07-17-72 v MINUTES OF SPECIAL MEETING OF ATLANTIC BEACH CITY COMMISSION AT THE CITY HALL ON MONDAY, JULY 17, 1972, AT 8: 00 P.M. PRESENT: William S. Howell, Mayor-Commissioner F. W. Fogg L. W. Minton, Jr. R. R. Rosborough, Commissioners AND Oliver C. Ball, City Attorney R. C. Vogel, City Manager ABSENT: D. W. Speed, Commissioner, Out of City Adele S. Grage, City Clerk, Out of City The meeting was called to order by Mayor-Commissioner Howell for the purpose of considering approval of plans for commercial buildings in the City of Atlantic Beach, Florida. The first item to be considered was the construction of a pre- fabricated steel building located at 151 Levy Road, Atlantic Beach, Florida. Plans were submitted by the owner, Mr. William S. Taylor. After reviewing the plans, it was moved by Commissioner Rosborough, seconded by Commissioner Minton and unamiously approved to instruct the City Manager, Mr. Vogel, to issue the building permit. The next item considered was the construction of a motel to be erected adjacent to the Sea Turtle Restaurant, Atlantic Beach, Florida. After lengthly discussion concerning the proposed types of footings, Mr. Bill Cook advised the Commission the engineers were in the process of designing concrete pilings. Commissioner Minton moved, seconed by Commissioner Fogg that the City Manager, Mr. Vogel, issue permits for the construction of the motel. Resolution No. 72-36, covering certain alley in the City of . Atlantic Beach, Florida being bounded on the South by Lots 1, 2 and 3, Block 36, Atlantic Beach Subdivision, and on the North by Lots 9, 10 and 11, Block 36 Atlantic Beach Subdivision was read in full by Mayor Howell. Commissioner Minton moved that we adopt said Resolution, seconded by Commissioner Fogg and carried. Copy of Resolution 72-36 is attached hereto and made a part hereof. Commissioner Minton moved that we adopt said Resolution, seconed by Commissioner Fogg and carried. Copy of Resolution 72-37 is attached hereto and made a part hereof. Ce Vogel, ng City Clerk RESOLUTION 72-36 WHEREAS, that certain alley in the City of Atlantic Beach, Florida, being bounded on the South by Lots 1, 2 and 3, Block 36, ATLANTIC BEACH SUBDIVISION, and on the North by Lots 9, 10 and 11, Block 36, ATLANTIC BEACH SUBDIVISION, all as recorded in Plat Book 5, page 69, of the current public records of Duval County, Florida has never been developed, and WHEREAS, the members of the City Commission of the City of Atlantic Beach, Florida feel it is in the best interest of the citizens of the City of Atlantic Beach, Florida, to abandon the said alley as described above, and WHEREAS, the said alley is a Ten (10) foot right of way as shown on the official City of Atlantic Beach map. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, AS FOLLOWS: 1. That the City of Atlantic Beach, Florida, abandon that alley bounded on the South by Lots 1, 2 and 3, Blbck 36, ATLANTIC BEACH SUBDIVISION, and on the North by Lots 9, 10, and 11, Block 36, Atlantic Beach Subdivision, all as recorded in Plat Book 5, page 69, of the current public records od Duval County, Florida. 2, The City of Atlantic Beach does hereby forever quit-claim all right, title, interest, claim and demand in respect of said alley, and will not be held liable in any way whatsoever in respect of any interest, lien, equity or claim either in law or equity, in respect of said alley. 3.
