M. Present: William S. Howell, Mayor-Commissioner A. J. Longo R. R. Rosborough L. W. Minton, Jr. Preben Johansen, Commissioners and R. C. Vogel , City Manager Oliver Ball, City Attorney Adele S . Grage, City Clerk The meeting was called to order by the Mayor-Commissioner, Mr. Howell . The Invocation was given by Commissioner Minton. The minutes of the meeting of March 9, 1970 were approved as written upon motion of Mr. Longo, seconded by Mr. Minton and carried. Mr. Howell recognized visitors and called for any business from the floor not on the Agenda. Mr. Bob Price spoke in reference to the dog situation and the conduct of the dog catcher, and asked for a clarification of the Ordinance. Miss Charlotte Reid also spoke on the subject, as did Mr. George Bull. There was discussion as to what is a "stray" dog or a dog "running at large" . The Reid dog was about 30 feet from them when the dog catcher stopped and picked it up and there was some unpleasant altercation before they got the dog from him. There was a lengthy discussion during which Mayor Howell advised he felt a dog should only be picked up on written complaint of a citizen. Mr. Minton moved we form a citizens ' committee to investigate the situation and give us an answer as to information to give to public as to what the Humane Society does do. The motion had no second. After further discussion Mr. Johansen moved that the "Dog" ordinance be amended that no dog be picked up without a written complaint by a citizen, seconded by Mr. Longo. Mr. Minton made a substitute motion that the matter be tabled and put in Committee for report back at next meeting, seconded by Mr. Rosborough and substitute motion carried. Mayor Howell appointed Commissioners Minton and Rosborough and City Manager Vogel as Committee. Mr. Howell advised that in figuring the 1969 taxes payable from the balance due the Selva Marina Realty Company in line with Court Stipulation, we did not allow any discount. The Selva Marina Realty Company feel they are entitled to 4% discount, since we had the balance on November 1, 1969. Mrs. Grage advised that it was agreed last year that we would not charge penalty interest on back years nor give discount on the current tax, and she issued these receipts for 1969 accordingly. There was discussion during which it was advised that the discount amounts to $19.40, and it was agreed that we allow it. Therefore Mr. Longo moved adoption Minutes 3/23/70 Page #2 of Resolution #70-11 to refund to Selva Marina Realty Company the $19.40, seconded by Mr. Rosborough and carried. Copy of said Resolution is attached to these minutes and made a part thereof. Mr. Harcourt Bull has requested that we apply the balance due the Selva Marina Realty Company under this Court Stipulation to taxes due on Saltair lots 765 and 766 which are owned by the Selva Marina Realty Company. They were not in the suit, but in this way we would balance out the Selva Marina part of the stipulation. The Selva Marina Realty Company will pay difference in what is due on these lots and the stipulation balance. Mr. Longo moved that the balance be applied against Lots 765 and 766 as suggested with Selva Marina Realty Company paying balance due, seconded by Mr. Minton and carried. Mr. Vogel asked for approval to call for bids on the Jordan Sewer extension. The work will not be done until the Jordans make the deposit as previously decided on. Mr. Longo moved that the City Manager call for bids as requested, seconded by Mr. Minton and carried. Mr. Vogel asked approval to issue a permit for a prefab building at 155-157 Levy Road. He advised it would meet all building code requirements and zoning, but our Ordinance requires Commission approval for buildings in business zone. Following discussion Mr. Longo moved approval for permit as requested, seconded by Mr. Johansen and carried. Mr. Vogel presented Resolutions#70-6, #70-7, #70-8, #70-9 and #70-10 authorizing the removal of unsafe and dangerous structures from specific properties for passage. Mayor Howell read the Resolutions, and following discussion Mr. Minton moved adoption of Resolutions #70-6 through #70-10, seconded by Mr . Johansen and carried. Copies of said Resolutions are attached hereto and made a part hereof. Mayor Howell presented Ordinance amending Zoning Ordinance #90-59-3 specifying lot coverage of 950, 1050 and 1150 square feet in Residence A and A-1 districts. Mr. Minton moved Public Hearing be continued from day to day, seconded by Mr. Rosborough and carried. An Ordinance amending Zoning Ordinance #90-59-3 specifying lot coverage in Residence A and A-1 districts in more detail, was presented in full in writing for consideration on first reading by title only. Mr. Howell read the title in full . Mr. Longo moved that the rules be waived and said Ordinance be passed on first reading by title only, seconded by Mr. Minton and the vote was: Aye: Longo, Minton, Rosborough, Howell Nay: Johansen Whereupon the Mayor declared the motion carried and set April 13, 1970 at 8: 00 P. M. for Public Hearing. Minutes 3/23/70 Page #3 Mr. Vogel presented a report on the drainage situation in Saltair in area of Miss Rowena Eaton' s property. Copy of report is attached to these minutes and made a part hereof. Mr. Johansen asked as to figures on houses which have been built in last several years. It was advised that they have been tabu- lated and a report would be ready by next meeting. Mr. Minton stated he thinks Mr. Hilliard has done an excellent job on the recreational facilities. Mr. Rosborough agrees and feels Mr. Hilliard should be commended. The Mayor recognized Mayor Futch and Councilmen Parsons and Griffin from Neptune Beach as visitors in the audience. Mr. Howell presented Resolution #70-12 expressing our congratula- tions and thanks to the Jacksonville University Dolphins Basketball team for their ability and sportsmanship and the recognition the Jacksonville area received due to their accomplishment in the NCAA Tournament. Mr. Johansen moved passage of said Resolution with copies to be sent to Coach Williams and President Spiro of Jacksonville University, seconded by Mr. Longo and carried. Copy of Resolution #70-12 is attached hereto and made a part hereof. Mayor Howell advised that he and Mr. Vogel had attended a meeting this afternoon of the Duval Delegation. He reported that the City of Jacksonville has withdrawn their bill relative to millage and that the taxing powers will remain with the Cities of Atlantic Beach, Neptune Beach, Jacksonville Beach and Town of Baldwin. He feels we are in a good position. Mr. Longo stated he feels the Mayors have done an outstanding job in representing us at these meetings.
