MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY
COMMISSION HELD AT THE CITY HALL ON MONDAY, JANUARY 11 , 1971 ,
AT 8 : 00 P.M.

The meeting was called to order by the Mayor-Commissioner ,
Mr . Howell .
The invocation was given by Commissioner Rosborough ., followed
by the salute to the flag .
Upon motion of Mr . Longo , seconded by Mr . Rosborough , the
minutes of the regular meeting of December 28 , 1270 , were
approved as written . Motion carried .
Mayor Howell recognized visitors present and called for any
business from the floor not on the Agenda. City Manager
Vogel at this t _me introduced Mr . Sill Tully who is associated
with Lewis C . Medlin , Architect , and stated that Mr . Tully
had with him proposed plans for the property rezoned on
Atlantic Blvd: . There being no action to be taren on these
plans , it was suggested by Mr . Rosborough that the Commission-
ers take a look at them following the meeting .
Under Communications , a letter was read from Mode , Inc . ,
3514 St . Augustine Road , Jacksonville , in which they made
application for permission to collect and dispose of their
own refuse , at their complex , Place by the Sea, 901 Ocean
Blvd . , Atlantic Beach , and asked for a rate to be supplied
to them for their providing such service . It was estimated
by the Commission that the Place by the Sea was now paying
the City approximately $1400 a year , which amount included
the containers rented to them by the City . The Mode , Inc . ,
is owned and operated by owners of Place by the Sea, and
they have some 10 other apartment complexes in this county.
They have started this service at the other establishments
of theirs already and desire to add this complex to their
operation . It was suggested • b y Mayor Howell that a Com-
mittee be appointed . It was moved by Commissioner Johansen ,
seconded by Commissioner Longo and passed , that a committee
be appointed to study this matter and report bac'- at the next

meeting . Mayor Howell appointed Commissioner Minton , . u1ic
Works Director Hilliard and City Manager Vogel and City
Attorney Ball as the committee.
Correspondence was read from Interstate Contracting Company
in which letter they as`.7..ed the rezoning of the acreage just
north of the Vienna Schnitzel Haus restaurant , which adjoins
Lot 17 , Plock 27 , all of which fronts on Sailfish Drive East ,
from its present zoning of 'Business "Aa."_ to Residence C .
Their purpose for this request is to permit the construction
of an apartment building on the property and they stated that
they have been unable to sell this property , secure financing
or an FHA/ VA commitment for a house inasmuch as it looks
into the back of the Pic ' n Save Store in the area where they
keep their dumpsters , trash , etc . It was moved by Commissioner
Rosborough , seconded by Commissioner Longo , and passed , that
this be referred to Committee for a report back at the next
meeting . Mayor Howell appointed Commissioner Rosborough ,
City Manager Vogel , and City Attorney Ball to this Committee .
Mayor Howell suggested that since the next item on the Agenda
which was a Resolution to close W . Plaza Street , should ,` e
acted on following the action on Ordinance 30-71-40 , which
was further down on the Agenda, that this matter be tabled
until that time in the meeting .
Commissioner Longo reported on bids received on Specification
#70-7 - Police Patrol Cars , and stated that after careful
evaluation of the ; ids received under this Specification ,
they, the Committee , concluded that the Big 1BR" Chevrolet
Company was the lowest and best `:sir; and therefore the Com-
mittee recommended that the Commission aware the contract to
the Big '°R.' Chevrolet Company . Discussion followed in which
Commissioners Preben Johansen and Minton stated that they
were in disagreement with the choice because when the cars
needed servicing , it would take additional time and expense
to have a patrolman or Public Works person tae the cars
all the way into Jacksonville for worL under the warranty .
It was pointed out that the work , any was needed , could be
done by any local Chevrolet dealer , whether it b be the LAg
'R" or Thor . Further discussion followed on the advisability
of awarding to the next highest hidder , because the next time
a bid was called for , it would hamper the City receiving
ethical bids from reputable dealers . It was moved by
Commissioner Longo , seconded by Commissioner Rosborough ,
that the bid be awarded to the rig 'R" Chevrolet Co . , for
their low bid price of $4 , 772 . y2 . The vote was :
Ayes : Commissioners Rosborough , Longo , and Mayor
Howell .
Nay : Commissioners Minton and Johansen .

Mayor Howell declared the motion _ assed .
Mayor Howell presented Ordinance No . . O-71-43 covering Zoning ,
entitled : AN ORDINANCE AMENDING CHARTER 21 CF THE CODE OF
THE CITY OF ATLANTIC EACH, FLORIDA, ENTITLED "ZONING" , AND
AMENDING THE OFFICIAL ZONING MAP Tr' CONFORM WITH THE FOLLOWING
AMENDMENT. This re-;onin.g is on _i_,c1).s #44 and #41 , section
H from Busines "A" to Business 'B. " . The Ordinance was
presented in full in writing for passage ! .57 Title only on
first reading . i>ir . Longo moved , seconded by Mr . !los orough ,
the passage of sa. a Ordinance on first reading . Motion
carried unanimously and Mayor Howell set the Public Hearing
date for January 25 , 171 .
Mayor Howell stated that the Resolution to be considered'
concerning the closing of West ?laza treet , should be carried
over to the next meeting because if the rezoning Ordinance
does not pass , then the Resolution would become a mute
question . It was agreed that this be carried over to the
next meeting following the xublic Hearing on the proposed
Ordinance .

Wors Director Hilliard requested permission to call

the bids will be called for , to be received January 25

The Police Reports for the month of December 1170 , and the
yearly report for the year 1`. 70 , were received for informa-
tion and filing .
City Manager Vogel reported his mileage for the month of
December to be 4:`2 miles and City Clerb Grage ° s
Commissioner Preben Johansen stated that there is an extreme
important issue at hand which would concern the entire
economic areaof the beaches . He stated that it had been
reported on the television newscast this evening by
Representative Bennett that it was fairly certain that the
Navy base facilities at Mayport would be closed . He fu Cher
commented that whether or not a ,_ulic realized it , there
was a strong economic valuation put on the Navy and their
personnel in the area and the closing of this base would
a loss go the entire Northeast Florida area. Representative
Bennett , he stated , had commented on the television broadcast
that he had done all he could in trying to prevent the
closing of the base at Mayport . It was moved "by Commissioner

Johansen , seconded by Commissioner 7o,borough , and carried ,
that a resolution be prepared by the City Attorney and for-
warded to President Richard M. Nixon , Senator Spessard L.
Holland , .senator Edward J. Gurney, senator Lawton Chiles ,
Congressman Charles E . Bennett , Conressman Bill Chappel ,
Jr . , Secretary of Defense Melvin P . L_:ird and Secretary of
the Navy John H . Chafee , said resolution stating that to
close the base would be disastrous :o this area. Cony of
Resolution 71-1 is attached hereto' and made a Dart thereof .

RESOLUTION NO. 71-1
WHEREAS , it appears to the members of the City Commission of the
City of Atlantic Beach , Florida, that there is a possibility, or
probability, that consideration is being given to the closing
down of the United States Navy Base situate and located at
Mayport, Florida, and,
WHEREAS, the members of the City Commission of the City of
Atlantic Beach, Florida, feel that it is not in the best interest
of its citizens , or people of the surrounding area, that this
Naval Base be closed down, and,
WHEREAS, this Naval Base is situate and located in such close
proximity to the Country of Cuba, and is the nearest Naval
operation to that area which can accommodate large quantities of
Navy Shipping, and,
WHEREAS , it is felt most strongly by all citizens and members of
the City Commission of the City of Atlantic Beach, Florida, that
this particular United States Navy Base should remain under full
operational conditions;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF ATLANTIC BEACH, FLORIDA, AS FOLLOWS :
1. That any and all steps which can, or should, be taken to
prevent the closing down of this United States Navy Base
at Mayport, Florida, be taken forthwith.
2 . That a true copy of this Resolution be sent to President
Richard M. Nixon, Senator Spessard L. Holland, Senator
Edward J. Gurney, Senator Lawton Chiles , Congressman Charles
E. Bennett, Congressman Bill Chappell, Jr. , Secretary of
Defense Melvin R. Laird and Secretary of the Navy John H.
Chafee.
