RESOLUTION N0.09-15
CERTIFICATE OF RESULTS OF PRIMARY ELECTION OF THE
CITY OF ATLANTIC BEACH, FLORIDA, HELD ON TUESDAY,
OCTOBER 6, 2009.
WHEREAS, the clerks and inspectors of the Primary Election held in Atlantic Beach,
Florida, on October 6, 2009, for the purpose ofelecting aMayor-Commissioner for Seat 1, and two
Commissioners for Seats 4 and 5, certified the election results as indicated on Exhibit A attached
hereto and made a part hereof, and
WHEREAS, the County Canvassing Board, made up of Ronald Higbee, County Judge; Jerry
Holland, Supervisor of Elections; and Jack Webb, Vice President of the Jacksonville City Council
met on October 6, 2009 and publicly canvassed the votes and certified the returns as indicated on
Exhibit B attached and made a part hereof.
IT IS HEREBY FOUND AND DETERMINED BY THE CITY COMMISSION OF
ATLANTIC BEACH, FLORIDA, acting in the capacity of a City's Canvassing Board, that the
qualified voters who participated in said Primary Election cast their votes and the returns were
certified by the clerks, inspectors and the County Canvassing Board.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF ATLANTIC BEACH, FLORIDA that it is hereby agreed that said returns be accepted as
reported, and the result of the election is as follows:

Atlantic Beach City Charter:
Sec. 43. Elections: Canvass of returns.
The polls shall open at seven o'clock a.m. and shall close at seven o'clock p.m. or as otherwise
provided by Florida Statutes. The result of the voting, when ascertained, shall be certified by
return duplicate, signed by the clerk and a majority of the inspectors of the election. One copy
shall be delivered by the election clerk to the mayor-commissioner and the other to the city clerk,
both of whom shall transmit such returns to the city commission at its regular meeting on the
second Monday in October for primary election and, if needed, the second Monday in November
for general election. At such meeting, the city commission shall canvass the returns and the result
as shown by such returns shall be declared by the city commission to be the result of the election.
The city clerk shall, not later than noon on the second day aver the canvass of said election,
furnish a certificate of election to each person shown to have been elected.
