MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY
COMMISSION HELD AT THE CITY HALL ON MONDAY, OCTOBER 27, 1969

The meeting was called to order by the Mayor-Commissioner, Mr.
Howell.
The Invocation was given by Commissioner Rosborough.
The minutes of the meeting of October 13, 1969 were presented
for approval. Mr. Weldon moved that said minutes be approved
as written, seconded by Mr. Longo. Mr. Henry Isaacs stated
that the minutes were in error in showing that at the Public
Hearing on Ordinance #42-69-1 "No one appeared either for or
against" , as he had spoken for the Ordinance to be amended to
include past Mayors. Mr. Weldon amended his motion to approve
minutes to show Mr. Isaacs ' request in behalf of and for the
benefit of former Mayors, seconded by Mr. Longo, and the
substitute motion carried. Mr. Howell declared the minutes as
written approved with this correction to show that Mr. Isaacs
spoke to amend the Ordinance.
Mr. Howell recognized visitors present and called for any busi-
ness from the floor not on the Agenda. There was none.
Mr. Howell presented the Honorable Walter Dickinson, Councilman
representing District 1 on the Consolidated City of Jacksonville
Council. Mr. Dickinson stated that Mr. Vogel invited him to
present the latest information available on the proposed
Recreational Park to be located north of Atlantic Beach with
entrance on Mayport Road. He advised the City of Jacksonville
has funds available in the amount of approximately 11 million
dollars at present to purchase that area from the Rogers place
north to the Mayport Naval Station fence and east of Seminole
Road which will be approximately 7430 feet of Ocean Front. It
is planned to close Seminole Road. He advised this will be a
first-class park , and this area is just the first phase of the
project. They plan to acquire land from Seminole Road to
Mayport Road later as money is available, but not as much as
originally planned as feel it would be better to leave a larger
buffer zone between the Park and the City of Atlantic Beach.
He had talked to various ones involved in the planning and was
assured that although there would be some concessions in the Park
they would not interfere with present businesses in the Beaches

Area. There is no plan to change the situation at Mayport Road
and Atlantic Boulevard, however, he will talk to Mr. Sollee
further about this. The future plans include a four lane road
built on the right-of-way of the old JM&P Railroad, which right-
of-way belongs to the County and is from Fort Caroline Road
east to Seminole Road. The Commissioners expressed concern
over traffic problem at Mayport Road and Atlantic Boulevard.
Also hope that the project will proceed in orderly fashion,
adequate parking facilities provided, and Atlantic Beach be
protected during time of development. The Commission expressed
their appreciation of Mr. Dickinson' s coming and making this
presentation.
Mr. George Bull spoke in rebuttal advising that there were no
plans yet made on the project and it was just an idea. He
stated the City of Jacksonville is acquiring land haphazardly
without an overall concept of what is needed and how they will
operate.
It was suggested by Mr. Longo and he so moved that a member of
the City Commission be appointed to work with Mr. Dickinson
to see to the City of Atlantic Beach ' s interests as regards
traffic on Seminole Road, or any other developments that might
affect Atlantic Beach, seconded by Mr. Holloway and carried.
Mr. Howell appointed Mr. Longo to work with Mr. Dickinson.
Mayor Howell presented for second and final reading Ordinance
##42-69-1 covering annuity for certain employees and read same
in full. Notice of Public Hearing was posted in line with
Charter requirements. Paragraph 2 of Section 2 is amended as to
military service. Mr. Howell then declared the meeting in
session for Public Hearing on said Ordinance. Mr. Isaacs again
made his request for an amendment to the Ordinance so that
former Mayors, "Judge" Reid and "Fritz" Rosborough will be
included in it and not himself. As no one else appeared either
for or against said Ordinance, Mr. Howell declared the Public
Hearing closed. Mr. Longo moved passage of Ordinance ##42-69-1
on second and final reading, seconded by Mr. Holloway and
carried. Whereupon Mr. Howell declared Ordinance #42-69-1
passed on second and final reading.
A letter was read from the Daley Outdoor Advertising Company,
Incorporated, requesting permission to illuminate the Ocean
State Bank outdoor bulletin with fluorescent lighting. Mr.
Howell advised this goes back to the Sign Ordinance wherein all
existing billboards were "grandfathered" in and may remain
non-conforming until such time as their condition requires
replacement, relocation or material repair, and the question
Mr. Vogel would like clarified is whether the lighting of this
sign would be in conflict with Ordinance, does it increase the
non-conforming use, etc. Mr. Ball ' s opinion was that it would
increase the non-conforming use and would be in violation of
the Amendment. He believes it was the intent of the Commission

that over a period of time obsolescence would eliminate these
signs. On question from Mr. Holloway if this would be setting
a precedent, Mr. Ball advised it would be in violation of our
Ordinance and would be setting a precedent. There was further
discussion in which Mr. Ball repeated his opinion as to intent
of Amending Ordinance *60-66-3 at time when passed. Mr. Holloway
believes if the Commission so desires, the Ordinance should be
changed, for if we make an exception, it will be same thing as
changing the Ordinance, and if anyone else requests this would
be a precedent. Mr. Howell agreed if anything done then the
Ordinance would have to be changed. Mr. Weldon advised he
can't see that the electrification of the sign would come under
replacement, relocation or material repair. On question, Mr.
Ball advised it would be a material change and under the
Ordinance it is not allowable and he doesn't see how we can
stretch the Ordinance and violate its order or intent. The
City Manager will notify that under the Ordinance it is not
allowed.
The following bids were received on heating and air conditioning
the City Hall as per Specification *69-8:

Mr. Longo moved that the bids be received and referred to
Committee for recommendation, seconded by Mr. Holloway and
carried. Mr. Howell named Commissioners Rosborough and Longo
with City Manager Vogel as Committee.
The representative of the DeChaine Company advised that no-
body makes an oil fired furnace which is UL approved, for
attics. He gave details of requirements for furnaces in
attics and advised he gave Mr. Vogel this information but after
specifications had gone out. All the bids were on the specifica-
tions as sent out, and they do not call for UL inspection.
Municipal Court dockets for October 13th and 20th, 1969 were
received for information and filing.
The City Manager' s report was received for information and
filing. Mr. Weldon stated he thinks it is a poor situation for
the City to see the 100 cars more or less parked haphazardly
behind the places on Atlantic Boulevard west of Mayport Road.
There was a discussion in which it was stated the businesses
advised they had no objection to the parking, there is no charge,

and the owners of cars are customers. Mr. Howell asked Mr.
Ball to pursue and see what can be done to stop this - see if
there is something in some ordinance to cover.
Mr. Longo asked as to the landfill situation, if they have
capped off and are they cleaning up. Mr. Hilliard advised they
are in process of capping now.
There being no further business, Mr. Howell declared the
meeting adjourned.
