COMMISSION HELD AT THE CITY HALL ON THURSDAY, APRIL 30, 1970
AT 8:00 P. M.

The meeting was called to order by the Mayor-Commissioner,
Mr. Howell.
The Invocation was given by Commissioner Minton.
Mr. Samuel S. Jacobsen, Attorney representing Mrs. Lucille
Donnell, stated that on behalf of Mrs. Donnell she would like
to turn in her present license and move for the issuance of
a "take-out" business in order to make the business more
desirable for the City. He advised that this is Mrs. Donnell' s
own decision and that she has not been pressed or forced to
do so.
Mr. Howell asked if she was willing for the Police Department
to have strict surveillance?
Mr. Jacobsen advised that she wants to cooperate with the
police and is hopeful the new type business will not induce
loitering. He advised he had been in conference with our City
Attorney on the matter.
Chief Stucki stated that in view of what Mr. Jacobsen has
said and the Mayor' s stipulation, it is satisfactory with
him.
Mr. Johansen moved that Mrs. Donnell will turn in her present
City license to the City Clerk and be granted a "take-out"
food and non-alcoholic beverage license only with no con-
sumption on premises, and that she will cooperate fully with
the Police Department over any problem that exists or might
exist in the future, seconded by Mr. Rosborough. Mr. Jacobsen
advised that at some future date, providing the difficulties
are cleared up and this good face effort should succeed, that
Mrs. Donnell may apply for a license like she has at present
without prejudice.
Mr. Rosborough feels will be a good move, as Mrs. Donnell has
suggested she would like to try on this basis and that this
will help alleviate the problem.
Mrs. Donnell advised she is already changing her equipment
around and will be here in the morning to turn in old license
and get new one if approved.

Mr. Don Goodling asked to speak but Mr. Howell advised that
the Public Hearing was closed Monday night and this meeting
is for the Commission to hear Mrs. Donnell and her Attorney,
and the Chief, and make a decision.
On an inquiry by Mr. John Weldon, Mr. Jacobsen stated he had
had no meeting with the City Commission and did not know some
of the gentlemen, but that he had had conferences with the
City Attorney, the Chief of Police and the Mayor.
The Mayor then called for the question and the vote was:
Aye: Johansen, Rosborough, Howell
Nay: Minton
Whereupon the Mayor declared the motion carried.
There being no further business the Mayor declared the meeting
adjourned.
