Adjourn t MINUTES OF THE MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD ON MONDAY, APRIL 27, 1970 AT 8:00 P. M. AT THE ATLANTIC BEACH CITY HALL. Present: William S. Howell, Mayor-Commissioner Preben Johansen , L. W. Minton, Jr. , and R. R. Rosborough , Commissioners and R. C. Vogel, City Manager Oliver Ball, City Attorney Adele S . Grage, City Clerk Absent: Arthur J. Longo, Commissioner (Out of City) The meeting was called to order by the Mayor-Commissioner, Mr. Howell. The Invocation was given by Commissioner Minton. Minutes of the meeting of April 13, 1970 were approved as written upon motion of Mr. Minton, seconded by Mr. Johansen and carried. Mr. Howell recognized visitors and called for any business from the floor not on the Agenda . Dr. David Cheshire spoke in regards to the drug problem as relates to Seminole Beach and our City and suggested the Commission form a Committee to study and make suggestions to eliminate this problem. He also spoke as to the fact that all the traffic going to Seminole Beach has to go through Atlantic Beach , and it affects every family directly or indirectly. Last summer was pretty bad and this summer it will be worse. Mrs. Frances Smith and Mr. Henry Isaacs both spoke in favor of Dr. Cheshire ' s suggestion. Following those statements Mr. Howell called for a motion for a Committee to study this dope problem as it pertains to Atlantic Beach. Mr. Johansen moved that the Mayor appoint a Committee of qualified people such as law enforcement officers and doctors, to make recommendations, and the Committee needs to be people who know what they are doing as this is a very serious problem, seconded by Mr. Minton and carried. On question by Mrs. Lynwood Dyal as to whether the Committee would study both drug and traffic, Mr. Howell advised the Committee would be in line with Dr. Cheshire ' s request on drug abuse. He will announce the Committee later. Mrs . McAllister said on behalf of Mrs . Hatch she wished to thank the Public Safety Department for their speed and efficiency in her recent emergencies. Chief Stucki advised that with reference to the safety of the citizens in Atlantic Beach concerning drug traffic and everything, he strongly recommends that we suspend or revoke the license granted the Mexiteria, Mamas Tacos., This request is based on a discussion with our City Attorney concerning certain legalities of our City Ordinance and State laws. After conferring with him and with what information we have, we have established beyond Minutes 4/27/70 Page #2 any shadow of a doubt that the Mexiteria is frequented on extremely numerous occasions by known drug sellers who have previously been arrested for these charges, and who are presently being arrested daily for these charges. They spend unusually large amounts of time in this area. We have arrested juveniles on these premises glue sniffing, and vagrants who had in their possession LSD and needed immediate medical supervision. Any day that we are looking for a child absent from school this is the first place we go and in most cases find them. On several occasions the operator of this business has been warned and told that if the situation wasn't cleared up that this would be the next step. Mrs . Donnell advised she had talked to the Chief and had agreed to have her place bugged, and that she was trying to do what the law says do. She says she knows things are going on but she was trying to work with the police, and that he did summons her to his office several times. Due to Mrs. Donnell ' s emotional upset, Mr. Howell went on to further busi- ness then resumed to this hearing. Mrs. Lynwood Dyal and a gentleman from Neptune Beach advised they had eaten in there and had never seen anything wrong. The gentleman' s daughter Laura works part time for Mrs. Donnell and advised she had known Mrs. Donnell to call the police. Mr. John Dyal stated he understood Mrs. Donnell was notified as late as this morning and did not have time to get an attorney. Mrs. Donnell again advised she did know these things went on. There was a long discussion as to who is responsible for what goes on in a place of business. Chief Stucki advised that he had not received 100% cooperation, that when he had conferences with Mrs. Donnell it was at his request. Mrs. Donnell advised she would be willing to change her business to a 'take-out" only so there would be no loitering. Others who spoke on the subject were Mrs. Frances Smith, Mr. Thomas Fields, Mrs. Mary Beth Copeland and others. Mr. Don Goodling advised he supported the Chief and does not think he would make the recommendation lightly. Following the lengthy discussion Mayor Howell declared the Public Hearing closed and suggested a special meeting for Thursday night, April 30th, at 8:00 P. M. which will give Mrs. Donnell time to secure counsel if she desires to, and we ' ll proceed then. Mr. Johansen moved a special meeting be set for Thursday night at 8:00 P. M. to consider further and make decision, seconded by Mr. Rosborough and carried. Mr. Vogel advised we are operating under the City of Jacksonville Plumbing Code while most of the cities in Florida have adopted the Southern Standard Plumbing Code. The reason is that plumbing can be done cheaper under this Code. The Southern Standard Plumbing Code, the Southern Standard Building Code, and Southern Standard Electrical Code are all separate. As to the Electrical Code, our franchise with the City of Jacksonville takes care of that. The Southern Standard Plumbing Code is updated each year as is the Building Code, while the one we use hasn't been changed in years. Jacksonville Beach has gone to V Minutes 4/27/70 Page ri3 the Southern Standard Code due to the modular houses being built. He recommends Commission consider and adopt. The new code allows plastic pipe that has been proven. Mr. John Dyal, who is an architect, on inquiry by Commission advised he would favor using Southern Standard Plumbing Code. As it will take an Ordinance, Mr. Rosborough moved that an Ordinance be pre- pared for presentation at next meeting to adopt the Southern Standard Plumbing Code, seconded by Mr. Minton and carried. Mr. Vogel advised that Mr. Jordan was unhappy with the single bid received on the sewer extension and has requested we call for new bids. If no objections he would like to call for bids to be received at next meeting. There was no objection. Mr. Howell advised there is a lot on 10th Street on which we are receiving numerous complaints, The lot is extremely low and continues to hold water. The Mosquito Control has been up there looking at it and made complaints on it as it is a breeding area for mosquitoes. In discussing with City Attorney we believe we can fill this lot under the nuisance ordinance and assess against the property. The decision was for necessary papers to be prepared for presentation at next meet- ing. The report was received from the Committee recommending acceptance of the bid of Detroit Diesel Engine Division for the auxiliary engine for water plant. Mr. Johansen moved acceptance of recommendation of the Committee, seconded by Mr. Minton and carried. Copy of report attached hereto and made a part hereof. Bids were received on a new pick-up truck as follows: The Big "R" Chevrolet $2,011. 58 Lynch-Davidson Ford 2, 082 . 01 Southside Dodge 2, 055. 52 Quinn R. Barton Company 2, 242.70 Mr. Rosborough moved they be referred to Committee for study and recommendations, seconded by Mr. Johansen and carried. Mr. Howell appointed Mr. Rosborough, Mr. Vogel and Mr. Hilliard as Committee. Mr. Vogel announced his mileage for March was 477 and Mrs. Grage' s was 200 miles. Approval was requested for purchase of a 2" meter with fittings from Account #1501., Mr. Rosborough moved approval of the purchase, seconded by Mr. Minton and carried. Mr. Minton thanked the Chief for cleaning up the disorder at the Park recently. There is a newly formed tennis club and a request has been received for the use of our Courts for two weekends, May 2nd- 3rd and May 9th-10th. The Courts will be posted and there Minutes 4/27/70 Page *4 was no objection. The Beaches Hospital Auxiliary have expressed their thanks for the part we had in putting up the new lighted directional sign.
