Following is my understanding of your proposal for the project and future maintenance. If this letter correctly describes your proposal and you agree to the terms and conditions,then please sign the bottom of this letter and return it to my office so that we will have a record of our agreement for the future. - You will be removing native plants on approximately 10 to 20 feet of land you own between the eastward most end of your lawn and the bulkhead and replace those plants with sod that you will maintain. You have asked permission of the City to remove the native plants on the north side of the City's beach access which is adjacent to your lawn. This area has an estimated size of 10 by 15 feet and is located on the City right of way just north of the beach access sidewalk. - You will install sod not only on the portions of your private property but also on the City right of way described above. No other landscaping materials will be installed on the right of way without my prior written approval. - You will provide the irrigation for this newly sodded area along the right of way from your private system in your yard. You will mow and otherwise maintain the area as you have for the other sodded and planted areas in the City's beach access adjacent to your lawn. - You have also offered to provide the irrigation water for the entire beach access, both north and south sides of the access sidewalk, at your expense. We understand that you will disconnect the irrigation from the City's potable water system and connect it instead to your private well. No remaining cross connection between the city system and your well water will remain after the conversion is made. From then on you will provide the irrigation water for the landscaped areas on both sides of this beach access at your expense and maintain the irrigation system. It is the city's understanding that the mowing of the sod on the south side of the beach access(south of the sidewalk) will continue to be done by your neighbor on that side and that you will have no responsibility for this portion of it(other than irrigation described above) . This project included running a water line and installing an automatic irrigation system, complete landscaping of the access and, at my sole expense, on-going lawn and plant maintenance of the access. At the time we received approval to make the improvements I paid the tap-in fee (which I believe was $350. 00) to have the water line run across Beach Avenue and the City was kind enough to donate one pallet of sod and install an irrigation meter (Meter #2) for the south portion of the access. There is an additional irrigation meter (Meter #1) for our yard that also waters the north portion of the access. I also paid for the installation of the access sprinkler system which was an additional $250.00. At the time we made the improvements a representative from the water department indicated that if we were to privately maintain the access, the City might be willing to furnish our yard water without charge. To date we have never received a quarterly billing for Meter #1. In September of 1992 we moved out of the house for renovations and upon returning last week found Meter #1 had been padlocked. As I conveyed to you this morning the lock was removed on Saturday but I would request that the City continue to furnish water for Meter #1 without charge. My reasoning for this is that the quarterly charge, we have been told, totals about $500.00 annually. For this the City, neighbors and visitors receive many benefits. We totally maintain the access, replant it every year, in the summer have the grass mowed once per week, in the winter every other week and make any repairs that are needed to the sprinkler system. In my opinion this more than compensates for the lost revenue the City would be receiving. City of Atlantic Beach May 3, 1993 Page 2 Most importantly, however, is the example our neighborhood has set by expending the funds necessary to make a beautification statement, that will hopefully be followed by others residents in Atlantic Beach, making it a better place to live. one other point I will make, since we have made these improvements the many people that use our access are far more considerate in keeping it free of litter and trash. Everyone including the visitors seem to take great pride in what we have done. on behalf of the neighbors around the 14th Street access I hope the City will continue to work with us on the water and I want to personally thank Crystal Morgan and Don Ford for their help and assistance in guiding us through this request.
