of the
first reading of the four ordinances presented at this meeting, May
8, 1972, and the second reading on May 22, 1972, that would be in
conflict with said ordinances. Mr. Fogg moved that Mr. Vogel be so
directed, seconded by Mr. Minton and carried.
There being no further business, the mayor declared the meeting
adjourned.

RESOLUTION NO. 72-25
(State Municipal Revenue Sharing)
WHEREAS, the 1972 Florida Legislature successfully passed legisla-
tion relating to Taxation and Revenue Sharing with Local Governments,
and
WHEREAS, the 1972 Florida Legislature further enacted legislation
providing for Salary Incentive Programs for Law Encorcement Cfficers,
and provided that the State Police Standards Council shall establish
reasonable rule and regulations pertaining thereto, with an effective
date of July 1, 1972,
WHEREAS, the Department of Revenue, State of Florida, pursuant to
the above legislation requires the receipt of a Certified Municipal
Report prior to June 1, 1972, in order to participate in Revenue
Sharing; the said report to contain certified answers to Police
StandIrds matters, which is not effective legislation until July
1, 1972, and the reasonable rules and regulations thereunder have
not been formulated, and
WHEREAS, the City Commission of the City of Atlantic Beach, Florida,
is fully desirous of participating in and being a recipient of funds
under the Revenue Sharing Act of 1972;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF ATLANTIC BEACH, FLORIDA, AS FOLLOWS:
1 . The City Commission of the City of Atlantic Beach, Florida,
publicly declares that it is the full intention of the
municipality to fully abide by the letter and the spirit
of the present and future effective legislation and reasonable
rules and regulations thereunder in these matters, among
others, of Police Standards.
2. The proper City Official., are hereby directed with diligent
haste to file with the Department of Revenue, proper applica-
tion forms for Revenue Sharing, with a Certified copy of this
Resolution attached as an addendum thereto.
