Signs over fifty (50) feet in area, and/or any sign which
is more than seventeen (17) feet above the ground, or any
sign weighing more than one thousand (1,000) pounds, must
be submitted with drawings from a registered engineer.
Signs with a solid area greater than 0 thirty (30) square
feet must be erected to withstand a wind pressure of at
least thirty-five (35) pounds per square foot. Drawings

Your considered attention to the history of and the recent facts
concerning the Beaches Aquatic Pool INFORMATIONAL AND DIRECTIONAL
SIGN is respectfully requested .
The history of the previously "grand f athe red" SIGN, which was
situated within the (now dedicated ) Aquatic Drive right-of-way,
extends back more than two decades .
During the mid-1960 ' s , the Beaches Aquatic Pool was constructed
on lands donated by Mr. John Blow. The donated lands included
the present swimming pool site , the tennis courts , the Aquatic
Gardens retention pond , and the AQUATIC DRIVE RIGHT-OF-WAY.
As a neighborly accommodation, Beaches Aquatic Pool deeded the
Aquatic Drive right-of-way to the late Mr. Ron Crofton (developer
of Aquatic Gardens) . Thereafter, the right-of-way was included
in the Aquatic Gardens Record Plat and dedicated to the City of
Atlantic Beach .
For approximately five years (after the right-of-way dedication)
the Sign remained in its long-standing location without contest .
Clearly, a "grandfathered" status existed .
Approximately one year ago , the adjacent property owner, during
land clearing of his parcel , caused the sign to be destroyed .

As a result of legal action , Beaches Aquatic Pool received a
court ordered compensation for the aforementioned loss. With the
funds received, Beaches Aquatic Pool replaced the (previously
destroyed) SIGN.
Recently, the City of Atlantic Beach received written objection
from the adjacent property owner concerning the replacement
sign .
During my recent extended absence from the City, notice to remove
was given by the City to Beaches Aquatic Pool . The end result
was the City of Atlantic Beach personnel removed the SIGN from
the Aquatic Drive right-of-way.
The City Commission is respectfully requested to recognize and
approve the re-installation of the INFORMATIONAL AND DIRECTIONAL
SIGN within the right-of-way of Aquatic Drive for the following
reasons :
1 . Beaches Aquatic Pool serves a Positive public purpose . The
public Purpose includes : swimming lessons , swimming team
senior citizen aquatic exercise program, family swimming , and'
other community services .
2. The SIGN existed prior to the dedication of Aquatic Drive;
accordingly, a "grandfathered" status existed .
3 . The SIGN was destroyed by overt action by an unrelated party.
The SIGN was not allowed to either decay, deteriorate or be
discontinued by Beaches Aquatic Pool .
4 . The present sign ordinance, when adopted , failed to identify
and include mitigation in instances of either vandalism or
illegal acts.
Upon receipt of your approval for re-installation of the INFORMA-
TIONAL AND DIRECTIONAL SIGN, Beaches Aquatic P001 will coordinate
with and cooperate with the City of Atlantic Beach as to any
alternative specific sign location.

I have your communication regarding the Aquatic
Pool, enclosing copy of letter of Justin C. Montgomery, and
a note to the Mayor from Mr. Weldon.
You state that the Commission requested I again
review this matter.
Ican add nothing to the two letters I have heretofore
written on this subject to the Commission. Mr. Montgomery' s
letter does not appear to me to reach the problem. As heretofrre
stated, to be exempt from ad valorem taxes, the property must be
used by a non-profit corporation for one or more of the purposes
for which exemption is granted by the Constitution and Statutes
of the State of Florida. These have been fully referred to in
my prior communications. The fact that the owner is a non-
profit corporation or that its revenues are exempt from Federal
income tax, does not answer the question.

Dear Mr. Weldon:
I have your letter of June 8 regarding Beaches
Aquatic Pool, Inc. , and in which you ask if there is a legal
basis on which the corporation may be granted exemption from
ad valorem taxation by the City of Atlantic Beach.
Section 110 of the City' s Charter provides:
IIAll property within the City not expressly
exempted by law shall be subject to an
annual taxation at its full cash value.
And Section 192. 01, Florida Statutes, similarly provides:
"Unless expressly exempted from taxation,
all real and personal property in this
State, and all personal property belonging
to persons residing in this State, shall
be subject to taxation in the manner provided
by law.

Section 1, Article IX of the Florida Constitution
provides for the exemption of such property from taxation as
may be used for municipal, education, literary, scientific,
religious or charitable purposes.
Section 16 of Article XVI of the Florida Constitution
provides:
..The property of all corporations, except the
property of a corporation which shall construct a
ship or barge canal across the peninsular of Florida,
if the Legislature should so enact, whether heretofore
or hereafter incorporated, shall be subject to tax-
ation unless such property be held and used exclusive-
ly for religious, scientific, municipal, educational,
literary, or charitable purposes. 11
Section 192. 06 of the Florida Statutes provides for
the exemption of property as authorized and limited by the
Constitutional provisions and provides, so far as relevant here,
as follows:
., 192. 06. Property exempt from taxation.
The following property shall be exempt from taxation:
(3) Such property of educational, literary, benevolent,
fraternal, charitable and scientific institutions
within this State as shall be actually occupied and
used by them for the purpose for which they have been
or may be organized; * * * *Educational institutions
as used in this chapter shall mean tax-supported
parochial, church and non-profit private schools,
colleges or universities conducting regular classes
and courses of study required for eligibility to,
certification by, accreditation to, or membership
in, the Southern Association of Colleges and Secondary
schools, State Department of Education, or the Florida
Council of independent schools * * * *. "

The fact that a corporation may have been organized
as a non-profit corporation, pursuant to corporate statutes,
and even though its charter may declare that it has been organ-
ized for religious, scientific, municipal, educational or
charitable purposes, does not alone give it tax exemption.
There must also be an exclusive use of the property for one
or more purposes mentioned in the Constitution and the Statutes.
Since the criterion for exemption is the use to which
the property is put and not the character of the ownership, the
question becomes principally one of fact, and not of law, to
be determined in the first instance by the Assessor.
in your letter you point outtliat this corporation
is exempt from Federal Income taxes under the Internal Revenue
Code. The provisions of that Code exempting certain non-profit
organizations from payment of income tax is much broader in
scope than the provisions of our Constitution and Statutes re-
ferred to above.

I wo4ld like to bring to your attention., although reluctantly
in view of the constant patrolling of the Atlentic Beach Police
Force, that we have been plagued recently by vandalism at our
Beaches Pool.
Apparently, youngsters crawl over the wall and thro-v rocks
in the Pool and through the wJ.ndows.
Just recently they have broken four letters of our outdoor
s 1 damaged 5 windows, and smashed two flood lights. This

I am not asking the City for arV damages, nor am I implying
that more patrolling is required, but we are very proud of this
facility and I �m sure the City is too., so all I am asking is

Gentlemen:
You have requested me through City Manager Mr.
Printon to advise you whether Beaches Aquatic Pool, Inc. is
eligible for the tax exemption requested in the letter of
Mr. Robert G. Stormes of January 15th to you.
Apparently Mr. Stormes' view is that since this
corporation is a non-profit corporation organized under
Chapter 617 of the Florida Statutes, it is eligible for the
requested exemption.
The fact that the corporation is a non-profit
corporation does not standing alone entitle it to exemption
of taxes upon its property. By Statute the property of
certain non-profit corporations devoted exclusively to certain
specified uses is exempt from ad valorem taxes, but from the
information before me the property of this corporation and
the purpose for which it is used, do not meet the requirements
of any tax exemption statute. The purpose for which the
property is used is the test as to whether it is exempt from
taxation though the ownership might be in a non-profit
corporation.

Sign area shall be computed as the smallest square rectangle,triangle,circle or combina-.

(b) The following signs,are permitted in the city,subject to the restrictions set out below:
(1) Flat s ns. A flat sign is any sign erected parallel to the face of or on the outside of
any building and supported through its length,by such wall,or any sign in any way
applied flat against a wall.Such signs shall not in any case project more than twelve
(12)inches from the face of the building, nor shall they extend above the a(Ijoining
eave line on a building with a pitched roof.No portion of any such sign which extends
over city property shall be less than eight(8)feet above the sidewalk grade of any
street or avenue,or fifteen(15)feet above the crown grade where the sign is located
parallel to and abutting on an alley. No flat sign shall utilize'or occupy an area
greater than fifteen (15) percent of the side of the building to which the sign is
attached.
(2) Hor
-_ntal jorgLecting signs. A horizontal projecting sign is any sign projecting at an
angle ro t e outsi e wa of any building and which has its greatest dimension in a
horizontal plane. These signs shall not have more than sixty (60) square feet of
horizontally projected area, as calculated from any angle. There shall be not over
twelve(12)inches of clear space adjacent to the bui'lding'wall,and the signs shall not
extend or project from the face of the building more than ten(1.0)feet.No part of the
sign shall extend above the top of the adjoining p*arapet wall on a building with a flat
roof or above the adjoining eave line on a building with a pitched roof.No part of any
such sign shall be closer than eight(8)feet to any sidewalk or pedestrian walkway,
nor closer than twelve(12)feet to any street,alley or highway where vehicular traffic
may move. All such signs shall be anchored to a wall and shall in no manner be
connected to or suspended from the roof of any building.
(3) Verticalprojectin s!gns. A vertical projecting sign is any sign projecting at an angle
from the ou7ii�idewa�o any building and which has a vertical dimension equal to or
exceeding the horizontal dimension.Such signs shall not have more than ninety(90)
square feet of horizontally projected area,as calculated from any angle;and shall not
project more than four(4)fact from the building to which they are attached,nor shall
the vertical height of the sign exceed eighteen(18)feet.No part of any such sign shall
extend more than six(6)feet above the top oft the adjo!nIng-parapet-Wall or'a bWldiiig
with a flat roof,nor more than six(6)feet above the adjoining eave line on a building
with a pitched roof. All such signs shall be anchored to the wall and shall not be
connected to or suspended from the roof of any building.
(4) Eoo
Isign A roof sign is any sign erected completely over the roof of any building.
TKese'signs shall have not more than one hundred eighty(180)square feet of horizon-
tally projected area,as calculated from any angle.The overall height above the roof
shall not exceed fourteen(14)feet. Any such sign shall have a clear space immedi-
ately above the roof of not less than seventy-five(75)percent of its length.Roof signs
shall be placed so that the least distance from any building line measured perpendic-
ular to the face of the sign shall not be less than the total height above the roof. No
roof sign shall extend horizontally past the building lines of the roof.
(5) EakjknLA pole sign is any sign erected on one(1)or more poles and which is wholly
or partially independent of any building for support.'Mesa signs shall have not more
than one hundred eighty (180) square feet of horizontally projected area, as calcu-
lated from any angle,and shall be limited to one(1)square foot of area for each lineal
foot of frontage of the lot on which the signs are placed. The height of any self-
supporting sign shall not exceed thirty-five(35)feet. One(1)such pole sign shall be
allowed on the street side of each lot;provided,where'a lot faces on more than one(1)
street,then one(1)such sign shall be permitted on each street side of the lot.Where a
pole sign is located on property.used as a shopping center, the pole sign shall be
limited in area to on (1)square foot of area for each lineal fo�t' of frontage of the lots
or parcel of land upon which the shopping ceifter is located--and on which the pole
signs are placed; provided, no pole sign for the'shopping center shall exceed three
hundred (300) square feet of horizontally projected area, as calculated from any

History of Aquatic Drive Retention Pond

Following is a chronological history of the ownership and maintenance of the Aquatic Drive
pond as described by Alan Potter to Jim Hanson on October 15, 2002.
Prior to 1961,the land fronting on Atlantic Boulevard and including the property that is
presently occupied by the Aquatic Pool, the Aquatic Drive Pond,the abandoned tennis
courts on the west side of Aquatic Drive as well as the Aquatic Drive right-of-way where
all part of a larger parcel owned by John Blow, an electrical contractor.
In 1961 or 1962, a large hotel in Jacksonville Beach was closed. The hotel had included
a pool that had been used by the Fletcher High School swim team. Coach Wimpy Sutton
was in charge of the swim team at the time. Because the pool that had been available to
the swim team was no longer open, area leaders began to look for a new location for a
pool.
John Blow donated the property that was later developed into Aquatic Drive,the Aquatic
Drive pool, the pond and the tennis complex all as one parcel for the development of a
community pool(presently called the Aquatics Center).
The pool was developed and operated for approximately the next 20 years. The access
driveway to the pool and the pool property were all that were developed, the rest
remaining vacant.
In approximately 1982 the Aquatics Center had developed some financial problems and
was having a difficult time making ends meet. They were approached by a developer
who planned to build the Aquatic Gardens subdivision. The developer offered to buy
memberships for all of the future owners of his subdivision(about 124) and agreed to
build the tennis courts on the west side of the pool access road, which was to be opened
as a public street and named Aquatic Drive. The pool owners transferred the pond and
tennis courts parcels to the developer so that he could build the tennis courts and the pond
through the proceeds of his financing for the subdivision. The two parcels were to be
later deeded back to the pool owners after the construction was completed. The property
for Aquatic Drive was also deeded to the developer, and was intended to be dedicated as
a public street after the opening of the new subdivision.
Sometime before the completion of the subdivision,the developer was murdered by his
wife who was later convicted and sentenced to jail. His lender then took over the project
and completed the development.
When the development was completed,the road(Aquatic Drive) was deeded to the City
of Atlantic Beach and an easement was given to the City for the pond property as well as
all other drainage facilities in the subdivision for"drainage and utilities". Per Mr. Potter,
that easement still exists.
With the completion of the development,the pond and tennis court parcels were deeded
back to the Aquatic Center.
The City began maintenance of the pond immediately upon completion of the subdivision
in approximately 1982 and continued to maintain the pond until approximately 1993. Per
Mr. Potter,the City stopped maintaining the pond property shortly after Jim Jarboe
became the City Manager.
The pool association later put up a fence along the west side of the pond because of some
vandalism that had occurred.
The governing board of the Aquatics pool is a tax-exempt organization. At one point in
time, Duval County stripped them of their tax-exempt status, which they have since
regained. However, the Tax Assessor concluded that the pond property was not directly
part of the pool and therefore not tax-exempt. After that decision, the Aquatic Center
paid the taxes on the pond for a few years. Later,they stopped paying taxes because they
saw no value of the pool to the continued operation of the Aquatics Center.
An attorney then bought the tax certificates on the pond property from the Tax Assessor
thinking that it contained six residential lots that could be resold. He approached the
Aquatic Center to buy the lots and then was told that the property was a retention pond.
That attorney then stopped paying taxes also.
Next, a couple in Port Orange bought the certificates and also contacted the Aquatic
Center offering to sell the property. Per Mr. Potter,they had never seen the property and
also did not realize that it was a retention pond.
This brings the ownership and maintenance (or lack of maintenance) up to the current
status.
