12-18-71 v r • MINUTES OF THE SPECIAL MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON SATURDAY, DECEMBER 18, 1971, AT 10:00 a.m. PRESENT: William S. Howell, Mayor-Conraissioner R. R. Rosborough F. W. Fogg L. W. Minton, Jr. D. W. Speed, Commissioners AND R. C. Vogel, City Manager Oliver C. Ball, City Attorney Adele S. Grage, City Clerk ABSENT: None The meeting was called in line with notice given at meeting of December 13, 1971. The meeting was called to order by the Mayor-Commissioner, Mr. Howell. Mr. Howell presented Ordinance #80-71-9 covering sewer service charges and read same in full. The Mayor then declared the meeting in session for Public Hearing on said Ordinance. Notice of Public Hearing was posted in line with charter requirements. No one appeared either for or against. Mayor Howell then declared the Public Hearing closed. Mr. Fogg moved passage of Ordinance #80-71-9 on second and final reading, seconded by Mr. Speed. There was a lengthy discussion as to the inequality in charges to the Beaches Aquatic Pool and Selva Marina Country Club compared to restaurants and other users. It was brought out that the Country Club serves meals has large parties, etc. , and their usage would be comparable to that of a restaurant. It was agreed the charges were not in line, but it was also agreed that the present Ordinance be passed then an Amendment Ordinance be presented including the Aquatic Pool and the Selva Marina Country Club in Item 3 of Section 1 "All Other Users. " Following the discussion, Mr. Howell put the question and the motion to adopt Ordinance #80-71-9 carried. Mr. Howell then presented in full in writing an Ordinance amending Ordinance #80-71-9 for passage on first reading by title only. Said Ordinance will include the Aquatic Pool and the Selva Marina Country Club in Item 3 of Section 1 entitled "All Other Users. " Mr. Speed moved that the rules be waived and the Amending Ordinance be passed on first reading by title only, seconded by Mr. Minton and carried. Date for Public Hearing will be December 27, 1971 at 6:00 p.m. r MINUTES OF SPECIAL MEETING December 18, 1971, 10:00 a.m. Page 2 Mr. Rosborough reported for the committee on the acquiring of 64 Saltair lots to be used as a park area. With the exception of 7 lots on Seminole Road across from the tennis courts, these lots are part of the interior lots lying between Sherry Drive and Seminole Road and north of the school area. Mr. C. T. Boyd, Trustee, has agreed to sell their 36 lots for the appraised total value of $7, 250.00 and then will take the amount in tax credit. Mr. Rosborough recommended and moved that the matter be referred back to committee to confer with Mr. Boyd as to the details of tax credit and advise him it is our intent to purchase as per agreement, seconded by Mr. Minton. There was a discussion in which Mr. Howell stated he feels we may have to go into condemnation on some of the remaining 28 lots. He asked the City Attorney what our position would be if we lost suit. Mr. Ball advised if we start we will have to follow through and he would suggest we most ahead cautiously. In the discussion it was agreed we go ahead with Mr. Boyd, then contact the other owners. It was also suggested we might be eligible for some Federal aid on a park project. Following discussion, Mr. Howell put the question and the motion carried. There being no further matters to be considered at this meeting, Mayor Howell declared the meeting adjourned. /ad/./,‘ / William .
