Dear Mr. Ford:
Thank you for speaking with me recently regarding the
captioned property (the "Property") 'and our client, Mr. John
Shields .
It is my understanding, based upon our recent conversation,
that your office has received complaints to the effect that the
Property is being occupied by tenants who come and go at odd hours
and who own numerous vehicles and park the same on the Property.
We recently discussed the terms and provisions of our recent
conversation and your letter dated October 11, 1991, with Mr.
Shields, who advises that the Property is part of a larger
townhouse unit which is located in a neighborhood that is comprised
primarily of similar type townhouse units. Additionally, Mr.
Shields believes that a great deal of these townhouse units are
tenant occupied. Mr. Shields further advises that the Property is
a three bedroom, two bath, unit and is presently occupied by three
adults .
Under the circumstances, we do not believe that it woUld be
appropriate for the City of Atlantic Beach to construe Mr. Shields '
use of the Property as a violation of Chapter 24 of the Atlantic
Beach Code (the "Zoning Code") for the following reasons :
First, we have been advised by Ms. Pat Harris of the Building
and Zoning Office of the City of Atlantic Beach that the Property
is located in Zoning District RG-2 which, according to Section

24 . 107(b) of the Zoning Code, permits multi-family dwellings such
as the townhouse wherein the Property is located. Thus, the
Property is a "permitted use" in the RG-2 Zoning District. This
is consistent with the definition of "townhouse" as defined in
Section 24 . 17 of the Zoning Code. When I initially reviewed your
letter, I was under the impression that the Property was a single-
family residence in a typical single-family detached dwelling
subdivision. However, it appears that the Property is located in
a zoning district that is zoned for dense, multi-family units that
are typically leased by the owners thereof to one or more tenants
and it therefore seems inequitable to impose a "single-family
detached house" standard to this type of dwelling.
Second, the Property is a three bedroom, two bath unit 'and I
believe it is customary for three adults to comfortably occupy such
a unit without creating a "nuisance" . For example, assume that the
Property was occupied by a husband and wife and two adult children.
Surely, this would not be a violation of the Zoning Code yet four
adults would occupy this one unit. Why then should it be a
violation of the Zoning Code in this instance when only three
adults occupy the Property?
Third, you stated that the complaints that you received from
other residents in the vicinity of the Property concern the number
of automobiles parked on the Property. It is my understanding that
there are never more than three automobiles, one for each tenant,
located on the Property. Note that Section 24 . 161 of the Zoning
Code requires that properties located in the RG-2 Zoning District
have to have at least three parking spaces and I am advised that
such is the case with respect to the Property. As such, we do not
believe that three cars parked on the Property could be construed
as a violation of the Zoning Code.
Lastly, you stated that the complaints that your office
received concerning the Property were that the tenants were coming
and going at odd hours . I would submit that this type of activity
Js typical for a rental community such as the townhomes located on
Aquatic Drive.
For all of the foregoing reasons, we would appreciate it if
you would consider the issues raised in this letter, review the
nature of the complaints that you have recently received with
respect to the Property, and generally reconsider your letter of
October 11, 1991 . It is my understanding, based on our recent
conversations, that the thirty day deadline imposed by your October
