On May 26, 2009, the above referenced property was granted a waiver from the Land Development
Regulations at a public hearing by the City Commission of the City of Atlantic Beach.
Specifically waived are the provisions of Section 24-171 (f), the Commercial Corridor
Standards, prohibiting the use of chain-link fences within the Commercial Corridor, upon
finding by the City Commission that it is not the intent of the Commercial Corridor
Development Standards to apply to properties in residential use, and the subject property is
within a residential subdivision and has been in residential use since development;
and subject to the following condition:
• This waiver shall not exempt the property or the property owner from any other provision of
the Land Development Regulations, as may be amended, regulating the condition of fences
which are in a state of disrepair, dilapidated, in poor condition, or a safety hazard to clear
vehicular sight distance.
The undersigned certifies that the above stated action of the City Commission is a true and correct
rendition of the action by said Board as the same appears in the record of the City Commission
minutes.
