THE MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY
COMMISSION HELD ON MONDAY, JANUARY 12, 1970 AT 8:00 P. M.

The meeting was called to order by the Mayor-Commissioner, Mr.
Howell.
The Invocation was given by Commissioner Minton.
Minutes of the meeting of December 22, 1969 were approved as
written upon motion of Mr. Rosborough, seconded by Mr. Johansen
and carried.
Mr. Isaacs advised that the minutes indicated no one appeared
for or against the Ordinances at the December 22nd meeting and
he would advise that he had appeared against all three Ordi-
nances. This is hereby noted in these minutes, and correcting
minutes of December 22, 1969.
Mayor Howell recognized visitors present and called for any
business from the floor not on the Agenda. There was no business .
A letter was read from President Nixon acknowledging our
Resolution supporting his efforts in Vietnam for Peace, and
expressing his gratitude. Said letter will be posted at the
City Hall.
Mayor Howell advised we are in receipt of a bill for unpaid
ambulance charges for 1969. He advised we hear a great deal
from Jacksonville elected officials commenting on the "free"
ambulance service that we are getting from Jacksonville. Of
course they apparently are unaware that we are paying as much
taxes as anybody else in the Consolidated Government and that
also the City of Atlantic Beach guarantees payment to the City
of Jacksonville for any ambulance charges that are not paid by
Atlantic Beach citizens. This statement of 17 unpaid bills
is in amount of $319. 50, however, 4 of them are not ours, they
are actually in the City of Jacksonville and amount to $75.00.
Our net bill is therefore $244. 50, and he suggests we pay this
amount and return the other 4 bills to City of Jacksonville
advising they live in City of Jacksonville jurisdiction. The
other bills have been turned over to our Chief of Police to
personally call on these people and see why not paid and if can
pay. These when collected will reimburse us and apply against
our payment of $244. 50. Mr. Johansen moved that we pay the City

of Jacksonville $244. 50 from the emergency account and that the
Chief of Police endeavor to collect the unpaid ambulance service
bills, seconded by Mr. Minton and following further discussion
the question was put and the motion carried.
Mr. Howell announced that the Duval Delegation will be at
Jacksonville Beach on February 2 , 1970 at 7 : 30 P. M. for a meeting
with all Beach Municipalities.
In this connection he advised that our Attorney has prepared a
bill in regards to the interest rate. Mr. Ball advised the bill
basically changes our limitation of 6% to 71% on G. O. Bonds or
revenue certificates according to the bill passed in Special
Session of the Legislature. This gives us clear authority to
do this, even though the Legislative Act states that all laws
in conflict are repealed. We want to do this in order to have
a clear Charter in this respect. There was discussion following
which Mr. Johansen moved that the City Attorney be authorized
to prepare the necessary bill to cover for prefiling and
presentation to the Duval Delegation, seconded by Mr. Rosborough
and carried.
Ordinance #90-70-35 amending Ordinance #90-59-3 was presented for
second and final reading and read in full by Mayor Howell . Notice
of Public Hearing was posted in line with Charter requirements.
Mr. Howell then declared the meeting in session for Public
Hearing on said Ordinance which designated certain areas as
Residence "C-1" which limits these areas to trailer parks for
residential purposes only. There was a general discussion as to
the area covered and the reason for the new area. It was brought
out that we are establishing a zoning area for trailer parks
only and are going to eliminate trailer parks from Business "B" .
It was decided to adopt this Ordinance and then present at next
meeting an amending ordinance taking trailer parks out of
Business "B" . Following further discussion Mr. Howell declared
the Public Hearing closed. Mr. Minton then moved the passage
of Ordinance #90-70-35 on second and final reading, seconded
by Mr. Rosborough and carried.
The Police and Fire Department reports for the year 1969 and
the Police Department report for December, 1969 were received
for information and filing.
Ordinance #47-70-1 was presented in full in writing for passage
on first reading by title only. Said Ordinance adopts the
revision and codification of the Ordinances of the City of
Atlantic Beach which is entitled "The Code of the City of
Atlantic Beach, Florida" . Mayor Howell read the title following
which Mr. Rosborough moved passage on first reading by title
only, seconded by Mr. Minton and carried. Public Hearing was
set for January 26, 1970 at 8:00 P. M.
Mr. Vogel advised his mileage for December; 1969 was 489 miles,
and Mrs. Grage' s was 200 miles.

Mayor Howell presented Resolution 70-1 directing the City Clerk-
Treasurer to open an account in First National Beach Bank for
Police Court costs collected in line with provisions of Chapter
69-111 Laws of Florida. Mr. Johansen moved passage of said
Resolution, seconded by Mr. Minton and carried. Copy of
Resolution 70-1 is attached to these minutes and made a part
hereof.
Mr. Hilliard advised that about one-half of the streets in
Royal Palms are coming apart following the heavy rains, and
something needs to be done immediately. If resurfacing isn't
done soon, we will lose the base if we have much more rain and
traffic. Following a discussion of the situation, Mr. Vogel
and Mr. Hilliard were directed to make a study of the streets,
call for bids, and bring back to next meeting.
There being no further business, Mayor Howell declared the
meeting adjourned.

RESOLUTION # 70-1
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
ATLANTIC BEACH, FLORIDA, That
The City Clerk-Treasurer be and is hereby directed to
deposit all monies collected under the provisions of
Chapter 69-111 Laws of Florida in the First National
Beach Bank in an Account to bknown as "Police Court
Cost Fund", and that
Said monies be deposited in th_2 Gmeral Fund at said
bank and transferred monthly to the "Police Court Cost
Fund",
AND BE IT FURTHER RESOLVED THAT,
Funds on said account be subject to withdrawal only
upon check signed on behalf of the City by the City
Treasurer or the Assistant City Treasurer and counter-
signed by either the Mayor-Commissioner or the Mayor
Pro-Tem.
