In early 2004 major renovations where started on a home located at 1897 Beach Avenue, adjacent to my home. Since that time my family friends and guests have not been able to enjoy our home and swimming pool. At various times We have been exposed to encroachment, property damage, noise, effects of parking congestion, paint over-spray , stucco mix blowing onto windows and house siding , lit cigarette butts being discarded across the fence onto wooding decks causing scorching of wood , airborne dust from pressure treated lumber being cut , Polystyrene (styrofoam) and concrete being cut, renovation materials being allowed to blew into my yard affecting my landscaping and swimming pool. My home is approximately 15 feet away from the home being renovated, being on the oceanfront there is almost always a breeze and many time a strong wind. Never have I seen any precautions taken to eliminate hazardous, potentially hazardous materials or debris from becoming airborne and coming onto my property and airspace. Nor has any effort been put forth to clean or remove the debris. Dust, stucco mix, paint, cement dust, and debris have at one time or another become airborne and has cause me and others on my property to be exposed to these hazardous and potential hazardous materials. I have constantly needed to drain my swimming pool water and refill with fresh water due to pressure treated lumber cutting dust, cement cutting dust, Styrofoam and construction debris getting in the swimming pool water . I have had to replace the swimming pool water circulating pump, filter and filter canister due to excess amounts of sand & cement dust from cutting concrete, styrofoam from trim installation getting into the pool water. The swimming pool maintenance is a great expense, but the effects of being exposed to suspected hazardous materials and dust is my biggest concern. Cement dust entering the swimming pool and causing equipment failure is one thing, breathing the dust that can causes lung damage and other breathing problems is another important issue and should be addressed and stopped. There is no reason to dry cut cement, styrofoam, or spray paint outdoors where dust and paint can become airborne and blow into other home owner's property. have many other concerns, too numerous to mention in this letter, but I will mention one about lit cigarette butts being discarded landing in mulch and wooden decks along the side of my home. This results in homes being very close together many times only fifteen feet apart. The end result is what one neighbor does to his home effects his immediate neighbors with a greater impact than if homes where 50 feet apart, noise while construction is going on only few feet away from a bedroom is no longer a subject to be ignored Before a major home remodeling, swimming pool installation or new construction permit is issued, considerations should be given to the adjacent property owners, the impact on the neighborhood in general and how the contractor or home owner will address the following issues. 1) Construction workers parking, will they car pool or will each worker drive to the job site? Where will they park? if each worker drives his car to the construction job site will it cause a parking congestion, blocking other people's driveways, cause damage to private property? 2) Approximate start and finish dates of any major repairs or construction after notice to commence letters are submitted and permits are issued. The codes should be revised and enforced to eliminate many months of adjacent neighbors losing the pleasure, peace and quite their homes. 3) Construction work hours should be limited to five days per week from 8 am to 5 pm. Saturday and Sunday and Holiday work should be prohibited where homes are less than 100 feet apart. Home owners do not appreciate machinery operating and workers playing radios next to their homes on weekends when work is being conducted a few feet away. 4) Noise and Hazmat control on job site (contact telephone number for complaints) FILE COPY 5) How contractor will handle and pay for any damage to public and private property while working on construction job site. 6) How contractor will handle and abate hazardous. Most of the concerns that you shared during our meeting do not violate any Atlantic Beach codes or State building code requirements that we enforce, although they have contributed to making your life difficult in recent months. Atlantic Beach has made it a practice to informally discuss with contractors the need to take extra measures to "be a good neighbor"when they are remodeling in close proximity to other homes. However, the issues you raised make it clear that we need to take a more formal approach. All such easements shall have a .width which is acceptable to the City. 7. City does not guarantee an uninterrupted supply of water, or water at any particular pressure, and reserves the, right to shut off the water in its main at any time for the purpose of making repairs or extensions of for providing temporary or emergency water supply. City will not be responsible for any damage caused by low pressure or interruption of service. Neither Developer nor,any of its successors or purchasers shall discharge into the sanitary sewer system water from "non-domestic" drains including without limitation switnmittg pools, air conditioning condensation lines, cooling lines or other discharge from any type of equipment. City shall. not be obligated to furnish any water or sewer service to any building which is built on Developer's property to which the City does not have access. The Developer hereby agrees and warrants that the City will not be held responsible for flooding problems which may result from the failure of sewer line back flow preventvr valves oil Developer's property. The Developer hereby agrees to hold harmless and indemnify City for all costs and damages resulting from flooding due to .back flow preventor valve failure. 8. A. if the Developer modifies his development plans for Developer's property which would require greater water usage, greater fire flows, additional water facilities, greater sewage flows, or additional sewage facilities than the water and sewer demands previously approved by ti►e City, the►t the Developer must obtain approval by the City for the construction of such additional water or sewer facilities which shall meet all City and governmental design requirements. 'lite Developer shall pay all additional contributions and fees as may be authorized by the City's service availability policy which is in effect on the date said new agreement is executed. 13. In addition to paragraph 911 above, any other change order between Developer and its utility contractor issued after City approval of original plans must be approved by the City before the change order is put into effect. . C. City shall have the right to review the systems design drawing and specifications to ensure that they meet the requirements of the City. The systems design drawing and specifications are to be in accordance with the City of Atlantic peach requirements unless otherwise .specified by City or its engineer. D. The City also reserves the right to approve the utility contractors to which construction bids are sent by Developer as well as the contractor to which the award is made. L. A representative of City or its engineers will be the absolute and exclusive owner of the facilities of said water and sewer systems whether located on, under, above or outside of the property described and regardless of who may have installed or constructed same to the extent described below: A. 1111 water mains, pipes, valves and fittings and appurtenances up to and including all meters shall be dedicated to and will be owned, operated a►►d maintained by Cite. 1111 water pipes on the customer's side of the meter shall be owned, operated• and maintained by the customer or its assigns. Except as provided in paragraph 9C, all sewer lines on the customer's side of the property line shall be owned, operated and maintained by the customer or its assigns. C. With reference to any blanket easements for multi-family projects such as apartments, mobile Dome developments, condominiums and PUU's or for coumnercial developments, all water mains to and including the water meter, all sewer mains, force mains and manholes in such blanket easements over private property allowing utility operations shall be dedicated to and shall be owned, operated and maintained by th► City except that the full length of sewer services from the sewer main or manhole shall be owned and maintained by the customer, All such City lines shall terminate wits► a manhole, D. All plant capacity and service availability charges, tees and other charges as outlined above 'are based on normal domestic sewage defined herein as containing not more than .three hundred (300) parts per million biochemical oxygen demand or three hundred (300) parts per million suspended solids. Whenever water which contains more 'than these amounts is to be admitted to the sewers, both the City and the pollution control agencies must.l.. specifically agree to the connection. An additional charge will be calculated in direct proportion to strength at seventy-five cents ($0.75) for each part per million of either biochemical oxygen demand or suspended•� solids over three hundred (300) parts per million. All such .connections shall provide for a suitable point for the haste to' be sampled by the City or the regulatory agencies.
