11August2009CEBMTGCITY OF ATLANTIC BEACH CODE ENFORCEMENT BOARD MINUTES 7:00 P.M., August 11, 2009 PRESENT: Vice Chairman Ron Pendleton Veda Bernstein Juliette Hagist Ray Martin Richard Ouellette Barbara Weiss EXCUSED: Chairman Carl Russell Nicholas Dodaro AND: Alex Sherrer, Code Enforcement Officer Susan Gorman, Secretary Suzanne Greene, Prosecuting Attorney Alan Jensen, City Attorney Vice Chair Ron Pendleton called the meeting to order at 7:00 p.m., followed by the Pledge of Allegiance to the Flag by all present. Secretary Susan Gorman read the roll and determined that there was a quorum. 1. Approval of Minutes: Following a brief review, the Board voted unanimously to approve the minutes of the Code Enforcement Board meeting of July 14, 2009. 2. No visitors noted. Vice Chair Pendleton asked all Respondents and witnesses to step forward to be sworn in. 3. OLD BUSINESS: a. Case # 429-08: Code Enforcement Officer Alex Sherrer advised the Board that Mr. Fred Cazares applied for a building permit and is in full compliance. b. Case # 427-08: Code Enforcement Officer presented evidence of Rena Konig efforts to come in compliance, and recommended that the Board grant the owner of 981 Sailfish Drive more time to meet full compliance. Discussion ensued. Ray Martin motioned to August 11, 2009 Page 2. grant an additional thirty days to come in full compliance. Juliettte Hagist seconded and the motion carried unanimously. c. Case #151-09: Alex Sherrer reported that Domino's Pizza is not in compliance and recent plumbing issues may result in further violations. Veda Bernstein made a request that CEB minutes note the potential for DEP involvement. The Code Enforcement Officer advised that fines relative to the case have accrued. 4. NEW BUSINESS: a. Case # 489-09: The Respondent Keith Maddox did not appear before the Board but the Code Enforcement Officer advised the Board that Mr. Maddox is in compliance. Code Enforcement Officer Alex Sherrer took questions from several Board Members regarding recreational boat storage. b. Case #824.1-09: The Code Enforcement Officer gave his presentation to the Board regarding the condition of the property located at 457 Sailfish Drive. Mr. Benjamin Brown is not the legal owner of the property at 457 Sailfish Drive, but appeared before the the Code Enforcement Board to respond to notice of repeat violations. The Code Enforcement Officer recommended Mr. Brown be found guilty and that Mr. Brown is subject to maximum fines allowed for repeat violations if found guilty. Discussion ensued. The Board determined that Mr. Brown's business activities run contrary to zoning for 457 Sailfish Drive. A motion was made to accept the Code Enforcement Officer's recommendation and the motion passed unanimously. c. Case #824.2-09: David and Catherine Chitty, owners of the property at 457 Sailfish Drive received notice to appear before the Board and Catherine Chitty took questions from Board Members regarding the violations associated with the property at 457 Sailfish Drive. Mrs. Chitty was advised that liens could be placed on the property if Code Enforcement violations continue and if Mr. Benjamin Brown fails to meet full compliance. Code Enforcement Officer Sherrer recommended that David and Catherine Chitty be found guilty and fined as first time offenders. A motion was made to accept the Code Enforcement Officer's recommendation and the motion passed unanimously. w August 11, 2009 Page 3. 5. Miscellaneous Business: None. 6.
