I have lived at 1373 Beach Ave. since 1974 (28 years). Never in all my years of construction and living in Atlantic Beach, have I been so insulted as I was today, December 3, 2002 My wife and I went to breakfast this morning in her car and when we returned home at approximately 9:30am, a painter employed by Duncan Painting Inc. was spray painting white lacquer paint within 15 feet of the front of my Ford Explorer. In addition, he was doing the painting on the city right-of-way, not on the Easton's property. I said good morning, and I said he shouldn't be spray painting so close to the cars. Basically I was told by him 'T..you, you have no right to tell me what to do". He said he was not using paint (what is the difference between white lacquer and paint?) and that he had put a 4' x 4' piece of visqueen to protect my car and he started back painting again. I objected again and he then went and talked to the homeowner and the contractor. I also went to the contractor and told him that I wanted my car and my wife's car covered. I was not going to move the cars since the painter and the contractor did not ask me before they started to paint. Because of the A4T*W ' 'tsrt nt and being sworn at by Mr. Duncan's employee, the ontractor should have removed him from the job. Instead, the painters went on and painted the rest of the day. No tax paying resident of Atlantic Beach should have to put up with such disrespect and insinuating threat that I'm old. The Contractor should have removed the painter immediately and stopped spray painting on the city right of way, am insisting that Duncan Painting Co. have thd' ' . This is an intolerable situation and one that should not have happened and don't think a written apology is acceptable under this situation. ITEM NUMBER 2: Back in April or May 2002, the footer contractor ran a front end loader across the front of my yard making 8 distinctive ruts into my front yard. I have photos showing the damage done. My wife, trying to be a good neighbor to the Eastons said she would wait until the Eastons started landscaping their yard to have the ruts taken care of. Mrs. Easton canceled the meeting in October and in light of what happened this morning, I wanted Mrs. Easton and the contractor to go out and look at the front of my yard. Mrs. Easton was too busy to walk to the ocean side and look at our problem. The contractor, my wife, and I went to the front yard where the contractor had had two day labors spend a half hour back in September throwing a couple of shovels of dirt in the ruts. In all my years of contracting, it has always been the general contractor as the person of final responsibility for the job. I don't know if Atlantic Beach has a separate permit for landscapers, but according to the State of Florida the General Contractor has the final responsibility for everything that happens on the job site. In addition, there was a boulder, 2 feet long and 10 inches high thrown in my yard from the Eaton's property. The contractor said it was not his responsibility but he removed it at my instance. I'm tired of all the ill regard that the contractor has had saying that it is not his responsibility about the front end loader that crossed my yard and caused the ruts. I want you to come out and make an appointment and meet with me regarding both of these items. Because the contractor told me it was not his responsibility to fix every rut in my front yard. As a tax payer in Atlantic Beach, I want my yard fixed now. It will have to be filled in by hand, raked, and rolled. There will be no machines on my property. And again t know the contractor is liable for damage done to my front yard. At 11 am today the contractor said he didn't know the name of the landscaper and was going to call my wife or me with the date of when the repair work was going to be done. He was to call us by 6 p m, today the time the repair worts would be done. At 6.30 this evening, the contractor and Mrs. Easton met on the street. Mrs. Easton said they do not have a landscape contractor, they have two bids. Therefore, there is no firm date when the landscaping will be done. This is very unprofessional and the contractor should be fined accordingly. Ford Subject: 14th St. Access temporary use On August 29th' Sonya Doerr and I met with Mr. and Mrs. Storn of 1373 Beach Ave. to discuss the request by William Easton to be permitted to use the ROW at the 14th St. access for construction traffic. We met for about one hour and discussed several topics including: • Process for using the access—utility permits • Bond to cover damage to utilities and landscaping • Protection of the access during construction • Restoration of access after construction completed • Other accesses that have been used for construction access • Fact that the site is surrounded on three sides by other buildings and the ocean • Setbacks for the site including oceanfront • Plans for the proposed structure • Front deck for the proposed structure The Storns were very concerned about the closeness of the proposed structure and the deck to be built further seaward than their house. We explained the seaward line of construction is controlled by the state and we have no control over this. We also advised the Storns that engineering and construction plans had not yet been submitted to the City and that we would fully review these issues at the time such plans were submitted. Bob Kosoy and George Worley have previously met with the Storns and discussed many of these issues. Bob has given the Eastons a letter stating they would be allowed to use the ROW with conditions. Residents have previously been allowed to use these ROWs and beach accesses during periods of construction where access to the ocean side of their lots was restricted. S. A. Easton Dear This letter is being written on August 24, within the seven day limit as specified in your letter of August 17th. Please note that while your letter was written on August 17 it was not mailed until five days later and was not received by me until the deadline date to make public comment. However, I am writing to you immediately in order to ensure that my comments and concerns are heard and are duly noted. My concerns are as follows: Appropriate siting of the proposed construction with respect to local setback, zoning restrictions, and maximum usage of upland portions of the property. The second f loor porch extends approximately 10 feet beyond the front edge of my house. Less than 5 years ago, when I requested authorization to extend the front edge of my house with a open porch,I was told by the City page 2 of 4 of Atlantic Beach, that I could not extent the front edge of my house in this manner because of the beach set back line. If I am not allowed to do this, then the Easton should not be allowed. If this porch is allowed,the combination of the Easton's home and porch would block the prevailing northeast winds vital to cool my house. According to the site plan, no provisions have been made to increase parking. Currently the Eastons park one car in a drive way and the other car horizontally on the street. Due to the narrowness of Beach Avenue and the close proximity of the Beach Access Walkway, this lack of a clear street can be a emergency vehicle nightmare. The site plan appears to eliminate the current driveway in favor of a walkway. This would require both vehicles to park horizontally on Beach Avenue adding to an already overcrowded situation. Expected impact of the proposed construction on nesting sea turtles and hatchlings and Asir habitat. A three story house will emit nighttime light at a higher level than the surrounding homes, which are set back and down behind the sand dune. As you know, during sea turtle nesting time, the necessity of zero beachside lighting if vital to ensure the sea turtles hatchling a safe return to the ocean. Expected impact of proposed construction on lateral public beach access. The Easton plan to use the 14th Street Beach Access as a way of accessing men and machinery to the site. This would require destroying a major part of this fully landscaped Access. The 14th Street Beach Access was the first Access in Atlantic Beach to be fully landscaped. All the work was completed by the neighbors and all the plants were gifts from each neighbor's garden. This Access is actively used by all the neighbors many t page 3 of 4 with small children. To have the Access tied up by lard machinery for six to nine months is not acceptable. Expected impact of the proposed construction to adjacent properties. The positioning of the front edge of the Easton's house, on the oceanside, is exactly in line to my house. This positioning blocks the prevailing northeast winds which is vital to cooling my house. Furthermore, this also blocks the Northeast view from both the upstairs and the downstairs windows of my house. It will require that the blinds of the master bedroom and the livingroom/dining room windows be drawn at all times for privacy. Drawn blinds will also further inhibit the wind's ability to cool the house. The Easton house is shown as a three story house. This is totally out of character with the ocean front neighborhood. There are no three story homes on the ocean front within a eight block area (with the exception of one home which was built 60 years ago). Furthermore, the house will be of concrete construction, again out of context with the ocean front neighborhood. All other homes in ten block area are frame homes with cedar shake shingles. A three story concrete home among two story old Florida ocean side home will destroy the authenticity and historical ambiance of the ocean front neighborhood. Under the new building codes the necessity of concrete pilings and a massive concrete foundation for a three story house could seriously damage the foundation of our 71 year old home since we are all !wilt on the same stable sand dune. The new house will be within 20 feet of our home. Several years ago, work by the Corp. of Engineers on the ocean front 100 feet away caused cracking in our foundation. I am extremely concerned about similar construction only 20 feet away. t page 4 of 4 Expected impact of the proposed construction to beach/dune system. On the site plan, as best as we can tell,the landscaped play area is going to be something that is below the existing ground level; again, disturbing the natural ground within 20 feet of our house. The Easton have already begun to remove vegetation which has been in place for more that 25 years. Further cutting of vegetation could cut into the same dune which would change the environment.
