Adjourn. �4 MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD ON MONDAY, SEPTEMBER 27, 1971, AT 8 :00 P . M. Present: William S. Howell, Mayor-Commissioner R. R. Rosborough A. J. Longo L. W. Minton, Jr . , Commissioners and R. C . Vogel, City Manager Oliver Ball, City Attorney Adele S. Grage, City Clerk Absent: Marion Marvin, Commissioner The meeting was called to order by the Mayor-Commissioner, Mr. Howell. The Invocation was given by Commissioner Minton. The minutes of the Special meeting of September 9, 1971 were approved as written upon motion of Mr. Longo, seconded by Mr. Minton and carried. Minutes of the Regular meeting of September 13, 1971 were approved as written upon motion of Mr. Longo, seconded by Mr. Rosborough and carried. Mr. Rosborough moved that the minutes of the special meeting of September 21, 1971 be approved with the addition to the next to the last paragraph on page 2 of the following: "Mr. Hill advised they could not at this time undertake the planning for Atlantic Beach, and would suggest our hiring a planner, but that the Jacksonville Area Planning Board would assist us in every way possible" . The motion was seconded by Mr. Longo and carried . Mr. Howell recognized visitors present and called for any business from the floor not on the agenda. There was none. A letter was presented from Mr. William R. Ott, Air Pollution Engineer of the Department of Health, Welfare and Environmental Services relative to Roland 's Red Barn, advising they had not recently found the Red Barn at 375 Atlantic Boulevard in viola- tion of the visible emission code of the City, but has found the above firm emitting less emissions than the normal barbecue pit because of the special grease traps below the grill, a feature designed by Mr. Blalock. They also advised that the Red Barn will be kept under close surveillance during the next few weeks. Mr. Howell stated they must not have been watching at same time Minutes 9/27/71 Page #2 he has, that we are watching the situation and are going to report any violations. Mr. Longo inquired if the City Manager had contacted Mr. Blalock, owner of the Red Barn, and the City Manager advised that he had written him advising him of the complaints. Mr. Hilliard stated that he was talking to Hotel and Restaurant Commission representative today, and they made an inspection there today and advised Mr. Blalock that the pit area and back of the building should be steam cleaned and he is supposed to be in the process of getting a steam cleaner to do this. Mr. Hilliard was asked to keep check on this and let us know what has been done. A letter was presented from Bennett 's Beach Motel relative to complaints from their guests who are being disturbed by noise and lights of people coming and going to and from the Red Barn Bar-B-Que which adjoins them on the West Side. They also stated they are plagued with debris such as beer cans and paper thrown on their property by patrons of Mr. Blalock' s. Prior to building the place, they were promised by Mr. Blalock that he would build a privacy fence which would keep lights and noise from disturbing the guests . They solicit the City's help in getting Mr. Blalock to build a nice, decent privacy wall to keep out noise and lights, and they suggested another solution would be for Mr. Blalock not to permit any parking on the side next to the Motel. They will appreciate any help and ask for cooperation for the mutual benefit of all concerned . Mr. Longo asked as to the situation reported at last meeting of indecent and unsanitary loitering and could we make him build a higher fence. Mayor Howell advised he didn' t know how as it is in a business area and he doesn' t know of any requirement of such a thing but we can see if we can get them to do it. Mr. Howell then asked our Attorney for any opinion and he stated that it perhaps could be a condition to closing him up entirely under a Nuisance Ordinance we have. Mr. Longo stated that perhaps in spirit of cooperation if he is going to take care of smoke problem that he should cooperate and put up a privacy fence and satisfy his surrounding neighbors . The Mayor suggested Mr. Vogel get in touch with him and get it cleaned up. Ordinance #20-71-22 amending 1971 Budget Ordinance #20-70-21 was presented by Mayor Howell and read in fyll for second and final reading. Mr. Howell then declared the meeting in session for Public Hearing on said Ordinance. Notice of Public Hearing was posted in line with Charter requirements . Mr. Moorhead asked clarification of $20,000.00 transfer as appeared to be same account. Mr. Howell advised that it was being transferred from Sewer Construction Funds , which are from the sale of Minutes 9/27/71 Page #3 Sewer Bonds , to Regular Sewer Fund Construction Account to cover extensions of lines on Atlantic Boulevard to Mayport Road. No one appeared either for or against the Ordinance. Mayor Howell then declared the Public Hearing closed. Mr. Longo moved adoption of Ordinance #20-71-22 on second and final read- ing, seconded by Mr. Rosborough and carried. Mr. Vogel asked approval to Call for Bids to put aluminum siding on City Hall like that on the addition, or we will have to get a paint job which is a regular reoccurrence . It is in the budget. After discussion Mr. Longo moved approval to call for bids to be received October 11, 1971 at 8 :00 P. M. , seconded by Mr. Minton and carried. Mr. Vogel reported for the Committee on Mr. Dagley's junk yard. He advised there is not but one thing to do, or change the law, and that is that Mr. Dagley will have to find another location for his business for there is nothing in Atlantic Beach Ordinances that provide for junk yards, and does not see how this Commission without changing the Zoning can permit this to continue. People will ask what to do with junked automobiles and we'll have to cross that bridge when we come to it. Mr. Minton advised he is in accord with Mr. Vogel's report. Mr. Dagley advised he is going to stay in business , that he has some land outside Atlantic Beach City limits. He advised we' ll talk about the cars in Atlantic Beach and he'll get rid of some of them as he has enough land outside of Atlantic Beach. It seems this will solve the problem. Mr. Longo asked if he had moved the cars off the street. He advised he had not, but he would. He said we advised they couldn' t be there but didn't tell him to move them but he would . Mr. Moorhead stated he was struck with Mr. Dagley' s statement that he would move some of the cars; that would still leave a junk yard in Atlantic Beach. Mr. Howell advised that at the last meeting Mr. Dagley was ordered not to take more junk cars onto any property he now has in Atlantic Beach and he has one year from last meeting to get them off. The Mayor assumes that is what Mr. Dagley had reference to. Mr. Dagley advised it was . Mrs . Grage advised that the officials for the election on October 5, 1971 will be: Clerk : Mrs . Zoe' Moore Inspectors : Mrs. Helen Joseph, Mrs . Doris Hoke, 61/ Mrs . Anne Price, and Mrs. Enid Nelson Mayor Howell advised these have all had experience with voting f r I Minutes 9/27/71 Page #4 machines and since we are using County voting machines , they require that we use people who have had experience with the machines. There were no objections to these as named, so Mayor Howell advised they will be the poll workers for the Primary Election on October 5 , 1971. Mayor Howell advised the City Commission would meet as required by Charter on October 5, 1971 at 8:00 P. M. following the tabula- tion of the votes on the October 5th Primary Election. Mr. Hilliard stated many are aware we ran out of water yester- day and he requested the Commission to have Mr. Parks come up with a unit that will let us know when the reservoirs are low on water. Mr. Howell asked Mr. Parks if he could come up with such a system that would signal the Police Station when the reservoirs are low on water. Mr. Parks advised he thought he could. Mr. Longo moved that we ask Mr. Parks to come up with some plans and figure on this, seconded by Mr. Minton. Mr. Parks was asked if he could give an approximate figure on this and he advised he would hesitate to do so but would be glad to report back at next meeting of the Commission with a letter reporting on the subject. Following discussion the question was put and the motion carried. Mr. Vogel advised he has a letter from Jax Utilities that the water line oversize going to Pecan Grove Apartments on Mayport Road will cost $1720.00, and we authorized $1750. Also he reported that we received approval from the Board of Health to install the Sewer lines on East Coast Drive between 12th and 15th Streets .
