Adjourn r MINUTES OF THE MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, FEBRUARY 10, 1969 AT 8:00 P. M. Present: William S. Howell, Mayor-Commissioner Louis C. Holloway, Jr. Arthur J. Longo Robert R. Rosborough, Commissioners and R. C. Vogel, City Manager Oliver C. Ball, Acting City Attorney Absent: John W. Weldon, Commissioner (Out of City) Adele S. Grage, City Clerk (Illness in Family) The meeting was called to order by the Mayor-Commissioner, Mr. Howell. Mr. Vogel will be Acting City Clerk, with Mrs. Beverley Vogel taking notes. The Invocation was given by Commissioner Holloway. Upon motion of Mr. Rosborough, seconded by Mr. Holloway and carried, the minutes of the meeting of January 27, 1969 were approved as written. Upon motion of Mr. Longo, seconded by Mr. Holloway and carried, the minutes of the special meeting of February 6, 1969 were approved as written. Mayor Howell recognized visitors present and called for any business from the floor not on the Agenda. There was none. Bids were next received on the dump truck. Copy of certified proof of publication covering Call for Bids is attached hereto and made a part hereof. The bids were as follows: Big R Chevrolet Co. $5, 561. 73 Duval Motor Co. 6, 142 .81 Lynch-Davidson Ford Co. 6, 328. 76 Massey Dodge Co. 6, 048.70 Mr. Rosborough moved bids be turned over to Committee for study and report back at next meeting, seconded by Mr. Longo. Mr. Longo was appointed Chairman. The motion was carried. Ordinance #40-69-7 amending the Jacksonville Electric Authority Franchise Ordinance #40-69-6 by repealing Section VI and inserting a new Section VI therein was presented for second and final reading. Mr. Howell read the Ordinance in full, then declared the meeting in session for Public Hearing on said Ordinance. As no one appeared either for or against said Ordinance, the Mayor declared the Public ' Hearing closed. Mr. Longo moved passage on second and final reading, seconded by Mr. Rosborough and carried. Minutes 2/10/69 Page #2 Mr. Holloway presented and read the report of the Committee on street resurfacing. He advised it is a change from one previously presented. The footage on Sailfish, Saratoga and Forrestal was reduced, 7th Street and Robert Street were added, and Royal Palms Drive will remain as originally recommended. The total estimate for this street resurfacing will be $10, 926.00 which will leave $7, 000.00 to $8, 000.00 for other street repairs during the year. There was discussion following which Mr. Rosborough moved the recommendation of Committee be accepted and call for bids be approved, seconded by Mr. Longo and carried. Approval was requested to purchase three (3) 1" meters from Account #1501 in the amount of $243. 00. Mr. Longo moved approval, seconded by Mr. Holloway and carried. Mayor Howell presented and read Resolution #69-2 creating a Housing Authority for the City of Atlantic Beach. Mr. Longo moved passage of Resolution #69-2, seconded by Mr. Rosborough. There was discussion in which Mr. Holloway advised, according to the Attorney, the City relinquishes all rights and has no authority over them and he would like to see some control. It was brought out that our Zoning and Southern Standard Building Code, as well as sewer, water and street requirements same as for private indi- viduals, would apply, and control to that extent. They will only handle when Federal funds are needed to subsidize rental on Housing project, and such funds are only available through Housing Authority. We have as much control over the building under this program as we do private individuals, and if privately owned will be on tax roll as any other property. It was determined that we do need some low-cost housing and prefer to handle through our own Housing Authority made up of local individuals who know our situations. There was further discussion during which it was brought out that only way can abolish the Housing Authority is to fail to appoint or reappoint them. Following the discussion the Mayor put the question and the motion carried. Copy of Resolution #69-2 is attached hereto and made a part hereof. The Resolution appointing members of Housing Authority was passed to next meeting on request of the Mayor. The Public Works report was received for information and filing. The report of the Police Department for the month of January, 1969 was received for information and filing. Mr. Vogel presented a map showing paving done in Atlantic Beach from 1965 to 1968 in various colors according to years, and pre- sented a report as to costs, etc. and also as to requirements in subdivisions and amendment to same passed in 1961. Copy of his report is attached hereto and made a part hereof. There was a lengthy disucssion of an amendment as to paving and our policy to cover. At present in new subdivisions there are paving require- ments for developers, but in other areas of City our policy has been on new paving to assess costs percentage-wise to property owners but never more than benefit derived therefrom. Mr. Howell Minutes 2/10/69 Page #3 advised he suggests caution as we do not want to get in unten- able position as to paving, curbs, gutters, etc. Mr. Vogel advised he would just like an Ordinance as regards subdivisions, rescinding 1961 amendment. He is to prepare an Ordinance for consideration at next meeting. Mr. Vogel advised that some individuals are on the cut-off list on utilities each quarter, going full 10 or 15 days over delinquent date. We send out notices and they take the full time. There is a $2 .00 cut-on charge, and Mr. Vogel would like to change to a $2 .00 delinquent charge that will be effective immediately on becoming delinquent whether cut off or not. There was discussion and Mr. Vogel was advised to get with City Attorney and if legal, prepare Ordinance for consideration at next meeting. The City Manager ' s automobile expense for 451 miles in the amount of $45. 10 and the City Clerk ' s automobile expense for 220 miles in the amount of $22 .00 were presented for approval. This to be paid from Account #404 which includes tolls and mileage. Mr. Longo moved approval of payment, seconded by Mr. Holloway and carried. My Commission Expires -57.23.-72 February 5, 1969 MEMO TO CITY COMMISSION: In compliance with the City Commission' s request that I prepare a map showing street resurfacing for the last 4 years, I here- with submit this map for your information. The total cost in 1965 for street resurfacing was $7, 960.00; in 1966 it was $10,875.00; in 1967, $8, 233.00, and in 1968, $10, 286. 00. At the Commission meeting of January 13, I was instructed to pre- pare a list of streets which, in my estimation, needed resurfac- ing on a priority basis. This was done, and the only criteria that established this in my mind was curbs and gutters, drainage, and need. The geographical location in the City had no bearing in my decision as I consider the entire City of Atlantic Beach one community. The City of Atlantic Beach, from its inception until 1958, to my knowledge, did not have any regulations governing minimum standards for subdivisions being platted within the City limits. In 1958 an Ordinance was passed, No. 67-58-1, which was for the purpose of setting up minimum standards in utilities, street improvements, etc. In this Ordinance, Section 4, "C" provides, and I quote: "Pavement shall be constructed with a six (6) inch limerock stabilized base (300# per sq. yd. ) and a one (1) inch asphaltic concrete surface course as outlined in Florida State Road Department Specifications dated April 1, 1954" . In 1961 an amendment was passed, and, in my opinion, this is the source of our problem today in the Royal Palms Subdivision, inasmuch as the amendment allowed an alternative, i.e. , "double surface treatment" . This is the clinker, and I suggest that this Commission repeal this alternative and revert back to asphaltic concrete, based on the latest State Road Department specifications. In developing a Subdivision, the cost of utilities, street and drainage improvements is naturally added to the cost of the lots, and in the end the buyer is paying for the improvements serving his property. In the case of platted property within the City that has not been improved with sewers, water, curbs, gutters and drainage improvements, precedent has been established down through the years that adjacent property be assessed for pro- rata costs of improvements, and each project has been handled by Ordinance covering each specified improvement. lir 1 Memo to City Commission Page #2 February 5, 1969 The resurfacing of existing paved streets and the replacement of deteriorated sidewalks has been considered as maintenance and no consideration has been given to assessing adjacent property for this type of maintenance, however, when we get into installing sidewalks or pavement where none has existed it may be considered by this Commission as being an improve- ment to the adjacent property worthy of assessment. It has been suggested that we have a Master plan. I would like to point out that we now have a Master sewer plan, and, in my opinion, before we expend any more funds for Master plans a low cost preliminary plan be made for financing and implementing a Master plan for sewer, storm drains, curbs and gutters and paving, in that order. WHEREAS, it is apparent that a need exists for a Housing Authority in the City of Atlantic Beach, Florida, and WHEREAS, it is the desire of the City Commission of the City of Atlantic Beach, Florida, that such a Housing Authority be formed, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, FLORIDA, AS FOLLOWS: That the City Commission of the City of Atlantic Beach, Florida, hereby determines, finds and declares in pursuance of the "Housing Authorities Law" of the State of Florida, that: 1. Insanitary and unsafe inhabited dwelling accommo- dations exist in the City of Atlantic Beach, Florida. 2. There is a shortage of safe and sanitary dwelling accommidations in the City of Atlantic Beach, Florida, available to families of low income at rentals they can afford; and 3. There is a need for a Housing Authority in the City of Atlantic Beach, Florida. BE IT FURTHER RESOLVED THAT this Resolution be effective immediately on passing.
